The meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Councilman Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Minutes of February 10, 1964. /s/ John L. PETITION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: February 11, 1964 The undersigned hereby petitions your honorable body to rezone from "B" Residential Use and "A" Height and Area District to "A" Residential Use and "A" Height District the following described property: Lots 1, L, 3, 6, 7, 8, 9, 10 and 11 of Kemble Addition, also Lots 120 -164 inclusive and Lots 174 -199 inclusive of Raff's 4th Addition, being more generally described as being bounded on the east by the first north -south alley west of Kendall Street, on the west by Kemble Avenue, on the north by Indiana Avenue, and on the South by Calvert Street. /s/ Robert L. SMITH Chairman -- Committee of the Whole REGULAR MEETING FEBRUARY 24 1964 RESOLUTION NO. 65 - -- 64 WHEREAS, The Common Council, of the City of South Bend recognizes there is a need for equal opportunity in housing in the City of South Bend for all people regardless of race, color, religion, national origin or ancestry of such person or group of persons and, WHEREAS, the City of South Bend recognizes the undesirability of discrimination and segregation in housing, NOW, THEREFORE, LET IT BE RESOLVED, that the Common Council of the City of South Bend, recognizing its obligation to the Community of South Bend, does on this day, urgently desire that, all Realtors, actively enforce their recent statement of principles regarding the sale. and rental of properties, and, LET IT FURTHER BE RESOLVED, that each lending institution make it be known its intent to further equal opportunity in housing and financial assistance for purchasing of housing regardless of race, color, religion, national origin, or ancestry of such person or group of persons and, LET IT FURTHER BE RESOLVED, that all other persons actively oppose discrimination against any person or persons because of race, color, religion, national origin;, or ancestry of such person or group of persons in the sale, rental or lease of any real property or in the financial assistance pertaining thereto and, LET IT FURTHER BE RESOLVED, that we appeal to all clergymen, religious groups and members of all churches to work in the community with a program of education, prayer and evangelism to dispel unfair and discriminatory treatment of a fellow human being. LET IT FURTHER BE RESOLVED, That the Common Council of the City of South Bend will diligently put forth further effort to: (1) Instigate such other desirable programs necessary to eliminate discrimination against any person or persons because of race, color, religion, national origin,or ancestry of such person or group of persons in the sale, rental, or lease of any real property or in the financial assistance thereto. (2) Remove sub-standard, unhealthful, unsafe, unsanitary and overcrowded living conditions resulting from discrimination in the sale, rental and financing of housing. (3) All grievances of discriminatory practices in housing in the City of South Bend be brought to the direct attention of the Chairman of the Housing Committee of the Common Council of the City of South Bend. LET IT BE FURTHER RESOLVED, that we urge every citizen in our community to assist in making South Bend a City of Brotherly Love - - -in fact and deed, as well as in word; /s/ EDWIN THOMAS SMITH it JOHN L. Motion carried by a roll call vote of ,9 ayes - 0 nays. COMMUNICATION More than 125 postal cards were received by the Eouncil favoring public housing. Councilman Muszynski made a motion that the cards be accepted and placed on file. Councilman Szymkowiak seconded the motion. Motion carried. COMMUNICATION Copy of 1964 Civic Cinema from the South Bend Civic Planning Association Inc. was presented to the Clerk and Council Members. Councilman Allen made a motion that the report be accepted and placed on file. Councilman Geib seconded the motion. Motion carried. REPORT OF HOUSING AUTHORITY OF THE CITY OF SOUTH BEND Rabbi Albert M. Shulman, Chairman of the South Bend Housing Authority, appeared before the Council to answer questions regarding the Authority's Annual Report which was submitted two weeks ago. Councilman Allen made a motion that the report be accepted and placed on file. Councilman Smith seconded the motion. Motion carried. REPORT OF SOUTH BEND REDEVELOPMENT DEPARTMENT Councilman Wise made a motion that the Report of_Sbuth Bend Redevelopment Department be held up until next meeting on March 9th, 1964, and the Clerk be instructed to notify Mr. Sucher to attend that meeting to answer questions pertaining to the report. Councilman Smith seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To'the Common Council of the City of South Bend! Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 ". (142 So. Meade St.) Respectfully report that they have examined the matter and that in their opinion this Ordinance be reset for public hearing on March 23rd. /s/ Edwin Thomas Smith, Chairman Councilman Glass made a motion that the report be accepted and placed on file. Motion carried. uanrtt A D MEETING FEBRUARY 24: 1964 REPORT OF CITY PLANNING COMMISSION The Honorable Common Council February 19, 1964 City of South Bend South Bend, Indiana Gentlemen: It has come to my attention that there is an error in the legal description of Ordinance No. 4459 -62 passed by the Common Council on May 14, 1962, Attached is an ordinance correcting this error. