HomeMy WebLinkAbout10-13-64 Council Meeting MinutesREGULAR MEETING OCTOBER 13, 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Tuedday,October 13, 1964, at 8 :08 P.M., with all members present except Councilman Muszynski. The meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Glass, and Smith. ABSENT: Councilman Muszynski. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. /s/ John L. Hunter Jr. Meetings of August.24th, August 31st and September 28, 1964. It Walter G. Glass Councilman Szymkowiak made a motion that the report be accepted and placed on file. Councilman Palmer seconded the motion. Motion carried. PETITION Petition of William Krill and Dorothy Krill to rezone Southwest corner of Bendix Drive and Ardmore Trail from "B" Residence District and "B" Height and Area District to "C" Commercial District and "C" Height and Area District. Councilman Geib made a motion that the petition be referred to the City Planning Commission. Councilman Wise seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: October 13, 1964 Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 ". (Location: Nash St., Grant St., Prairie Ave. and Calvert St.). Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Geib made a motion that the report be accepted and placed on file. Councilman Szymkowiak seconded the motion. Motion carried. 0 REGULAR MEETING OCTOBER 13 1964 REPORT OF COMMITTEE OF TAE WHOLE To the Comm@n'Council of the City of South Bend: October 13, 1964 Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 ". (Location: Meade St., Bendix Drive, Prast Blvd. and Westmore St.). Respectfully report that they have examined the matter and that in their opinion this ordinance be referred back to the City Planning Commission for amendment by excluding the following lots: 2 -6 inclusive and 9 -13 inclusive of Part of Westchester 1st Unit. /s/ Edwin Thomas Smith, Chairman Councilman Glass made a motion that the report be accepted and placed on file. Councilman Allen seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: October 13, 1964 Your-:Committee of the Whole to whom was referred "AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO THE EQUIPMENT REPAIR ACCOUNT OF THE SANITATION DEPARTMENT IN THE AMOUNT OF $3,549.00 WITH SAID SUM BEING TRANSFERRED FROM THE MOTOR EQUIPMENT ACCOUNT OF THE SANITATION DEPARTMENT ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Glass made a motion that the report be accepted and placed on file. REPORT OF CITY PLANNING COMMISSION October 5, 1964 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached-petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A" Residential Use and "A" Height and Area District the property generally described as being bounded on the East by Meade Street, on the South by Prast Blvd., on the West by Bendix Drive and on the North by Bonds Avenue and Green Street was legally advertised under date of September 21, 1964 and given public hearing on October 1, 1964. The following action was taken: After due consideration the Commission found that the predominant use it*he subject area is single family residential. REPORT -OF CMPLANNING COMMISSION October 5, 1964 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A -1" Residential Use and "A" Height and Area District the property generally described as being bounded on the North by the East -West alley South of Washington Street, on the East by Laurel Street, on the South by Napier Street and on the West by Walnut Street was legally advertised under date of September 21, 1964 and given public hearing on October 1. The following action was taken: After due consideration the Commission found that the proposed zoning would be in the best interest of the subject area. The following action was taken: After due consideration the Commission found that the predominant use in the subject area is single family residential. ORDINANCE No, 4694 - -64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Nash St., Grant St., Prairie Ave. and Calvert St.) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Muszynski) ORDINANCE NO, 4695 - -64 AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO THE EQUIPMENT REPAIR ACCOUNT OF THE SANITATION DEPARTMENT IN THE AMOUNT OF $3,549.00 WITH SAID SUM BEING TRANSFERRED FROM THE MOTOR EQUIPMENT ACCOUNT OF THE SANITATION DEPARTMENT. Councilman Geib made a motion that the ordinance be set for public hearing on October 26, 1964. Councilman Wise seconded the motion. Motion carried. ORDINANCE, FIRST & SECOND READING AN ORDINANCE ADDING SECTION 9 TO ORDINANCE NO. 4207 ENTITLED "AN ORDINANCE AUTHORIZING THE INCREASE OF SEWAGE SERVICE CHARGES TO ALL USERS OF CITY SEWER SERVICE OR CITY WATER SERVICE FOR THE PURPOSE OF REPAIR AND /OR REPLACEMENT OF WATER SERVICE LINES, SHUT -OFF BOXES AND WATER METER MANHOLES ", AS AMENDED BY ORDINANCE NO. 4260. The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the ordinance be set for public hearing on October 26, 1964. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE, FIRST & SECOND READING AN ORDINANCE APPROPRIATING ($3,000.00) TO THE SEWER DEPARTMENT FOR THE REPAIRS TO SEWER REPLACEMENT ;,.,SAID,,($3,000.00),TO.BE A TRANSFER FROM ACCOUNT J -12 INTO ACCOUNT J -2621 ALL BEING IN THE GENERAL FUND. The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the ordinance be set for public hearing on October 26, 1964. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Meade St., Prast Blvd., Bendix Drive, Bonds Ave. and (teen St.) Councilman Szymkowiak made a motion that the ordinance be referred back to the City Planning Commission for amendment by excluding the following lots: 16220 inclusive 23 -27 inclusive and 30 -34 inclusive of Part of West- chester 1st Unit. Councilman Glass seconded the motion. Motion carried. ULA,R_MEET3tG_— OCTOBER 13 1964 ii - -- NEW BUSINESS: The Council held an informal hearing with residents of the Parkovash, Tonti and Wakewa area to express their views on the proposed Barrett Law paving of their streets and a number of residents were heard. Mr. Robert Axelberg, 1220 N. Lafayette Blvd., filed a remonstrance with the City Clerk. There being no further business before the Council-; Councilman Glass made a motion to adjourn.
