HomeMy WebLinkAbout07-08-63 Council Meeting MinutesREGULAR MEETING _______ _______________________________ i� July 8, 1963 Be it remembered that the Common Council of the City of South Bend, Indiana met in Regular Session in ;the Council Chambers, City Hall, Monday, July 8, 1963 at 8 :49 P.M., with all members present excepting Councilman Krueper. The meeting was called to order by President Joseph T. ;Kroll, who presided. ROLL CALL: Present: Councilmen Kroll, Allen, Ladewski, Coleman, Glass, Lehman, Muszynski and Tellson. Absent: Councilman Krueper. REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervisionoof the Minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATIONS The Clerk read a communication from the American Municipal Association inviting the officials of the City to attend the American Municipal Congress to be held in Houston, Texas, at the Shamrock Hilton, on August 10 -14, 1963. Councilman Lehman made a motion that the communication be accepted and placed on file. Councilman Muszynski seconded the motion and the motion was carried. The Clerk read a communication from Councilman Paul E. Krueper, Jr. informing the Council that he would be unable to attend the July 8th meeting because of a previous out of town committment. Councilman Lehman made a motion ;that the communication be accepted and placed on file. Councilman Muszynski seconded the motion and the motion was carried. PETITION Petition of the Belleville Investment Company, Inc. to amend Zoning Ordinance No. 3702 so as to provide for Commercial Zoning of a portion of Belleville Shopping Center in the City of South Bend, Indiana. Councilman Lehman made a motion that the petition be referred to l.the City Planning Commission. Councilman Glass seconded the motion. Motion carried. REPORT OF THE CLERK OF THE BOARD OF PUBLIC WORKS AND SAFETY July 8, 1963 To the Members of the Common Council City of South Bend, Indiana Gentlemen: I wish to answer your Directive regarding information on air conditioning for the Chamber. In 1958 in the Board of Public Works budget we had $3,000.00 earmarked for air- conditioning for the Council Chambers Calling in Air Conditioning experts they informed us that the cost would be approximately $7,000.00. I so reported back to the Council and they decided to let the matter drop. The original item in my budget for air conditioning was not used, therefore at the end of the year it went back to the General Fund. Regarding window air conditioners, I wish to caution the Council that because of the odd size of these windows it would require changing of windows and window frames. REPORT OF THE COMMITTEE OF THE WHOLE To the Common.Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14TH DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, Respectfully report that that have examined the matter and that -in their opinion IT SHOULD BE REPORTED UNFAVORABLE. /s/ T. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED BY THE COMMON;COUNCIL OF THE CITY OF SOUTH BEND ON THE 14TH DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Southwest corner of Twyckenham Drive and Lincoln Way East) The Ordinance was given third reading and lost by a roll call vote of 6 Nays (Councilmen Kroll, Allen, Ladewski, Coleman, Glass and Lehman, and 2 Ayes.(Councimen Tellson and Muszynski). 1 Absent (Councilman Krueper). ORDINANCE NO. 4586 -63 AN ORDINANCE FOR ADDITIINAL APPROPRIATIONS IN THE BUILDING DEPARTMENT = $265.00 (as amended) The Ordinance was given third reading and passed by a roll call vote of 8 Ayes 0 Nays 1 absent (Councilman Krueper) REPORT OF THE CITY PLAN;COMMISSION July 1, 1963 The Honorable Common Council, City of South Bend South Bend, Indiana Gentlemen: The attached petition of the South Bend Housing Authority to rezone from "A" Residential Use and "A" Height and Area District to "A -1" Residential and "B" Height and Area District the land bounded on the north by Hamilton, on the east by Fremont Street, on the south by Marquette Blvd. and on the west by Meade Street was considered by the Commission at their June 27, 1963 meeting. After due consideration the Commission ;found that as the Zoning Ordinance contains Section 17 -A they are without authority in the matter. REPORT:OF:'THE CITY PLANNING COMMISSION July 1, 1963 The Honorable Common Council City of South Bend, Indiana Gentleman: The attached petition-,of the South Bend Housing Authority to rezone from "D" Light Industrial Use and "D" Height and Area District to "B" Residential and "B" Height and Area District the land bounded on the north by Western Avenue on the east by Scott Street, on the south by the New York Central Railroad right -of -way and on the west by Laurel Street was considered by the Commission at their June 27, 1963 meeting. After due consideration the Commission found that as the Zoning Ordinance contains section 17 -A they are without authority in the matter. Upon motion made by Councilman Glass and seconded by Councilman Lehman the report was accepted and placed on file. 7 REPORT OF THE CITY PLANNING COMMISSION July 1, 1963 The Honorable Common Council, City of South Bend, South