HomeMy WebLinkAbout03-08-65 Council Meeting MinutesREGULAR MEETING MARCH 8TH, 1965 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, March 8, 1965, at 8 :00 P.M., with all members present. The Meeting was called to order by President John L. Hunter Jr., who.presided. President Hunter introduced the Reverend Clifford 0. Nantz, Executive Secretary of Council of Churches of St. Joseph County, who gave the invocation. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meetings of the Council and found them correct. Richardson, Jr., President of the First District Democratic and Civic Association opposing the removal of Fire Station No. 6 from its present location on Portage Avenue. Councilman Geib made a motion that the communication be accepted and placed on file. Councilman Szymkowiak seconded the motion. Motion carried. PETITION Petition of William E. and Marilyn Dvorak and Richard E. Landgraf to rezone Southeast corner of Rinyon and Porga* Ave. from "B" Residential Use District and "B" Height and Area District to "C" Use District and "B" Height and Area District. Councilman Wise made a motion that the petition be referred to the City Planning Commission. Councilman Palmer seconded the motion. Motion carried. PETITION Petition of Oxford DeveiopmentCorporation to rezone tract of land bounded on the North by Darden Road, on the East by Riverside Drive, on the South by North boundary of Riverside Manor 2nd Addition from "A" Residential Use District to "A -2" Residential Use District. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of John H. and Maude A. Mink, et al, to rezone Southeast corner of Miami St. and Lincoln Way East, excluding gasoline station on corner, from "B" Residence District to "C" Commercial District. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Allen seconded the motion. Motion carried. PETITION Petition of Joseph M. and Tina A. Zappia to rezone three lots immediately West of "Capri" Restaurant located at 2104 Edison Road from "A" Residential to "C" Commercial District. Councilman Allen made a motion that the petition be referred to the City Planning Commission. Councilman Palmer seconded the motion. Motion carried. REPORT OF CITY PLANNING COMMISSION February 17, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A -1" Residential Use and "A" Height and Area District the property generally described as being bounded on the East by the first north -south alley West of Marine Street and by Mumford Court, on the West by the first north -south alley East of Miami, on the South by the first east -west alley South of Bowman Street and on the North by Indiana Avenue was legally advertised under date of January 25, 1965 and given public hearing on February 4, 1965. The following action was taken: After due consideration the Commission found that the proposed zoning would be in the best interest of the subject area. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council February 17, 1965 City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A -1" Residential Use and "A'' Height and Area District the property being generally described as bounded on the East by Leer Street, on the Wdst by the first north -south alley West of Marine and Mumford Court, on.the North by,Indiana Avenue,,and on the South by,the rear lot line of lots fronting on the North right -of -way line of Bowman:,-Street was .legally advertised under date of January 25, 1965 and given public hearing on February 4, 1965. The following action was taken: After due consideration the Commission found that the proposed zone change would be in the best interest of the subject property. Central Railroad, and on the south by Calvert Street was legally advertised under date of January 25, 1965 and given public hearing on February 4, 1965. The following action was taken: After due consideration the Commission found that the predominant use in the subject area is single family residential. REPORT OF HOUSING COMMITTEE TO THE COMMON COUNCIL Item 1: One individual questioning of real estate availability- disposed of to the satisfaction of parties concerned, at a meeting held February 17, 1965. Item 2: Meeting of interested parties concerning purchase of a house, delayed by reason of both parties being out of town and both requesting a meeting be set up for a date after March 13. ORDINANCE NO. 4733 - -65 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND SEWAGE TREATMENT PLANT AND THE MEMPHIS EQUIPMENT COMPANY FOR THE PURCHASE OF REO SERIES "M" 2'k TON 6 WHEEL DRIVE TRUCK IN THE SUM OF $4,995.00. The ordinance was given first reading by title and second reading in full. Councilman Wise made a motion for suspension of rules. Councilman Szymkowiak seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE, FIRST & SECOND READING AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE GENERAL FUND TO THE PRINTING ACCOUNT OF THE OFFICE OF CITY CLERK IN THE AMOUNT OF $2,000.00, The ordinance was given first reading by title and second reading in full. Councilman Smith asked that Department heads send Councilmen a letter of explanation for the requests. ORDINANCE, FIRST & SECOND READING AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE GENERAL FUND AND TRANSFERRED TO THE BUILDING DEMOLITION REPAIR AND CONTINGENT FUND IN THE AMOUNT OF $7,500.00. The ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the ordinance be set for public hearing on March 22, 1965. RESOLUTION NO. 94 - -65 RESOLUTION FOR AN ADDITIONAL APPROPRIATION IN THE LAND ACCOUNT OF THE SANITATION DEPARTMENT IN THE AMOUNT OF $1000.00 AND THE TRANSFER OF THE SAME FROM THE MOTOR EQUIPMENT ACCOUNT IN THE SAME CATEGORY OF THE SANITATION DEPARTMENT, ALL WITHIN THE GENERAL FUND. WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing annual budget; so that it is now necessary to appropriate more money than was appropriated in the annual budget for the various functions of City Government to meet such extraordinary contingencies; and, WHEREAS, Funds for land improvements are urgently needed by the Sanitation Department to assure its ability to properly perform its function and the sum of One Thousand ($1000.00) Dollars is needed forthwith; and, WHEREAS, A surplus exists in another account where it is not presently needed at this time; and more specifically as follows, to -wit: 1. One Thousand ($1000.00) Dollars in Account XX -722 designated as Motor Equipment Account. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, that the sum of One Thousand ($1000.00) Dollars be transferred to Account XX -73 designated as Land Account, by transferring it from Account XX -722, both of said accounts being in the same category, to -wit: Properties, of the Sanitation Department all within the General Fund. Motion carried by a roll call vote of 9 ayes - 0 nays. UNFINISHED BUSINESS Councilman Allen instructed the Clerk to notify the City Planning Commission that all petitions and papers pertaining to rezoning carry a descriptive line at the top of the paper, giving the general description of the property for quick identification. NEW BUSINESS: Mr. Kenneth Beck, 1601 E. Bowman St., appeared before the Council to complain that the City's installation of a new culvert and grate at Twyckenham Drive and C1yde.;Street did not solve the problen of flooding in the area. The matter was referred to the Street Department. REGULAR MEETING ranavra w i w NEW BUSINESS Mr. Kenneth Powell, 2101 Oak Park Dkfve, asked the Council for assistance to obtain relief from patrons of Eddie's Restaurant, 1345 N. Ironwood Drive, who park their cars on the sidewalk and push cement wheel bumpers from the restaurant's parking lots into the street. Councilman Hunter informed Mr. Powell that the Council would take whatever steps are possible to make the patrons conform to legal requirements in their parking habits. There being no further business before the Council, Councilman Geib made a motion to adjourn. Councilman Smith seconded the motion. Motion carried and Council adjourned at 9:45 P.M.
