DECEMBER--2, 1963
Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council
Chambers in the City hall on Monday, December 9, 1963, at 9:43 P.M., with all members present. The meeting was
called to order by Councilman Joseph T. Kroll,.President, who.presided.
ROLL CALL:
PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski
ABSENT: None.
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected
the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same
be approved.

Councilman Lehman made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the
motion. Motion carried.
PETITION
Petition of Hoffman Brothers, Inc., to rezone land on Edison road east of Ironwood.
Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman
seconded the motion. Motion carried.

REPORT OF THE COMMITTEE OF THE WHOLE

Your Committee of the-Whole, to whom was referred AN ORDINANCE PROHIBITING DISCRIMINATION IN REAL PROPERTY BECAUSE 0
RACE, COLOR, NATIONAL ORIGIN, RELIGION, OR ANCESTRY BY CERTAIN OWNERS, SELLERS, RENTERS, LESSORS, GRANTORS, LESSEES,
GRANTEES, ASSIGNEES, MANAGING AGENTS, REAL ESTATE BROKERS, REAL ESTATE SALESMEN, LENDERS AND OTHERS, PROVIDING FOR
THE RENAMING OF THE SOUTH BEND FAIR EMPLOYMENT PRACTICE COMMISSION, PRESCRIBING ADDITIONAL DUTIES AND POWERS, AND
PROVIDING PENALTIES, Respectfully report that they have examined the matter and it should remain in the Committee of
the Whole.

MINORITY REPORT
The undersigned members of the Common Council feeling that the Fair Housing Ordinance has been recommended by the
Mayor's Bi- Racial Committee and, further, that the same has been supported by 65 clergymen of this City and numerous
other civic groups of the City, the combined weight of whose membership represents the great majority opinion of our
city, do hereby submit a minority report of dissent from the majority report of the Committee of the Whole which
majority report by its recommendation of holding it in committee defeated the demonstrated opinion of South Bend
that the ordinance should be enacted.

REPORT OF CITY PLANNING COMMISSION
December 5,'1963
The Honorable Common Council
City of South Bend
South Bend, Indiana
Gentlemen:
In the matter of the petition of Balint, Sipocz, and Vadas for a change of zoning of Lots 1, 2, 3, 19, 20, and 21
of Lincoln Plaza, being between Chicago and Sheridan on the north side of Lincolnway West, the Council received an
unfavorable recommendation from the Planning Commission on 8 July, 1963.
Chapter 133, Acts of General Assembly 1961 amends the Planning Act; i. e., Chapter 174, Acts of 1947, Section 64
as follows:
Failure of the City Council to pass such proposed ordinance by said affirmative vote within ninety (90) .days after
its rejection by the plan commission shall constitute rejection of the proposed ordinance and it shall not be
reconsidered by the Planning Commission or the City Council until the expiration of one (1) year after date of its
original rejection by the Plan Commission. (The said "affirmative vote" referred to above is the statutory require-
ment of 75% vote of the Council to override an unfavorable recommendation.)
The 90 day time period expired on 8 October, 1963, It would seem eminently clear, therefore, that the subject
petition is not at issue.

REGULAR MEETING
RESOLUTION NO. 61 - - -63
DECEMBER 9, 1963
RESOLUTION AUTHORIZING CERTAIN PAYMENTS TO BE MADE TO SALARIED EMPLOYEES OF THE
CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana, is approaching the close of its fiscal year; and,
WHEREAS, the office of the City Controller will be required to make numerous payments and close its numerous
and complicated accounts; and,
WHEREAS, it is desirable that the work of said office be simplified;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana:
1. That all salaried officers and employees of the City shall be paid their salaries for the month of December,
1963, on the 20th day of December, 1963.
2. The Controller of the City of South Bend is hereby authorized to make said salary payments upon said date.
3. This Resolution shall be in full force and effect from and after its adoption by the Common Council and
approval by the Mayor.

Councilman Lehman made a motion for adoption of the Resolution. Councilman Coleman seconded the motion. Motion
carried by a roll call vote of 9 ayes, 0 nays.
NEW BUSINESS
Councilman Lehman made a motion to dispense with the December 23rd meeting of the Council. Councilman Tellson
seconded the motion. Motion carried.
Councilman Krueper made a motion that the Clerk be directed to advise the City Controller that the payroll checks
for the second half of the month of December, 1963 for all hourly rated employees of special services, utilities,
and city departments be held until December 31, 1963, and be released to employees on that date if it is shown
that they have worked their basic hours in their respective departments. In the event any employee does not work
the basic hours for which he is being paid, an adjustment must be made in the total amount of the check. Councilman
Muszynski seconded the motion. Motion carried.
This being the last meeting of this Council, President Kroll thanked all of the members of the Council for their
cooperation and help during the past four years and wished the incoming Councilmen a successful term of office.
Councilmen Allen, Ladewski, Coleman, Krueper and Muszynski all expressed their pleasure in having worked in the
Council during the past four years and also extended best wishes to the incoming Councilmen. Councilman Lehman
said he wished to commend the.City Clerk and her Deputy for their courtesy and efficient service during the
past term.
There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman
Coleman seconded the motion. Motion carried and the Regular meeting of the Common Council adjourned at 10 :15 P.M.
