HomeMy WebLinkAbout01-27-64 Council Meeting Minuteslim- REGULAR MEETING JANUARY 27 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, January 27, 1964, at 8:27 P.M., with all members present except Councilman Palmer. The meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski. ABSENT: Councilman Palmer REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Minutes of January 13, 1964 Is/ Walter G. Glass ) Isl John L. PETITION Petition of Place & Company, Inc. to rezone a tract of land West of Miami Road on the South side of Ireland Road from "B" Residential, "A" Height and Area District to "C" Commercial, "A" Height and Area District. Councilman Smith made a motion that the petition be referred to the City Plan Commission. Councilman Glass seconded the motion. Motion carried. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: December 11, 1963 The attached petition of Katherine Jennings to rezone from "D" Light Industrial Use and "F" Height and Area District to "B" Residential Use and "A" Height and Area District Lots 15, 16, 17 and 18 Linden Place Addition, being more generally described as being bounded on the east by College, on the south by Linden, on the west by Chicago, Indiana and Southern Railroad right -of -way, and on the north by the first east -west alley north of Linden was legally advertised under date of November 30, 1963 and given public hearing on December 10, 1963. The following action was taken: After due consideration the Commission found that the general area is in residential use, that the present industrial zoning is very questionable and that the present use of the subject area is residential. It was there= fore duly moved, seconded, and unanimously carried that the petition be recommended favorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Ilid%Ana Gentlemen: January 10, 1964 The attached petition of DeWitt Marshall,134 S. Dade Street, to rezone from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "A" Height and Area District Lot 615 Summit Place 3rd Addition, being more generally described as 142 S. Meade Street was legally advertised under date of December 30, 1963 and given public hearing on January 9, 1964. The following action was taken: After due consideration the Commission found that the favorable recommendation of the petition would result in spot zoning and therefore could devaluate the surrounding property, the rezoning would confer on the owner certain rights not enjoyed by other property owners and that the sole purpose of the rezoning was to allow the erection of an auto repair garage. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended unfavorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. ORDINANCE NO. 4619 - - -64 AN ORDINANCE REPEALING AN ORDINANCE PROVIDING AN ORDERLY PROCEDURE BY WHICH EMPLOYEES MAY BE HEARD CONCERNING BUDGET ITEMS WHICH AFFECT THEIR SALARIES AND WAGES AND BY WHICH EMPLOYEES MAY PRESENT GRIEVANCES WHICH RESULT FROM DIFFERENCES OF OPINION BETWEEN SUPERVISORS AND EMPLOYEES UPON WORKING CONDITIONS, iNCEUDING ARBITRATION PROCEDURES AND PROVISIONS FOR DEDUCTING FROM EMPLOYEES' WAGES FUNDS TO PAY ORGANIZATIONS OF EMPLOYEES, AS AMENDED, KNOWN AS ORDINANCE 4612 -63, ENACTED, ON THE 13TH DAY OF NOVEMBER, 1963. The ordinance was given third reading and passed by a roll call vote of 6 ayes (Councilman Hunter, Allen, Wise, Geib, Glass and Smith) - 2 nays (Councilman Szymkowiak and Muszynski) - 1 absent (Councilman Palmer). The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Palmer). ORDINANCE NO. 4621 - - -64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 (Franklin, Chapin, Indiana & Calvert Sts.) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Palmer) ORDINANCE NO, 4622 - - -64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702,AS AMENDED (Arthur, Eddy, Sorin & McKinley Ave.) The ordinance was given third reading and passed by a roil call vote of 8 ayes - 0 nays - 1 absent (Councilman Palmer). ORDINANCE N0, 4623 - - -64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS AMENDED (Jacob, Eddy, McKinley, Colfax and LaSalle Ave.) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Palmer). ORDINANCE NO. 4624 - - -64 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 (MishawakarAve. & 33rd St.) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Palmer) . ORDINANCE' - FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Linden Avenue & College Street) The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the ordinance be set for public hearing on February 10, 1964. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE - FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Lot at 142 So. Meade St.) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the ordinance be set for public hearing on February 10, 1964. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE - THIRD READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Location 17869 Edison Road) The ordinance was given third reading and lost by a roll call vote of 1 aye (Councilman Glass), 7 nays (Councilman Hunter, Allen, Wise, Geib, Szymkowiak, Smith and Muszynski)% 1 absent (Councilman Palmer). Councilman Wise made a motion that the Ordinance be referred back to the City Planning Commission for further study. Councilman Smith seconded the motion. Motion carried. REGULAR MEETING JANUARY 27 1964 ORDINANCE N0, 4625 - - -64 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE IAYNE- NORTHERN CO. INC., FOR THE FURNISHING OF MATERIALS AND LABOR FOR CERTAIN WELLS PUMPS$ CHLORINATION EQUIPMENT, REMODELING OF GARAGE, ELECTRICAL WORK$ PIPING, REMOVAL OF PUMPS AND SEALING OF WELLR FOR THE SUM OF $87,140.00. Vi The ordinance was given first reading by title and second reading in full. Councilman Smith made a motion for suspension of rules. Councilman Geib seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Palmer). The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Palmer). NEW BUSINESS Councilman Smith made a motion to accept the Annual Report of the Park Department. Councilman Szymkowiak seconded the motion. Motion carried. A suggestion was made that Council meetings begin at 7 :30 P.M. instead of 8:00 P.M. Councilman Smith made a motion to keep the present 8 :00 P.M. starting time. Councilman Szymkowi.ak seconded the motion. Motion carried. President Hunter asked Councilman Allen to make a further study of the advisability of changing to an earlier starting time. There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Councilman Geib seconded the motion. Motion carried, and Council adjourned at 9:05 P.M.
