HomeMy WebLinkAbout03-09-64 Council Meeting MinutesREGMAR MEETING MARCH 9, 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, March 9, 1964, at 9:20 P.M., with all members present. The meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski. ABSENT: None. REGULAR MEETING March 9, 1964 REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION South Bend Common Council South Bend, Indiana Gentlemen: February 21, 1964 The Northern Indiana. Chapter of the American Institute of Architects, in general meeting on January 18, unan endorsed the proposed South Bend Historic Preservation Ordinance. Councilman Smith seconded the motion. Motion carried. REPORT OF SOUTH BEND REDEVELOPMENT- DEPARTMENT Mr. Henry Sucher, Urban Redevelopment Director, appeared before the Council to answer questions pertaining to report of Redevelopment Department. Councilman Glass made a motion that the report be accepted and placed on file. Councilman Geib seconded the motion. Motion carried. REPORT OF SEWAGE TREATMENT PLANT Councilman Glass made a motion that the Report of SewW Treatment Plant be accepted and placed on file. Counc Geib seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: March 9, 1964 Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED ". (Washington St. from Summit Drive to Lombardy Drive) Respectfully report that they have examined the matter and that in their opinion the Ordinance be reported to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Glass made a motion that the report be accepted and placed on file. Councilman Geib seconded the motion: Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: March 9, 1964 Your Committee of the Whole to whor{was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED". (North side of Western Ave. from Lombardy Drive to Mayflower Road), Respectfully report that they have examined the matter and that in their opinion the Ordinance be.reported to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Allen made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. (South of Lathrop, West of Johnson and East of Huey Streets). Motion carried. 2 REGULAR MEETING MARCH 9, 1964 REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend :., March 9, 1964 Your Committee of the Whole to whom was referred PAN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702. (Kendall, Kemble, Indiana and Calvert); Respectfully report that they have examined the matter and that in their opinion the Ordinance be reported to Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Allen made a motion that the report be accepted and placed on file. Councilman Geib seconded the motiok REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: March 9, 1964 Your Committee of the Whole to whom was referred "AN ORDINANCE TO AMEND SECTION 17 -A OF ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH, BEND, INDIANA ". Respectfully report that they have examined the matter and that in their opinion this Ordinance go to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Geib made a motion that the report be accepted and placed on file. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City South Bend March 9, 1964 South Bend, Indiana ' Gentlemen: The attached petition of the Lock Joint Tube Co., Inc., et al, to rezone from "D" Light Industrial Use and "D" Height and Area District to "B" Residential Use and "B" Height and Area District a triangular tract of land bounded on the north by the rear lot lines of those lots fronting on the south right -of -way line of Rose Street and on the southeast by Riverside Drive was legally advertised under date of February 24, 1964 and given a public hearing on March 5, 1964. The following action was taken: After due consideration the Commission found that the proposed zoning would be in the best interest of the City and the area. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended favorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. ORDINANCE NO. 4629 - 64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO, 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED (Washington St. from Summit Drive to Lombardy Drive) The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE NO. 4630 64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0, 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED (North side of Western Avenue. from Lombardy Drive to Mayflower Rd.) The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE N0. 4631 - 64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO, 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED (South of Lathrop, West of Johnson and East of Huey Sts.) The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE NO. 4632 - 64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Kendall, Kemble, Indiana and Calvert) The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE NO. 4633 - 64 AN ORDINANCE TO AMEND SECTION 17 -A OF ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, INDIANA The ordinance was given third reading and passed by a roll call vote of 7 ayes (Councilmen Hunter, Allen; Palmer, Wise, Geib, Glass and Smith), 2 nays (Councilmen Szymkowiak and Muszynski). ORDINANCE, FIRST & SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (6 Acre triangular tract fronting Riverside Drive) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the ordinance beset for public hearing on March 23rd, 1964. Councilman Szymkowiak seconded the motion. Motion carried. NEW BUSINESS Councilman Glass made a motion that the City Attorney be instructed to prepare an Air Pollution Ordinance. Councilman Muszynski seconded the motion. Councilman Smiinmade an amendment to the motion that the ordinance also include industrial smoke. Councilman Geib seconded the motion. Motion carried. There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Councilman Smith seconded the motion. Motion carried, and Council adjourned at 10:27 P.M. ATTEST:
