REGULAR MEETING
AUGUST 10, 1964
Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the
Council Chambers in the City Hall on Monday, August 10, 1964, at 9:25 P.M., with all members present. The
meeting was called to order by President John L. Hunter Jr., who presided.
ROLL CALL
PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib,
Szymkowiak, Glass, Smith and Muszynski.
ABSENT: None.

REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

Councilman Smith made a motion that the report be accepted and placed on file. Councilman Palmer seconded the
motion. Motion carried.
PETITION
Petition of Humble Oil & Refining Company to rezone a tract at the southwest corner of Lincolnway West and Ryer
Street from "B" Residence District and "B" Height and Area District to "C" Commercial District and "B" Height
and Area District.
Councilman Szymkowiak made a motion that the petition be referred to the City Planning Commission. Councilman
Glass seconded the motion. Motion carried.
REPORT OF COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:

Your Committee of the Whole to whom was referred "AN ORDINANCE APPROPRIATING $200.00 FOR THE USE OF THE CITY
PLAN COMMISSION IN THE PAYMENT OF ADDITIONAL EXPENSES INCURRED AS A CONSEQUENCE OF THE PUBLICATION OF LEGAL
NOTICES REQUIRED BY LAW ".
Respectfully report that they have examined the matter and that in their opinion this ordinance go to the
Council as favorable.

Your Committee of the Whole to whom was referred "AN ORDINANCE PROHIBITING CARELESS OPERATION OF VEHICLES IN
THE CITY, DEFINING TERMS, AND REPEALING ALL ORDINANCES IN CONFLICT ".
Respectfully report that they have examined the matter and that in their opinion this ordinance go to the
Council as favorable.

No. 3702).

The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays.
ORDINANCE. FIRST & SECOND READING
AN ORDINANCE APPROPRIATING ($1500.00) TO THE ELECTRICAL
DEPARTMENT FOR THE PURCHASE OF A TRUCK; SAID ($1500.00)
TO BE A TRANSFER FROM ACCOUNT V -37 INTO ACCOUNT V -722,
ALL IN THE GENERAL FUND.
The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that
the ordinance be set for public hearing on August 24, 1964. Councilman Szymkowiak seconded the motion. Motion
carried.
ORDINANCE, FIRST & SECOND READING
AN ORDINANCE APPROPRIATING ($500.00) TO THE OFFICE OF THE
CITY CLERK FOR THE PURCHASE-OF ADDITIONAL.POSTAGE TO BE _A
TRANSFER FROM ACCOUNT C -362 INTO ACCOUNT C -212, ALL IN THE
GENERAL FUND.
The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion
that the ordinance be set for public hearing on August 24, 1964. Councilman Szymkowiak seconded the motion.
Motion carried.
ORDINANCE. FIRST:.& SECOND READING
AN ORDINANCE APPROPRIATING ($2,500.00) TO THE CITY CEMETERIES
DEPARTMENT FOR THE PURCHASE OF A TRUCK; SAID ($2,500.00) TO
BE A TRANSFER FROM ACCOUNT N -12 INTO ACCOUNT N -722, ALL IN
THE GENERAL FUND.
The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that
the ordinance be set for public hearing on August 24, 1964. Councilman Wise seconded the motion. Motion carried.

RESOLUTION NO. 72 - -64
RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE OTHER
SUPPLIES ACCOUNT OF THE SOUTH BEND STREET DEPARTMENT
IN THE AMOUNT OF $5,000.00 AND THE TRANSFER OF THE SAME
FROM ANOTHER ACCOUNT IN THE SAME.CATEGORY OF THE.STREET
DEPARTMENT; SAME BEING A TRANSFER BETWEEN TWO ACCOUNTS
IN THE SAME CATEGORY, BOTH BEING IN THE STREET AND
TRAFFIC FUND.
WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing annual budget, so
that it is now necessary to appropriate more money than was appropriated in the annual budget for the various`
functions of City Government to meet such extraordinary contingencies; and,
WHEREAS, heavy duty rain gear, sign equipment, and other supplies are necessary to assure its ability to properly
perform its function and the sum of.$5,000.00 is needed forthwith, and,
WHEREAS, A surplus exists in another account where it is not presently needed at this time; and more specifically
as follows, to -wit:
1. Five thousand Dollars ($5,000.00) in Account S -321 designated as supplies, gasoline;
NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of $5,000.00 be
transferred to Account No. S -37 designated as other supplies - general by transferring it from the following
account, to -wit:
2. Five thousand Dollars ($5,000.00) from Account S -321. Which said account is in the general supplies
category of the Street Department.

CONTRACTUAL ACCOUNT OF THE SOUTH BEND CEMETERIES DEPARTMENT
IN THE AMOUNT OF $400.00 AND THE TRANSFER OF THE SAME FROM
ANOTHER. ACCOUNT IN THE SAME CATEGORY OF THE CEMETERIES
DEPARTMENT; SAME BEING A TRANSFER BETWEEN TWO ACCOUNTS IN
THE SAME CATEGORY, BOTH BEING IN THE CITY CEMETERIES DEPART-
MENT'S ACCOUNT, ALL IN THE GENERAL FUND.

1. Four Hundred dollars ($400.00) in Account N -261 designated as services contractual, tree trimming.
NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of $400.00 be
transferred to Account N -251 designated as other services contractual, Repairs of Buildings and Structures,
by transferring it from the following account, to -wit:
2. Four Hundred Dollars ($400.00) from Account N -261, which said account is in the same services
contractual category of the Cemeteries Department.