Bend, Indiana Gentlemen: The attached petition of Joseph Muia to rezone from "B" Residential Use and "E" Height and Area District to "C" Commercial Use and "E" Height and Area District the north 12 feet of lot 154 of Horne and Dunn's lst Sub., lying parallel to and being 132 feet, more or less, south of Mishawaka Avenue and having frontage on the west right -of- way line of 27th Street was legally advertised under date of June 17, 1963 and given public hearing on June 27, 1963. The following action was taken: After due consideration the Commission found the requested zoning to be the most reasonable zoning for the subject property. REPORT OF THE CITY PLANNING COMMISSION July 1, 1963 The Honorable Common Council City of South Bend South Bend, ;Indiana Gentlemen: The attached petitions of Danny Balint, Joseph Sipocz, and Endre Vadas to rezone from "A -1" Residential Use and "A" Height and Area District to "C" Commercial Use and "A" Height and Area District Lots 1, 2, 3, 19, 20 and 21 of Lincoln Plaza, being generally described as the lots between Sheridan A venue and Chicago Street and having frontage on Lincolnway West were legally advertised under date of June 17, 1963 and given public hearing on June 27, 1963. The following action was taken: After due consideration the Commission found that the rezoning of subject property would constitute spot zoning. It would in addition be an unwarranted intrusion into a residential area; that there was ample commercial zoning in the vicinity; that the lots in question could be developed residentially as attested by the surrounding residences. REPORT OF THE CITY PLANNING COMMISSION July 1, 1963 The Honorable Common Council, City'of South Bend, South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A" Residential Use and "A" Height and Area District the property generally described as bounded on the east by Sheridan Street, on the west -by the first north -south alley west of Gladstone Street, on the north by Ford Street andon the south by Sample Street to Albert Street-and the first east -west alley north of Sample Street between Albert Street and Sheridan Avenue was legally advertised under date of June 17, 1963 and given public heari on June 27, 1963. The following action was taken: After due consideration the Commission found that the best zoning for the subject property would be "A" Residential and "A" Height and Area District. REPORT OF THE CITY PLANNING COMMISSION July 1, 1963 .:The Honorable Common Council, City of South Bend, South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use and "B" Height and Area District to "A" Residential Use and "A" Height and Area District Lots 500 -733 inclusive of Belleville Gardens, 2nd Unit, being more generally described as bounded on the east by the rear lot line of lots abutting on Edison Avenue, on the west by Lombardy Drive and the north -south property line between Barberry Lane and Lombardy Drive, on the north by Sample Street and on the south by the rear lot line of lots abutting on Meadow Lane was legally advertised'-under date of June 17, 1963 and given public hearing on June 27, 1963. The following action was taken: After due consideration the Commission ;found that the best zoning for the subject property would be "A" Residents, and "A" Height and Area District. The following action was taken: After due consideration the Commission found that the best zoning for the subject property would be "A" Residential and "A" Height and Area District. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 ( Lots 2 and 3 in Lincoln Plaza) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 22, 1963, Councilman Ladewski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 ( Lot 1 in Lincoln Plaza) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 22, 1963. Seconded by Councilman Coleman. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 ( Lots 12,20 and 21 in Lincoln Plaza) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 22, 1963. Councilman Ladewski seconded the motion. Motion carried. REGULAR MEETING ORDINANCE JULY 8, 1963 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 ( Lots 379 -403 inclusive, 488 -515 inclusive, Lots 572 -627 inclusive and Lots 684 -739 inclusive in Belleville 3rd Unit.) 5105 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 22, 1963. Councilman Coleman seconded the motion. Motion carried, ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Lots 500 -733 inclusive of Belleville Gardens 2nd Unit) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that Ordinance be set for public hearing on July 22, 1963. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Lots 760 -807 inclusive and part of Lot 728 of Belleville Unit "F ") The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 22, 1963. Councilman Ladewski seconded the motion. Motion carried. Councilman made a motion for a five minute recess at 9:35 P.M. Seconded by Councilman Ladewski. Motion carried. The Council reconvened at 9:50 P.M. There being no further business to come before the Council, Councilman Lehman made a motion to adjourn, seconded by Councilman Allen.
