HomeMy WebLinkAbout05-25-64 Council Meeting MinutesREGULAR MEETING MAY 25, 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, May 25, 1964, at 9:02 P.M., with all members present. The meeting was called to order by President John L. Hunter Jr. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski seconded the motion. Motion carried. RESOLNTION -NO; 70 -464 Resolution. relative to the death of Joseph T. Kroll, former P- resident of the Common Council-of the City of South Councilman Smith made a motion for the adoption of the Resolution and that a copy be sent to Mrs. Kroll. Councilman Muszynski seconded the motion. Motion unanimously carried. Resolution adopted. (See next page) - - _REGULAR MEETING MAY 25, 19 64 RESOLUTION NO. 70 - -- 64 WHEREAS, God, in His Infinite Wisdom, has called from this life, Joseph T. Kroll, former President of the Common Council, Husband of Irene Kroll, Father of Ronald, Terrence, Dale and Mrs. Dale Engdahl, WHEREAS, his untimely death has brought much grief and sorrow to his wife, Irene Kroll, his sons and daughter, NOW, THEREFORE, BE IT RESOLVED: That we, the COMMON COUNCIL of the City of South Bend, do hereby extend to Mrs. Irene Kroll our sincere sympathy in this, their deepest hour of sorrow, and, BE IT FURTHER RESOLVED that a page be set aside in the COUNCIL records of the City of South Bend and this Resolution be copied therein and a copy duly certified by the Clerk be sent to his family. Hunter.Jr., President of the Common Council REGULAR MEETING MAY 25 1964 RESOLUTION NO. 67 -- 64 A resolution of the Common Council of the South Bend, Indiana endorsing the establishing of a plan of action for the revitalization of the Downtown Area. Be it resolved that the Common Council of South Bend, Indiana realizes that an urgent need exists to construct a combination City - County building and to implement a general program for the Downtown Area. Let it further be resolved both are an integral part of the Downtown Area, the revitalization of which can be a very potent factor in increasing the economy and employment of the entire city and county. Let it further be resolved that it is imperative that our economy be continually strengthened at an early date; therefore we believe that a plan of action and priority schedule be implemented. Let it further be resolved helping ourselves is vitally important. Co- operation between government, civic organizations and private enterprises is essential. It is with this thought in mind the Common Council of South Bend, Indiana subscribes to and urges everyone interested in total development of our City and County to endorse a plan of action for the next five years. /s/ John L. RESOLUTION NO. 68 -- 64 RESOLUTION OF THE COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING UNDERTAKING OF SURVEYS AND P S FOR AN URBAN RENEWAL PROJECT AND FILING OF AN APPLICATION FOR THE INDUSTRIAL EXPANSION PROJECT AREA. For Resolution,see pages 56 and 57. Councilman Muszynski made a motion for the adoption of the Resolution. Councilman Smith seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. Resolution adopted. RESOLUTION A RESOLUTION REPEALING RESOLUTION NO. 10 OF THE YEAR 1962 ENTITLED A RESOLUTION APPROVING TWO ADDITIONAL TRACTS OF LAND AS A PART OF PROPOSED LOW RENT HOUSING PROJECT IND. 15 - 3 WHICH TRACTS ARE LOCATED ON THE WEST SIDE OF FREMONT STREET BETWEEN BERGAN STREET AND MARQUETTE BOULEVARD IN THE CITY OF SOUTH BEND. Section I. Resolution No. 10 of the year 1962 entitled 'A Resolution Approving Two Additional Tracts of Land as a Part of Proposed Low Rent Housing Project Ind. 15 - 3 Which Tracts Are Located on the West Side of Fremont Street between Bergan Street and Marquette Boulevard in the City of South Bend" be and is hereby repealed. Section II. This resolution shall be effective upon the signatures of the President of the Common Council and the Mayor for the city'of South Bend being affixed hereto. /s/ Richard G. Geib Member of Common Council Councilman Geib made a motion for the adoption of the Resolution, Councilman Wise seconded the motion. Motion lost by a roll call vote of 2 ayes (Councilmen Wise and Geib), 7 nays (Councilmen Hunter, Allen, Palmer, Szymkowiak, Glass, Smith and Muszynski). REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 12, 19 64 The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A" Residential Use and "A" Height and Area District the property gdndrally described as an area bounded on the northwest by Prairie Avenue, on the east by Morris Street and on the south by EwingAvenue was legally advertised under date of April 27, 1964 and given public hearing on May 7, 1964. The.f6ll6wing action was taken: After due consideration the Commission found that the predominant use in the subject area is single- family residential. