HomeMy WebLinkAbout12-14-64 Council Meeting MinutesREGULAR MEETING DECEMBER 14, 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, December 14, 1964, at 8:40 P.M., with all members present except Councilman Muszynski. The meeting was called to order by President John L. Hunter Jr., who presided. a REGULAR MEETING DECEMBER 14- 1964 ROLL CALL PRESENT: ABSENT: REPORT OF COMMITTEE ON MINUTE Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Glass, and Smith. Councilman Muszynski. To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. PETITION Petition of Humble Oil and Refining Company to rezone tract of land at Lincoln Way West and Ryer Street. Councilman Szymkowiak made a motion that the petition be referred to the City Planning Commission. Councilman Smith seconded the motion. Motion carried. PETITION Petition of Clarence W. Dockery and Martha Dockery and Roland Salk to rezone tract of land on Hickory Road and McKinley Highway. Councilamn Smith made a motion that the petition bw referred to the City Planning Commission. Councilman Szymkowiak seconded the motion. Motion carried. (Location: Southwest corner of Keller St. and Bendix Drive). REGULAR MEETING DECEMBER 14 1964 REPORT OF CITY PLANNING COMMISSION To the Common Council of the City of South Bend: December 14, 1964 Your Committee of the Whole to whom was referred "AN ORDINANCE ESTABLISHING A SCHEDULE OF RATES AND CHARGES FOR SERVICES RENDERED BY THE WATER WORKS SYSTEM OF THE CITY OF SOUTH BEND TO AREAS OUTSIDE THE CORPORATE LIMITS AND REPEALING ORDINANCE NO. 4651, PASSED MAY 11, 1964 AND ENTITLED, "AN ORDINANCE ESTABLISHING A SCHEDULE OF RATES AND CHARGES FOR SERVICES RENDERED BY THE WATER WORKS SYSTEM OF THE CITY OF SOUTH BEND TO ARMS OUTSIDE THE SOUTH BEND CITY LIMITS ". Motion carried.- REPORT OF CITY PLANNING COMMISSION December 8, 1964 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A -1" Residential Use and "A" Height and Area District the property generally described as being bounded on the East by Leer Street, on the West by the first north -south alley East of Miami Street, on the North by the first east -west alley South of Bowman Street and the rear lot line of lots on the north side of Bowman Street, and on the South by Ewing Avenue was legally advertised under date of November 23, 1964 and given public hearing on December 3, 1964. The following action was taken: After due consideration the Commission found that the proposed zone change would be in the best interest of the subject area. ORDINANCE, FIRST & SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 3925 ENTITLED AN ORDINANCE PROVIDING FOR THE COLLECTION AND DISPOSAL OF GARBAGE AND TRASH AND PROVIDING PENALTIES TO PREVENT AREAS WITHIN THE CITY LIMITS OF THE CITY OF SOUTH BEND FROM BECOMING AND BEING USED AS LAND -FILL AREAS. The ordinance was given first reading by title and second reading in full. Councilman Wise made a motion that the ordinance be referred to the Ordinance Committee and for public hearing on January 25, 1965. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE, FIRST & SECOND READING AN ORDINANCE REPEALING SECTIONS 16 TO 36, INCLUSIVE, OF CHAPTER 35 OF ORDINANCE NO. 4608 - -63, BEING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO EXCAVATIONS AND OBSTRUCTIONS IN STREETS, ALLEYS, AND PUBLIC PLACES AND SUBSTITUTING NEW SECTIONS IN LIEU OF THOSE REPEALED. The ordinance was given first reading by title and second reading in full. DEFINING RESPONSIBILITIES OF PARENTS OR GUARDIANS OR OTHER HAVING THE LEGAL CARE AND CUSTODY OF MINORS "UNDER THE FULL AGE OF EIGHTEEN (18) YEARS AND PROVIDING FOR PENALTIES AND ARRESTS FOR VIOLATIONS THEREOF, DESCRIBING CERTAIN PROCEDURES IN THE APPREHENSION AND PROCESSING OF SUCH MINORS UNDER THE FULL AGE OF EIGHTEEN (18) YEARS AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. INDIANA, ACTING BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND SAFETY, AND NORTHERN INDIANA TRANSIT, INC., ITS SUCCESSORS AND ASSIGNS, WHICH SAID CONTRACT RELATES TO THE RATES CHARGED FOR BUS TRANSPORATION SERVICE UPON CERTAIN STREETS AND HIGHWAYS IN SAID CITY. REGULAR MEETING DECEMBER 14, 1964 RESOLUTION NO. 87 - -64 A RESOLUTION APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND MIDLAND ENGINEERING COMPANY, INC., FOR ROOFING AND FLASHING REPAIRS TO THE 6,000,000 GALLON CONCRETE RESERVOIR AT THE NORTH PUMPING STATION. WHEREAS, damage has been incurred to the roof of the water reservoir at the North Pumping Station which damage is -a potential source of danger to the water contained therein, and which roof requires repair at the earliest possible time. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the Contract entered into between the South Bend City Water Works and the Midland Engineering Company, Inc., on the 30th day of November, 1964 for roofing and flashing repair work to be done on the 6,000,000 gallon concrete reservoir at the North Pumping Station in the sum of Two thousand one - hundred eighty ($2,180.00) Dollars is hereby approved and confirmed. /s/ Walter M. RESOLUTION NO. 88 - -64 RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE MEDICAL, SURGICAL AND DENTAL ACCOUNT, IN THE AMOUNT OF THREE HUNDRED DOLLARS ($300.00) AND IN THE TELEPHONE AND TELEGRAPH ACCOUNT, IN THE AMOUNT OF SEVENTY -FIVE DOLLARS ($75.00) AND THE TRANSFER OF THE SAME FROM THE RADIO PREVENTIVE MAINTENANCE CONTRACT ACCOUNT IN THE SAME CATEGORY OF THE STREET DEPARTMENT, ALL BEING IN THE STREET AND TRAFFIC FUND. WHEREAS,_Certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it is now necessary to appropriate more money than was appropriated in the annual budget for the various functions of City Government to meet such extraordinary contingencies; and, WHEREAS, Additional funds are urgently needed by the Street Department to assure its ability to properly pay current telephone expenses and the sum of Seventy -five Dollars ($75.00) is needed forthwith and additional funds are urgently needed by the Street Department to assure its ability to meet current medical, dental, and surgical expenses and the sum of Three Hundred Dollars ($300.00) is needed forthwith; and WHEREAS, A surplus exists in another account where it is not presently needed at this time and more specifically as follows, to wit: 1. Three Hundred Seventy -Five Dollars ($375.00) in account S252B, designated as Radio Preventive Maintenance Contract. NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of Seventy -Five Dollars {$75.00) be transferred to account S261 designated as Medical, Surgical and Dental, by transferring said funds from the following account, to -wit: 2. Three Hundred Seventy -Five Dollars ($375.00) from account S252B, all of said accounts being in the same cagetory, to -wit: Services Contractual of the Street Department and all being in the street and traffic fund. /s/ John L. RESOLUTION NO. 89 - -64 RESOLUTION OF THE COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING GENERAL NEIGHBORHOOD RENEWAL PLAN WHEREAS, pursuant to the provisions of Title I of the Housing Act of 1949, as amended, the City of South Bend Department of Redevelopment (herein called the "Local Public Agency ") has entered into a contract, designated Contract No. Ind. R -41 (GN)(A) with the Federal Government pursuant to which the Government has made available to the Local Public Agency financial assistance for the preparation of a General Neighborhood Renewal Plan for the Urban renewal area designated as the LaSalle Park Area in the City of South Bend, State of Indiana (herein called the "Locality "); and WHEREAS the Local Public Agency proposes to undertake with Federal financial assistance one or more urban renewal projects in the above- described urban renewal area; and WHEREAS there has been prepared and referred to the Common Council of the City of South Bend, Indiana (herein called the "Governing Body ") for review and approval a General Neighborhood Renewal Plan for the urban renewal area, dated August 14, 1964, entitled "General Neighborhood Renewal Plan for the LaSalle Park Area" and consisting of 18 pages and 9 exhibits; and WHEREAS said General Neighborhood Renewal Plan has been approved by the governing body of the Local Public Agency, as evidenced by the copy of said body's duly certified resolution approving said General Neighborhood Renewal Plan which is attached thereto; and WHEREAS there have also been presented to the Governing Body certain supplementary data, including data respecting estimated grant -in -aid requirements, relocation requirements and resources, and governmental actions required to carry out said General Neighborhood Renewal Plan; and (Continued) REGULAR MEETING VZtl ,l`MZK 1q, 1704 RESOLUTION NO. 89 - -64 (Continued) RESOLUTION OF THE COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING GENERAL NEIGHBORHOOD RENEWAL PLAN WHEREAS a general plan is in existence and is recognized and used as a guide for the general development of the Locality as a whole; and, also there has been presented to the Housing and Home Finance Administrator, and said ! Administrator has approved, a Program for Community Improvement (Workable Program) for the community; and WHEREAS the City of South Bend Plan Commission which is the duly designated and acting official planning body for the Locality, has reported to the Government Body respecting the conformity-,,-,of said General Neighborhood Renewal Plan to the general plan for the Locality as a whole: NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: 1. That the General Neighborhood Renewal Plan for the area aforementioned, having been duly reviewed and considered, is hereby approved; that it is determined to be adequate as an outline of the urban renewal activities proposed for the area involved, as a framework for the preparation of urban renewal plans, and as an indication generally, to the extent feasible in preliminary planning, of land uses, population density, building coverage, prospective requirements for the conservation and rehabilitation "of -•plroperty-,-and any portions of the area contemplated for clearance and redevelopment, and that the Executive Director of the Department of Redevelopment be and is hereby directed to file said copy of the General Neighborhood Renewal Plan with the minutes of this meeting. it 2. That it is hereby found and determined that said General Neighborhood Renewal !� Plan for the urban renewal area conforms to the general plan of the Locality II and to the Program for Community Improvement. 3. That it is the intention of this.Body that tkak the General Neighborhood Renewal Plan be used to the fullest extent feasible as a guide for the provision of public improvements in such area, and that said Plan will be considered in formulating codes and other regulatory measures affecting property in the area and in under- taking other local governmental activities pertaining to the development, redevelopment, conservation, and rehabilitation of the area. 4. That in order to implement and facilitate the effectuation of the Plan hereby approved, this Body hereby (a) pledges its cooperation in helping to carry out I the Plan; (b) requests the various officials, departments, boards, and agencies of the Locality having administrative responsibilities in the premises likewise !! to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the Plan; and (c) stands ready to consider and take appropriate action upon proposals and measures designed to effectuate the Plan. !� /s/ Janet S. After some . discussion, Councilman Geib withdrew his motion and Councilman Smith withdrew his second to the motion. Councilman Smith made a motion for a ten minute recess. Then Councilman Allen made a motion to change her vote from nay to "aye ". Upon roll call, the Resolution was adopted by a roll call vote of 5 ayes (Councilmen Allen, Palmer, Wise, Szymkowiak and Glass), 3 nays (Councilmen Hunter, Geib and Smith), 1 absent (Councilman Muszynski).