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: February 18, 1964 The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A" Residential Use and "A" Height and Area District the property generally described as being bounded on the east by the first north -south alley west of Kendall Street, on the wdst by Kemble Avenue, on the north by Indiana Avenue and on the south by Calvert Street was legally advertised under date of January 27, 1964 and given public hearing on February 6, 1964. The following action was taken: After due consideration the Commission determined that 98% of the area is now in single family use. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: February 18, 1964 The attached petition of the Belleville Investment Company, Inc. to zone "C" Commercial Use and "E" Height and area a tract of land being generally described as the north side of Western Avenue from Lombardy Drive to Mayflower Road was legally advertised under date of January 27, 1964 and given public hearing on February 6, 1964. The following action was taken: After due consideration the Commission found that the requested zoning was in the best interest of the area. Motion carried. �!8 REGULAR MEETING FEBRUARY 24 1964 REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend February 18, 1964 South Bend, Indiana Gentlemen: The attached petition of the Belleville Investment Company, Inc. to zone "B" Residential Use and Area District a tract of land being generally described as extending along the south right -of -way Washington Street from Summit Drive to Lombardy was legally advertised under date of January 27, public hearing on February 6, 1964. The following action was taken: After due consideration the Commission found that the proposed zoning would tend to create a buffer between the commercial property to the south and the school and homes to the north. Hamilton to rezone from "A" Residential Use and "A" Height and Area District to "B" Residential Use and "A" Height and Area District the property being generally described as south of Lathrop Street, west of Johnson Street and east of Huey Street was legally advertised under date of' January 27, 1964 and given public hearing on February 6, 1964. The following action was taken: After due consideration the Commission found that the proposed change is in the best interest of the area. ORDINANCE, THIRD READING AN ORDINANCE PROHIBITING DISCRIMINATION IN REAL PROPERTY BECAUSE OF RACE, COLOR, NATIONAL ORIGIN4 , OR ANCESTRY BY CERTAIN OWNERS, SELLERS, RENTERS, LESSORS, GRANTORS, LESSEES, GRANTEES, ASSIGNEES, MIMGING AGENTS, REAL ESTATE BROKERS, REAL ESTATE SALESMEN, LENDERS, AND OTHERS, PROVIDING FOR THE RENAMING OF THE SOUTH BEND FAIR EMPLOYMENT PRACTICE COMMISSION, PRESCRIBING ADDITIONAL DUTIES AND POWERS, AND PROVIDING PENALTIES. The ordinance was given third reading and lost,by a roll call vote of 0 ayes - 9 nays. ORDINANCE NO. 4628 - -- 64 AN ORDINANCE TO AMEND ORDINANCE NO, 4459 -62 BEING AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF THE CITY OF SOUTH BEND, INDIANA, CERTAIN LANDS. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman,Wise seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. Councilman Smith made a motion for a three minute recess. Councilman Geib seconded the motion. Motion carried and Council recessed at 8:40 P.M. The Regular Meeting of the Council reconvened at 8 :43 P.M. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 (Kendall, Kemble, Indiana and Calvert) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the ordinance be set for public hearing on March 9th, 1964. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE. FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED. . (North side of Western Ave. from Lombardy Drive to Mayflower Road), The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be set for public hearing on March 9th, 1964. Councilman Szymkowiak seconded the motion. Motion carried. President Hunter thanked the students from Riley High School and Members of the Young Republican Club for their interest in attending the Council meeting. There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Councilman Geib seconded the motion. Motion carried and Council adjourned at 9:00 P.M. ORDINANCE AN ORDINANCE TO AMEND SECTION 17 -A OF ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, INDIANA s Proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed Ordinance were the following: Mr. Robert Hunt, 1105 Hudson Ave., who presented a petition bearing 2300 signatures, °and Mr. Albert Crowell, 2601 Portage Ave., who represented the Northwest Civic Association. Speaking in opposition to the proposed Ordinance were the following: Professor Herbert E. Sim, 2605 Edison Road, Mr. VaIjean Dickinson, President of the South Bend Chapter of the National Association for the Advancement of Colored People, Mr. Jesse L. Dickinson, Executive Director of the Local Housing Authority, and Rabbi Albert M. Shulman, Chairman of the Housing Authority, Councilman Muszynski made a motion that the Ordinance go to the Council as unfavorable. Councilman Szymkowiak seconded the motion. Motion lost by a roll call vote of 2 ayes (Councilmen Szymkowiak. and Muszynski), 7 nays (Councilmen Hunter; Allen, Palmer, Wise, Geib, Glass and Smith). Councilman Hunter made a motion that the Ordinance go to the Council as favorable. Councilman Geib seconded the motion. Motion carried by a roll call vote of 7 ayes (Councilmen Hunter, Allen, Palmer, Wise, Geib, Glass and Smith), 2 nays (Councilmen Szymkowiak and Muszynski). There being no further business before the Committee of the Whole, Councilman Geib made a motion to adjourn.' Councilman Hunter seconded the motion.