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 12, 1964 The attached ordinance originated by the City Planning Commission amending Ordinance No. 3702, the Zoning Ordinance of the City of South Bend, Indiana by deleting therefrom the following: (10)Foundry, aluminum, was legally advertised under date of April 27, 1964 and given public hearing on May 7, 1964. The following action was taken: After due consideration it was duly moved, seconded, and unanimously carried that the ordinance be recommended favorably to the Council. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 12, 1964 The attached petition of Charles and Gaylene Coussens, et al, to rezone from "A Residential Use and "A" Height and Area District to "B" Residential Use and "A" Height and Area District the property generally described as a 20 acre tract of land having 680 feet, more or less, frontage on Corby Blvd., and lying 2016 feet, more or less, west of Hickory Road, was legally advertised under date of January 27, 1964 and given public hearing on February 6, 1964. The following action was taken: After due consideration the Commission found that the requested zoning was not in the best interest of the subject area. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 12, 19 64 The attached petition of Martha Wappenstein.et al, to rezone from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "A" Height and Area District the property generally described as a parcel of land having frontage of 20 feet on the west right -of -way line of Ironwood Drive between Mishawaka Avenue and Vine Street was legally advertised under date of April 27, 1964 and given public hearing on May 7, 1964. The following action was taken: After due consideration the Commission found that the requested zoning would be in the best interest of the subject area. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 22, 1964 The attached ordinance originated by the City Planning Commission amending Section l sub- section a of Ordinance No. 3702, the Zoning Ordinance of the City of South Bend, Indiana was legally advertised under date of March 23, 1964 and given public hearing on April 2, 1964. The following actionwas taken: After due consideration it was duly moved, seconded, and unanimously carried that the ordinance be recommended- favorably to the Council. Councilman Geib made a motion that the report be referred back to the City Planning Commission for another public hearing. Councilman Muszynski seconded the motion. After some discussion, Councilman Geib withdrew his motion and Councilman Muszynski withdrew his second to the motion. Councilman Geib made a motion that the report be accepted and placed on file. Councilman Allen seconded the motion. Motion carried. The following action was taken: After due consideration it was duly moved, seconded, and unanimously carried that the ordinance be recommended favorably to the Council. ORDINANCE NO. 4659 - -64 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (75 Acre Tract at Miami and Jackson Roads) The ordinance was given third reading and passed by a roil call vote of 5 ayes (Councilmen Palmer, Szymkowiak, Glass, Smith and Muszynski), 4 nays (Councilmen Hunter, Allen, Wise and Geib). ORDINANCE, FIRST & SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN STREET AND TRAFFIC FUND IN THE AMOUNT OF $15,000.00 The ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the ordinance be referred to the Committee of the Whole for public hearing on June 15th, 1964. Councilman Geib seconded the motion. Motion carried. REGULAR MEETING RESOLUTION NO. 69--64 RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE RADIO EQUIPMENT FUND OF THE SOUTH BEND,FIRE DEPARTMENT IN THE AMOUNT OF $4,500.00 AND THE TRANSFER OF THE SANE FROM THREE OTHER ACCOUNTS IN THE PLANT AND EQUIPMENT CATEGORY OF THE FIRE DEPARTMENT. WHEREAS,, certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it is now necessary to appropriate more money than was appropriated.in the annual budget for the various functions of City Government to meet such extraordinary contingencies; and WHEREAS, radio equipment is urgently needed by the Fire Department to assure its ability to properly perform its function and the sum of $4,500.00 is needed forthwith; and WHEREAS, a surplus exists in other accounts where it is not presently needed at this time; and more specifically as follows, to-wit: 1. Two-thousand Dollars ($2,000.00) in Item Q-722 designated as property, motor equipment; 2. Two-thousand Dollars ($2,000.00) in Item Q-726 designated as property, other equipment; and 3. Five-hundred Dollars ($500.00) in Item Q-73 designated as property, land. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of $4,500.00'be transferred to Account No. Q-724 designated as property, radio equipment by transferring it from the following accounts, to-wit: 1. Two-thousand Dollars ($2,000.00) from Account Q-722. 2. Two-thousand Dollars ($2,000.00) from Account Q-726. 3. Five-hundred Dollars ($500.00) from Account Q-73, All of which said accounts are in the general . property category of the Fire Department. /s/ Richard G.
