HomeMy WebLinkAbout11-09-64 Council Meeting MinutesREGULAR MEETING NOVEMBER 9, 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, November 9, 1964, at 8:17 P.M., with all members present except Councilman Wise. The meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Alien, Palmer, Geib, Szymkowiak, Glass, ~Smith "and Muszynski. MEW _�3E�ULAR MEETING NOVEMBER 9, 1964 REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspec the minutes of the previous meeting of the Council and found them correct. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: November 9, 1964 Your Committee of the Whole to whom was referred "AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE STANCO MIDWEST SALES CO. FOR THE PURCHASE OF HIAB SPEED LOADER MODEL 177 WITH 18 FEET BOOM LENGTH IN THE SUM OF $4,210.00." FOR THE PURCHASE OF REO "M" SERIES 2k TON 6 %6 RECONDITIONED TRUCK IN THE SUM OF $4,395.00 ". ORDINANCE N0.4705 - -64 ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO THE SERVICES - CONTRACTUAL ACCOUNTS OF THE FIRE DEPARTMENT IN THE AMOUNT OF $4,500.00 AND THE TRANSFER OF THE SAME FROM THE SERVICES - PERSONAL ACCOUNT OF THE FIRE DEPARTMENT. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Wise). ORDINANCE NO. 4706 - -64 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN THE AMOUNT OF $3,340.00 AND THE REDUCTIONS IN THE SAME AMOUNT OF ANOTHER ACCOUNT, TO -WIT: ACCOUNT L -11. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Wise). ORDINANCE, FIRST & SECOND READING AN ORDINANCE APPROPRIATING AN ADDITIONAL $1,200.00 FROM THE GENERAL FUND TO:THE BUILDING DEMOLITION, REPAIR AND CONTINGENCY FUND. The ordinance was given first reading by title and second reading in ftill. Councilman Glass made a motion that the ordinance be set for public hearing on November 23, 1964. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE, FIRST & SECOND READING AN ORDINANCE APPROPRIATING $1,044.09 FROM THE STREET AND TRAFFIC FUND TO ACCOUNT S -252 DESIGNATED AS REPAIRS OF EQUIPMENT. The ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion that the ordinance be set for public hearing on November 23, 1964. Councilman Palmer seconded the motion. Motion carried. REGULAR MEETING NOVEMBER 9T1964 ORDINANCE NO. 4707 - -64 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE B.I.F. DIVISION OF THE NEW YORK AIR BRAKE CO., FOR CONTROL AND METERING EQUIPMENT IN THE SUM OF $4030868.00. The ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion for suspension of rules. Councilman Palmer seconded the motion. Motion carried by a roll call vote of 8 ayes - 1 absent (Councilman Wise). The ordinance was given third reading and passed by a roll call vote of 8-'ayes - 1 absent (Councilman Wise). ORDINANCE NO. 4708 - -64 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH.BEND CITY WATER WORKS AND WALLACE & TIERNAN, INC., FOR CHLORINE FEEDING EQUIPMENT IN THE SUM OF $1710371.00. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Szymkowiak seconded the motion. Motion carried by a roll call vote of 8 ayes - 1 absent (Councilman Wise). The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Wise). ORDINANCE, FIRST & SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND TO THE 1963 CITY ELECTION BUDGET ACCOUNT IN THE AMOUNT OF $11,908.56. Councilman Smith made a motion that the ordinance be referred to the Elections Committee for study. Councilman Geib seconded the motion. After some discussion, Councilman Smith withdrew his motion and Councilman Geib withdrew his second to the motion. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the ordinance be set for public hearing on November 23, 1964. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE, FIRST & SECOND READING AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE GENERAL FUND TO THE POSTAGE ACCOUNT OF THE OFFICE OF CITY CLERK IN THE AMOUNT OF $600.00. The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the ordinance be set for public hearing on November 23, 1964. Councilman Palmer seconded the motion. Motion carried. RESOLUTION NO. 84 - -64 RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE OIL ACCOUNT OF THE SANITATION DEPARTMENT IN THE AMOUNT OF $150.00 AND THE TRANSFER OF THE SAME FROM THE GASOLINE ACCOUNT IN THE SAME CATEGORY OF THE SANITATION DEPARTMENT,ALL WITHIN THE GENERAL FUND. Councilman Allen moved that the Resolution be amended in the following manner: In the 3rd paragraph WHEREAS clause, delete the word "supply" and substitute the word "surplus ". Councilman Palmer seconded the motion. Motion carried. Resolution amended. The Resolution, as amended, reads as follows: RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE OIL ACCOUNT OF THE SANITATION DEPARTMENT IN THE AMOUNT OF $150.00 AND THE TRANSFER OF THE SAME FROM THE GASOLINE ACCOUNT IN THE SAME CATEGORY OF THE SANITATION DEPARTMENT,ALL WITHIN THE GENERAL FUND, AS AMENDED. WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it i s now necessary to appropriate more money than was appropriated in the annual budget for the various functions of City Government to meet such extraordinary contingencies; and, WHEREAS, Additional oil is urgently needed by the Sanitation Department to assure its ability to properly perform its function and the sum of One- hundred Fifty ($150.00) Dollars is needed forthwith; and WHEREAS, A surplus exists in another account where it is not presently needed at this time; and more specifically as follows, to -wit: 1. One- hundred Fifty ($150.00) Dollars in Account XX -321 designated as Supplies, gasoline. (Continued) 121V REGULAR MEETING NOVEMBER 9, 1964 RESOLUTION NO. $4­64 (Continued) NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, that the sum of One- hundredFifty ($150.00) Dollars be transferred to Account No. XX -322 designated as Supplies, oil, by transferring it from the following account, to -wit: 2. One- hundred Fifty ($150.00) Dollars from Account XX -321, both of said accounts being in the same category, to -wit: Supplies, of the Sanitation Department. /s/ John Wise, Member of the Common Council Councilman Glass made a motion to adopt the Resolution, as amended. Councilman Szymkowiak seconded the motion. Motion carried by a roll call vote of 8 ayes - 1 absent (Councilman Wise). NEW BUSINESS: AN ORDINANCE PERTAINING TO STREET SNOW REMOVAL, AND REGULATING TRAFFIC, PARKING AND OTHER CONDUCT DURING PERIODS OF SNOW REMOVAL CONDITIONS, PROVIDING FOR THE REMOVAL OF VEHICLES AND PROVIDING FOR PENALTIES, AS AMENDED. Councilman Geib made a motion that the ordinance be given first and second reading tonight. Councilman Szymkowiak seconded the motion. Motion carried. The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion to amend Section 1, Definitions, paragraph 5, that numeral (3) be deleted and "(e)" substituted; also Section 2, General Provisions, paragraph (c), second line of sub- paragraph (1) be amended by deleting the word "emergency" and inserting "removal conditions ". Councilman Smith seconded the motion. Motion carried. Councilman Smith made a motion that the ordinance, as amended, be set for public hearing on November 23, 1964. Councilman Geib seconded the motion. Motion carried. Councilman Smith suggested that the Mayor inform department heads not to send out Christmas cards with "tax money ", Councilman Szymkowiak suggested that parking be free Monday nights on downtown streets during December for the Christmas season to "give the City a shot in the arm ". UNFINISHED BUSINESS: Councilman Glass informed the Council that the Legislative Committee does not have anything to report on the status of the area planning commission. There being no further business before the Council, Councilman Smith made a motion to adjourn. Councilman Geib seconded the motion. Motion carried and Council adjourned at 9:40 P.M.
