HomeMy WebLinkAbout07-29-63 Council Special Meeting minutesSPECIAL MEETING = __, tti t _---- _________________________= JULY 29, 1963 Be it remembered that the Council met in Special Session in the Council Chambers in the City Hall, on Monday, July 29, 1963, at 8:47 P.M., with all members present, the date having been set by the Council at the July 22, 1963 meeting of the Council. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF SANITATION OFFICER Member of the Common Council Gentlemen: July 26, 1963 Herein is a report of my activities in regards to the compliance of the Weed Ordinance. As of this date, July 26, I have received the followong complaints and have had compliance to the ordinance as follows: Number of complaints 148 Cut by owners 80 Cut by Street Department 19 To be cut by St. Joseph County 15 Complaints pending 34 Total 148 In addition there were 360 parkways and 24 lots cut by the Street Department during the month of June. In the event that the City of South Bend through its Street Commissioner effects the removal of such obnoxious grow or has paid for its removal, the actual cost hereof, plus accrued interest at the rate of six (6%) per cent per ann from the date of the completion of the work, it not paid by such owner prior thereto, shall be charged to the owner REPORT OF SANITATION OFFICER (continued) of such property on the next regular tax bill forwarded to such owner by the City, and said charge shall be due and payable by said owner at the time of payment of such tax bill. In addition to the above, any owner of a lot, place or area, or the agent of such owner, who violates any provision of this ordinance, after due notice is given, and failure to remove said weeds, grass, or deleterious, unhealthful growths, over 12 inches high, or other noxious matter that may be growing, lying or located within their lot, place or area, on conviction thereof shall be fined for each offense in a sum not less than Twenty ($20.00) Dollars or more than Three Hundred ($300.00) Dollars, to which may be added imprisonment in the County Jail for a period not to exceed thirty (30) days at the option of the court, and each violation shall constitute a separate and distinct offense. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY To the Members of the Common Council City of South Bend, Indiana Gentlemen: July 29, 1963 This is in answer to your Directives dated July 24, 1963 concerning the following requests: 1. Councilman Lehman's request that an investigation be made of .the traffic problem in the 1700 block of South Michigan Street near Azar's and Bonnie Doon's Drive -in restaurants. 2. Councilman Allen's request to the Board of Public Works and Safety and the Police Department to check the ice Cream vendors who are violating the Anti -Noise Ordinance. The Board requested the Police Department to submit a report concerning these two items. This report was filed with the Board at its meeting of July 29, 1963. Verifax copy of the report is attached hereto. OFFICERS REPORT 7 -29 -63 Attention: Chief Harman Board of Works Respectfully submitted, /s/ Anthony J. Sabo Anthony J. Sabo, Clerk Board of Public Works and Safety Insp. Nicholas The Council meeting field July 22, 1963 directed the Police Department to check into the following two problems: 1. Ice Cream vendors and the sounding of their bells. 2. So. Michigan Street traffic and noise situation. Ice Cream vendors have been advised by;our department that they must have all the necessary permits and licenses before they can operate,on the city streets. They also have been advised on the City Ordinance pertaining to the sounding of any bells and sounding devices. A policy on what times their sounding devices were set to operate was agreed upon, and this was between the hours of noon and 3:00 P.M. they.would not be able to ring any bells, or use any sounding device. After 9:00 pm in the residential neighborhood no bell or sound was to be heard. If any company violated this agreement, arrest would be made, with the possibility a stricter enforcement of the Ordinance be made. The South Michigan Street traffic problem has been of great concern and officers have been directed to follow a very strict enforcement program, and this has been done. Since July 1, 1963 to this date, 490 traffic arrests have been made in the City of South Bend. Of this total number, over half have been in the So. Michigan Street area. Starting July 20, 1963 assignments were changed so that two traffic cars, two solo bikes, and one three - wheeler were in this area at the times violations ran the highest. During this period (July 20 -July 27) 131 violations were written by these officers. Ther has been a change here, and although the traffic flow is heavy, violations of traffic and noise have been cut down. The Traffic Engineer also has been advised of the problem, and he will check to see if any problem can be straightened out in the way of engineering. The Police Department will continue a strict vigil on both these complaints and will do its best to keep the problem of noise and traffic violations at a minimum. /s/ Cornelius Nicholas Cornelius Nicholas Inspector- Uniform Div. 7 -29 -63 South Bend Police 10:30 am Councilman Muszynski made a motion that the report be accepted and placed on file. REPORT OF TRAFFIC ENGINEER Members of the Common Council City Hall South Bend, Indiana Gentlemen: July 29, 1963 At the regular meeting of the South Bend Common Council on July 22, 1963, a request was made to investigate the traffic problem in the 1700 block of South Michigan Street. _. REPORT OF TRAFFIC ENGINEER (continued) I have already met with the Inspector of the Uniform Division of the Police Department and studies will be made of vicinity in question. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1964, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. ORDINANCE NO. 4591 - - -63 AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1964 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0. nays. ORDINANCE AN ORDINANCE APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF ALL BUDGET - OPERATED DEPARTMENTS OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1961, AND ENDING DECEMBER 31, 1964, INCLUDING DEPARTMENTS, FUNDS AND COMMISSIONS FOR WHICH MONEY IS APPROPRIATED, IN WHOLE OR IN PART, FROM FUNDS OTHER THAN THE GENERAL FUNDS, OF SAID CITY TO -WIT: STREET, TRAFFIC AND PARK DEPARTMENTS, FIREMEN'S PENSION AND POLICEMEN'S PENSION FUNDS, AND THE CITY PLAN AND URBAN REDEVELOP- MENT AND FAIR EMPLOYMENT PRACTICES COMMISSIONS, BUILDING DEMOLITION, REPAIR AND CONTINGENT FUND, PARK DISTRICT FUND, GENERAL SINKING FUND, HOSPITAL FUND, ART ASSOCIATION FUND AND THE URBAN REDEVELOPMENT BOND FUND: PROVIDING THAT SUCH APPROPRIATIONS SHALL INCLUDE ALL OUTSTANDING CLAIMS AND OBLIGATIONS: FIXING THE SALARIES OF ALL CITY OFFICIALS AND EMPLOYEES, REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREIWTH: PROVIDING A TIME WHEN THE SAME SHALL TAKE EFFECT. Councilman Lehman made a motion'that the Clerk read the total of each section instead of each item. Councilman Tellson seconded'the motion. Councilman Allen also seconded-the motion. Motion carried unanimously. The Clerk then gave the Ordinance its first reading by title and second reading in full. Councilman Kroll, President announced a five minute recess. The Council recessed at 9:30 P.M. The Council reconvened at 9:45 P.M. Councilman Krueper made a motion that�the annual meeting for the adoption of the budget and tax levy be held on August 26, 1963, at 8:00 P.M. and that there be legal publication in The South Bend Tribune and The Record on August 2nd and August 9th, 1963. Councilman Lehman seconded the motion. Motion carried. Councilman Allen moved that the Committee of the Whole meet on August 19, 1963, at 7:30 P.M., at the Morris Civic Auditorium to hold a public hearing on the budget and tax levy for 1964. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FIXING THE TAX LEVY FOR THE YEAR 1964 FOR THE CIVIL CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in -full. Councilman Coleman made a motion that the Ordinance be set for public hearing on the 19th of August, 1963 in the Committee of the Whole, the meeting to be held in the Morris Civic Auditorium at 7:30 P.M., and that the adoption of the tax levy be on the 26th day of August, 1963 at 8:00 P.M. Councilman Glass seconded the motion. Motion carried. RESOLUTION No. 41 - - -63 Resolution relative to the death of Sarah Fletcher Allen. Councilman Muszynski moved for the adoption of the Resolution. Councilman Tellson seconded the motion. Motion unanimously carried. Resolution adopted. President Kroll requested the Council to stand for a moment of silent prayer in memory of Sarah Fletcher Allen, daughter of Councilman J. Chester Allen and Mrs. Allen. W SPECIAL MEETING R E S O L U T I O N JULY 29, 1963 WHEREAS, SARAH FLETCHER ALLEN, daughter of our fellow - Councilman, J. Chester Allen, has departed this life; and, WHEREAS, the death of this young and brilliant girl has caused much grief and sorrow to her bereaved family and her many friends. NOW, THEREFORE, BE IT RESOLVED that we, the members of the Common Council hereby extend to J. Chester Allen, to Mrs. Allen, and to the other members of the family our sincere sympathy in this their deepest hour of sorrow; and, BE IT FURTHER RESOLVED that a page be set aside in the Council Records in the City of South Bend and this Resolution be copied thereon and a copy duly certified by the Clerk be sent to Councilman J. Councilman Ladewski seconded the motion. Motion carried and the Special Meeting of the Common Council adjourned at 9:59 P.M. ATTEST: CLERK APPROVED: PRESIDENT PUBLIC HEARING MEETING OF THE COMMITTEE OF THE WHOLE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA Upon motion duly made, seconded and unanimously carried at the July 29th meeting of the Common Couhcil the Commit of the Whole Meeting of the Council was set for this date and said meeting to be held in the Morris Auditorium to give Citizens the opportunity to review the proposed budget and Tax Levy and to be heard thereon. The Meeting was called to order by Councilman T. W. Lehman, Chairman, who presided. The time the meeting convened was 7:40 P.M. Upon roll call, all members were present. The Chairman announced that each department would be considered separately and asked the Clerk to read the pro- posed budget. Through the Courtesy of the Minnesota Mining Company, The St. John Business Machines Company and their representa- tive, Jack G. Badger, each department's budget was projected upon a screen making the figures visible for all in the Auditorium. Speaking on the proposed budget were the following: Miss Virginia Guthrie, Executive Secretary of the South Bend Civic Planning Association; Peter Bognar, 807 West Washington Avenue; Mrs. Frederick Mutzl, 320 Parkovash; Paul Boehm, Recreational Director for the Park Department; Richard Krirman, 1118 Queen Street; Ralph Newman, Park Department Superintendent; Henry Sucher, Urban Redevelopment Director; Charles Hahn, 1619 East Colfax Avenue; Richard Kromkowski, President of the Park Commissioners; Janet Allen, 125 West Marion Street; Lewis Haber, South Bend Tribune. Councilman Kroll moved for a five minute recess. Councilman Coleman seconded the motion. Motion carried. Meeting recessed at 10 :10. The meeting was reconvened at 10:18 P.M. All persons who wished to be heard, having been given the opportunity so to do, Councilman Kroll moved that the Public Hearing be continued to the August 26, 1963, meeting of the Council to be held in the Council Chambers in the City Hall.
