Chambers in the City Hall on Monday, May 27, 1963, at 8:17 P.M., with all members present except Councilman Tellson.
The Meeting was called to order by President Joseph T. Kroll, who presided.

Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected
the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be

URBAN REDEVELOPMENT DEPARTMENT REPORT
The Urban Redevelopment Commission filed :a Progress Report on the Workable Program for Community Improvement.
After some discussion among the Councilmen and after hearing Mr. Henry Sucher, Director, Councilman Krueper made a
motion that the matter be.set ofrer for approval until the June 10, 1963, Meeting of the Council. Councilman Glass
seconded the motion. Motion carried.

AN ORDINANCE AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY.
THE MUNICIPAL CITY OF SOUTH BEND LOCATED IN THE CITY OF SOUTH
BEND, ST. JOSEPH COUNTY, INDIANA, DESCRIBED AS FOLLOWS:
Lot No. 16 in Council Oaks Addition to the City of South Bend
The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for
suspension of rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays,
1 absent (Councilman Tellson). The Clerk then read Ordinance No. 4583 - - -63 for its third reading and it was passed
.by a roll call vote of 8 ayes, 0 nays, -1 absent (Councilman Tellson).
ORDINANCE
AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE BUILDING
DEPARTMENT FUND - $265.00
The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the
Ordinance be set for public hearing on June 24, 1963. Councilman Lehman seconded the motion. Motion carried.
RESOLUTION NO. 34_ --63
WHEREAS, the Municipal City of South Bend has made applications to 'the Housing and Home Finance Agency of the
United States under the Public Works Acceleration Act, and
WHEREAS, that one of the projects being processed by said Housing and Home Finance Agency, is known as APW- Ind. -�
1G, and
WHEREAS, the said Agency is prepared to match Federal funds with non - Federal funds to be provided by the Munici-
pal City of South Bend, and
WHEREAS, it is necessary for the Municipal City of South Bend to provide capital improvement project funds for
public works projects under said APW- Ind., -1G, in the sum of Five Hundred Forty -Five Thousand Dollars ($545,000.00),
and,
WHEREAS, in order to acquire said Federal Funds, it will be necessary for the Municipal City of South Bend to
undertake additional public work, or works in an amount equal to Five Hundred Forty -five Thousand Dollars
($545,000.00), for the period of time that it will take to complete APW- Ind. -1G, and
WHEREAS, it is contemplated that said project will be completed in-1963,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, that the Municipal City of South
Bend will undertake additional public work,,?,? or works in the amount of Five Hundred Forty -five Thousand 1,$545,000.00)

BE IT FURTHER RESOLVED THAT FROM AND AFTER THE PASSAGE, ENROLLMENT, ATTESTATION AND SIGNATURE BY THE CLERK
and presiding officer and approval by the Mayor, this resolution shall become effective.

RESOLUTION NO. 35 - - -63

($185,000.00), for the year 1963.
BE IT FURTHER RESOLVED that from and after the passage, enrollment, attestation and signature by the Clerk and
presiding Officer and approval by the Mayor, this resolution shall become effective.

RESOLUTION NO. 36 - - -63
WHEREAS, the Common Council of the Municipal City of South Bend, authorized an appropriation for a revision
and codification of the Ordinances of the City of South Bend, Indiana, to be known as the "Municipal Code of
South Bend, Indiana" up to and including ordinances heretofore adopted to December 31, 1962, and
WHEREAS, there have been submitted by the Michie City Publications Company, Incorporated of Charlottesville,
Virginia, galley proofs numbered 1 to 158 inclusive, constituting the Official Code of the Municipal City of South
Bend, and
WHEREAS, it is necessary that after said galley proofs have been approved, that said galley proofs be returned
to the Michie City Publications Company, Incorporated of Charlottesville, Virginia, for the preparation of a
general index and the paging and final printing of the entire Code, and
WHEREAS, it is required by the laws of the State of -Indiana, that an official ordinance by adopted by this
Council, adopting said Municipal Code,
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the Municipal City of South Bend, authorize and
instruct the City Attorney to prepare said adopting ordinance and submit the same to the Common Council of the City
of South Bend for official adoption, when the effective date of the Code can be determined and fixed with certainty;
when the said Company has completed their preparation of the general index, the paging and final printing,
BE IT FURTHER RESOLVED that the Clerk of the City of South Bend is hereby authorized to submit one set of said
galley proofs numbered 1 to 158, inclusive, to the said Michie City Publications Company Incorporated of Charlottes-
ville, Virginia, for the completion of the Code by preparation of said general index, paging and final printing
thereof.
BE IT FURTHER RESOLVED, that from and after the passage, enrollment, attestation and signature by the Clerk
and presiding officer and approval by the Mayor, this resolution shall become effective.

