HomeMy WebLinkAbout02-10-64 Council Meeting MinutesREGULAR MEETING FEBRUARY 10, 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, February 10, 1964, at 8 :10 P.M. with all members present. The meeting was called to order by President John L. Hunter Jr., who presided, ROLL CALL PRESENT :' Councilman Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Minutes of January 27, 1964 /s/ Walter G. Glass ) it John L. PETITION Petition of Lock Joint Tube Co., Inc. and C. R. Holloway to rezone Riverside Drive and Sherman St,( Councilman Geib made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. _REGULAR MEETING FEBRUARY 10, 1964 COMMUNICATION A note to Council Members from Don, Delois and Al Palmer "Thanking you for your kind sympathy expressed in the beautiful flowers received. Councilman Glass made a motion that the communication be accepted and placed on file. Councilman Szymkowiak seconded the motion. Motion carried. COMMUNICATION TO: CITY CLERK - CITY OF SOUTH BEND FROM: COUNCIL - CITY OF SOUTH BEND After the first two regular meetings of the Common Council of the City of South Bend, it has been recognized by its members that an improvement can be made in the presentation of petitions to the Council. By unanimous vote the Council has decided that a change in procedure is in order in the presentation of these petitions. Effective at the meeting of the Council on February 24, 1964, it will be a requirement that the petition give a general description of the location of the property requested to be rezoned. Such petition must be in the hands of the City Clerk on or before noon Wednesday of the meeting in which such petition is presented to the Common Council. It will also be necessary that there be presented to the City Clerk eleven (11) copies of each petition- -one each for the nine Councilmen- -one for the City Clerk and one for the City Planning Commission. Councilman Geib made a motion that the communication be accepted and placed on file. Councilman Palmer seconded motion. Motion carried. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: December 111 1963 The attached petition of the Humble Oil Company to rezone from "B" Residential Use and "B" Height and Area District to "C" Commercial Use and "B" Height and Area District the property generally described as being the southwest corner of Lincoln Way West and Ryer Street was legally advertised under date of October 28, 1963 and given public hearing on November 7, 1963. The following action was taken; After due consideration the Commission found that sufficient commercial j zoning and land use existed in the general area; that this would be an unnecessary and unwarranted intrusion into a residential neighborhood; that it would result in a continuation of strip zoning. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended unfavorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: February 7, 1964 The attached petition of the Common Council to amend Section 17 -A of Ordinance No. 3702, the Zoning Ordinance of the City of South Bend, Indiana was legally advertised under date of January 16, 1964 and given public hearing on January 27, 1964. The following action was taken: After due consideration it was duly moved, seconded, and unanimously carried that the following resolution be adopted: BE IT RESOLVED, that the tlanning Commission finds: 1. That the proposed amendment to the Zoning Ordinance would under ordinary circumstances be a desirable amendment. 2. That one of the purposes of the Zoning Ordinance is to promote the general welfare of the City. 3. That the proposed amendment if adopted at the present time would prohibit the use of certain areas for the purposes for which the City is presently committed to use such areas. That in the opinion of:the Commission the adoption of the proposed amendment at the present time would not promote the general welfare of the City. REPORT OF COMMITTEE OF THE WHOLE February 10, 1964 To the Common Council of-.:the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 ". (Northwest corner of Linden Ave. & College St.). Respectfully report that they have examined the matter and that in their opinion it should be reported favorable.. Isl Edwin T. Smith, Chairman Councilman. Glass made a motion that the report be accepted and placed on file. Councilman Szymkowiak seconded the motion. Motion carried, REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 ". (142 So. Meade St.) Respectfully report that they have examined the matter and that in their opinion this ordinance be set for public hearing on February 24th, 1964. Isl Edwin T. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: February 10, 1964 Your Committee of the Whole to whom was referred "AN ORDINANCE PROHIBITING DISCRIMINATION IN REAL PROPERTY BECAUSE OF RACE, COLOR, NATIONAL ORIGIN, RELIGION, OR ANCESTRY BY CERTAIN OWNERS, SELLERS, RENTERS, LESSORS, GRANTORS, LESSEES, GRANTEES, ASSIGNEES, MANAGING AGENTS, REAL ESTATE BROKERS, REAL ESTATE SALESMEN, LENDERS, AND OTHERS. PROVIDING FOR THE RENAMING OF THE SOUTH BEND FAIR EMPLOYMENT PRACTICE COMMISSION, PRESCRIBING ADDITIONAL DUTIES AND POWERS, AND PROVIDING PENALTIES ". Respectfully report that they have examined the matter and that in their opinion the ordinance go to the Council as unfavorable. Isl Edwin T. REPORT OF HOUSING AUTHORITY OF THE CITY OF SOUTH BEND Mrs. Kathryn Blough City of South Bend City Hall South Bend, Indiana 46601 Dear Mrs. Blough: February 6, 1964 Pursuant to the Housing Authorities Act Chapter 207, Acts 1937 as amended which says in part: "At least once a year, an Authority shall file with the Clerk a report of its activities for the proceeding (preceding) year..." we file this report covering the period from January 1, 1963 to December 31, 1963. We hope that the material of this report will be of value to all who are concerned with'the operation of this public service agency. Please feel free to call on the Board or staff for any desired information that you or others may require as to the operation of the Authority. We are grateful for the help that has come from your office as well as that emanating from other City of South departments. We look toward a pleasant and rewarding relationship. Motion carried, The Clerk was instructed to notify Rabbi Albert M. Shulman and Mr. Jesse L. ORDINANCE NO. 4626 - 64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Northwest corner of Linden & College) The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE - FIRST AND SECOND READING AN ORDINANCE TO AMEND SECTION 17 -A of ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND INDIANA. The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the ordinance be set for public hearing on March 9th, 1964. Councilman Smith seconded the motion. Motion carried. ORDINANCE NO. 4627 - 64 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND SEWAGE TREATMENT PLANT AND HARRY H. VERKLER CONTRACTOR, INC., FOR THE PURCHASE OF ONE SCUM SKIK KIN G TANK FOR THE SUM OF $37,500.00. The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion for suspension of rules. Councilman Szymkowiak seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. RESOLUTION N0. 63 -- 64 Resolution relative to the death of Florence Miller Hunter. Councilman Glass made a motion for the adoption of the Resolution. Councilman Geib seconded the motion. Motion unanimously carried. Resolution adopted. (sea next page) REGULAR TING FEBRUARY 10, 1964 RESOLUTION NO. 63 -- 64 WHEREAS, God, in His Infinite Wisdom, has called from this life, FLORENCE MILLER HUNTER, Mother of Councilman John L. Hunter Jr. WHEREAS, her untimely death has brought much grief and sorrow to her bereaved family and her many friends, NOW, THEREFORE, BE IT RESOLVED that we, the members of the Common Council hereby extend to John L. Hunter Jr. and to the other members of the family our sincere sympathy in this their deepest hour of sorrow; and BE IT FURTHER RESOLVED that a page be set aside in the Council Records in the City of South Bend and this Resolution be copied thereon and copy duly certified by the Clerk be sent to Councilman John L. Palmer and to the other members of the family our sincere sympathy in this their deepest hour of sorrow; and BE IT FURTHER RESOLVED that a page be set aside in the Council Records in the City of South Bend and this Resolution be copied thereon and a copy duly certified by the Clerk be sent to Councilman Albert E.