RESOLUTION NO. 37 - - -63
RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE CITY PLANNING
COMMISSION $150.00, AND THE TRANSFER OF SAME FROM ONE ACCOUNT TO ANOTHER IN
THE SAME CATEGORY OF THE CITY PLANNING COMMISSION
WHEREAS, certain extraordinary conditions have developed since the adoption of the existing annual budget, so
that it is now necessary to appropriate more money than was appropriated in the annual budget for the various funet
of City Government to meet such extrao -gdinary emergencies; and
WHEREAS, Account No. 243, described as Photographing, and Blue Printing, in the City Planning Commission fund is
depleted and the sum of One Hundred Fifty ($150.00) Dollars is needed forthwith, and
WHEREAS, under Account No. 241, described as Printing, other than office Supplies, under the City Planning
Commission Fund, there is One Hundred Fifty ($150.00) Dollars that will not be needed at this time,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH.BEND,,that the sum of One Hundred Fi
($150.00) Dollars be transferred from Account No. 241, described as Printing, Other than Office Supplies under the
City Planning Commission Fund, to Account No. 243, described as Photographing and Blue Printing, under the City
Planning Commission Fund.

Councilman Coleman made a motion to amend the Resolution in the last line of the third paragraph by striking "at this
time ". Councilman Allen seconded the motion. Motion carried. Councilman Coleman made a motion for adoption of the
Resolution, as amended. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 8ayes, 0 nays,
1 absent (Councilman Tellson).
RESOLUTION NO. 38 - - -63
RESOLUTION TO TRANSFER $93,800.00 FROM THE GENERAL FUND OF THE CIVIL CITY OF SOUTH
BEND TO THE GENERAL SINKING FUND OF THE CIVIL CITY OF SOUTH BEND
WHEREAS, by authority of Chapter 71 of the Acts of 1961, of the General Assembly of the State of Indiana, also
found in Burns Indiana Statutes 61 -1208, the Common Council of the City of South Bend has the authority to transfer
monies from one fund having a sufficient balance to another fund which is depleted; and
WHEREAS, the General Fund of the Civil City of South Bend has a sufficient balance and the General Sinking Fund
of the Civil City of South Bend is depleted; and
WHEREAS, monies have not been delivered by the St. Joseph County Treasurer and the St. Joseph County Auditor to
the Civil City of South Bend from the 1962 taxes payable in 1963, in a sufficient amount; and
WHEREAS, sufficient monies will be available from the St. Joseph County Treasurer and Auditor to pay to the
City monies due and owing to and by virtue of taxes to be derived from personal and real property; and
WHEREAS, said monies are anticipated to be received on or before the 1st day of August, 1963,
NOW, THEREFORE, BE IT RESOLVED, that the Controller of the City of South Bend, be authorized to temporarily
transfer the sum of $93,000.00 out of the General Fund of the Civil City of South Bend, to the General Sinking':
Fund of the Civil City of South Bend, and that said repayment from the General Sinking Fund to the General it
Fund be effected on or before the 1st day of August, 1963, and
BE IT FURTHER RESOLVED, that the Controller issue a warrant and receipt for the amount of said transfer,
and that said warrant shall be endorsed and deposited in the depository account designated for said General
Sinking Fund, and
BE IT FURTHER RESOLVED, that no appropriation shall be required for the said transfer, and said repayment, and
that no interest shall be charged on said temporary transfer.

There being no further business to come before the Council, Councilman Muszynski made a motion to adjourn.
Councilman Lehman seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at
9 :24 P.M.
