HomeMy WebLinkAbout04-08-63 Council Meeting MinutesREGULAR MEETING APRIL 8, 1963 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers on Monday, April 8, 1963, at 8:11 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATION The Clerk read a communication from the South Bend Jaycees, Inc., favorinb the principal of county wide incineration as a method of refuse disposal. Councilman Lehman made a motion that the communication be referred to the Health Committee of the Council. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATION The Clerk read a communication from the Mishawaka Womens Club recommending a joint solution of the common problem of refuse disposal by the South Bend - Mishawaka Metropolitan Area. Councilman Lehman moved that the communication be referred to the Health Committee of the Council. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition ro rezone the South -west corner of Lincolnway East and Twyckenham Drive. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE To the Common Council of the City of South Bend: Your Committee on Ordinances, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOW14 AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED, (Relative to procedure of amendments), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLY AND SET FOR PUBLIC HEARING ON MAY 13, 1963. j is/ J. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY To Members of the Common Council South Bend, Indiana Gentlemen: RE: Coal Dust Complaint April 8, 1963 The matter of the coal dust complaint, transmitted to the Board of Public Works and Safety by the Common Council through the City Clerk, was acted upon by the Board of Public Works & Safety at its regular meeting on April 8, 1963. The following action has been taken: An affidavit, prepared by the City Attorney's Office, has been signed by one of the residents in the affected area, a warrant has been issued by the City Clerk's Office and service of same has been accepted by an officer of the Rose Coal & Fuel Company. ANNUAL REPORT OF SEWAGE TREATMENT PLANT All Councilmen have copies of the Annual Report of the Sewage Treatment Plant. Councilman Lehman made a motion that the report be accepted and placed on file. Councilman Krueper seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 4381 - - -61, AND COMMONLY KNOWN AS THE BUILDING CODE FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, Respectfully report that they have examined the matt and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. ORDINANCE NO. 4569 - - -63 AN ORDINANCE AMENDING ORDINANCE NO. 4381 - - -61, AND COMMONLY KNOWN AS THE BUILDING CODE FOR THE CIVIL CITY OF SOUTH BEND, INDIANA The Ordinance was given third reading and passed by a roll call vote of 9 ayes and 0 nays. REPORT OF CITY PLANNING COMMISSION April 8, 1963 The Honorable Common Council City of South Bend, South Bend, Indiana Gentlemen: The attached petition of Crest Manor Corporation to zone "A" Residential and "At1 Height and Area District the recently annexed land being generally described as a tract of land situated in the north half of Section 31, T37N, R3E, south of Jackson Road between Miami Road and Ironwood Drive and being bounded on the north and east by the present city limits was legally advertised under date of March 25, 1963 and given public hearing on April 4, 1963. The following action was taken: After due consideration the Commission found that the requested zoning would be the best zoning for the subject property. REPORT OF CITY PLANNING COMMISSION April 8, 1963 The Honorable Common Council City of South Bend South, Bend, Indiana Gentlemen: The attached petition of property owners to rezone from the existing zoning to "A" Residential Use and t°A" Height and area District Lots 1 -60 inclusive of City View Place being generally described as the east side of Kemble between REPORT OF CITY PLANNING COMMISSION (continued) Ewing and Calvert, the west side of Catalpa between Ewing and Calvert and the east side of Catalpa between Donald and Calvert was legally advertised under date of March 25, 1963 and given public hearing on April 4, 1963. The follow- ing action was taken: After due consideration the Commission found that the best zoning for the subject property would be ° "A" Residential. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended favorably to the Council with the further recommendation that Lots 23 -24 and the south 40 feet of Lots 25, 26, and 27 be excluded from the petition. REPORT OF CITY PLANNING COMMISSION April 8, 1963 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use' and "B" Height and Area District to "All Residential Use and "A" Height and Area District Lots 201 -206 inclusive of Brentwood Estates 5th Addition and Lots 1, 2, 3 also Lots 26 -35 inclusive and Lots 49 -55 inclusive and Lots 65 and 66 inclusive of Alwards Addition and Lots 13 -24 inclusive and Lots 31 -46 inclusive of Vogt's 1st Addition being more generally described as being bounded on the east by the first north -south alley west of Bendix Drive, on the west by Ryer Street, on the north by Lincolnway West and on the south by Ardmore Trail (Crumstown Avenue) was legally advertised under date of March 25, 1963 and given public hearing under date of April 4, 1963. The following action was taken: After due consideration the Commission found that the best zoning for the subject property would be "A" Residential. REPORT OF CITY PLANNING COMMISSION April 8, 1963 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "C" Commercial Use and ''D " Height and Area District to "A" Residential Use and "A" Height and Area District Lots 3, 4, 5 of Steyaert and Gryp Addition including Lot 272 of Part of Northwest 3rd Plat and Lots 1 and 2 of Tzitonok's Sub. being generally described as the northeast and southwest corners of Bryan and Sherman was legally advertised under date of March 25, 1963 and given public hearing on April 4, 1963. The following action was taken: After due consideration the Commission found that the best zoning for the subject property would be "A"' Residential. The following action was taken: After due consideration the Commission found that the best zoning for the subject property would be "A" Residential. REPORT OF CITY PLANNING COMMISSION April 8, 1963 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use and "A" Height and Area District to "A" Residential use and "A" Height and Area District the property generally described as being bounded on the north by Calvert Street, on the east by Kendall, on the south by Ewing and the west by the first north- south alley east of Chapin Street between Donald and Calvert and Catalpa between Donald and Ewing and the west side of Kemble between Donald and Ewing was legally advertised under date of March 25, 1963 and given public hearing on April 4, 1963. The following action was taken: After due consideration the Commission found that the best zoning for the subject property would be "A'' Residential. REPORT OF CITY PLANNING COMMISSION April 8, 1963 The Honorable Common Council City of South Bend' South Bend, Indiana Gentlemen: The attached proposed ordinance originated by the City Planning Commission to amend Section "17 -A" of Ordinance No. 3702, commonly known as the Zoning Ordinance of the City of South Bend, Indiana, was legally advertised under date of March 25, 1963 and given public hearing on April 4, 1963. The following action was taken: After due consideration it was duly moved, seconded, and unanimously carried that this ordinance be recommended favorably to the Council. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Land bounded by Bendix Drive, Ryer, Lincolnway West and Ardmore Trail) The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that Ordinance be set for public hearing on May 13, 1963. Councilman Lehman seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (The northeast and southwest corners of Bryan and Sherman) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set. for public hearing on May 13, 1963. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Land bounded on the north by Lincolnway West and fronting Brentwood Court) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on May 13, 1963. Councilman Allen seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Land bounded by Calvert,Kdndall, Ewing and Kemble) The Ordinance was given first reading by title and second reading in full. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF SOUTHBEND, INDIANA, AS AMENDED The Ordinance was given first reading by title and second reading in full. Councilman Glass seconded the motion. Motion carried. ORDINANCE NO. 4570 - - -63 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND NEWMAN & ALTMAN, INC., FOR THE PURCHASE OF TWO (2) 1963 STUDEBAKER ONE- '_1iALF -TON RATED TRUCKS WITH UTILITY BODY, STAHL NO. 75 OR EQUIVALENT FOR THE TOTAL PRICE OF $3,115.00 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 9 ayes and 0 nays. The Ordinance was given third reading and passed by a roll call vote of 9 ayes and 0 nays. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE STREET A14D TRAFFIC FUND, IN THE SUM OF $16,400.00 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on May 13, 1963. Councilman Glass seconded the motion. Motion carried. RESOLUTION NO. 32 - - -63 A RESOLUTION APPROVING A SITE BOUNDED ON THE NORTH BY WESTERN AVENUE, ON THE EAST BY SCOTT STREET, ON THE SOUTH BY THE FIRST EAST -WEST PUBLIC ALLEY NORTH OF MONROE STREET, AND ON THE WEST BY CHAPIN STREET IN THE CITY OF SOUTH BEND, INDIANA, FOR THE CONSTRUCTION OF A LOW RENT HOUSING PROJECT CONSISTING OF APPROXIMATELY TWENTY (20) UNITS, BY THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND, INDIANA. WHEREAS, the City of South Bend, Indiana, has heretofore entered into a Cooperation Agreement with The Housing Authority of the City of South Bend, Indiana; WHEREAS, pursuant to the provisions of said Cooperation Agreement, The .Housing Authority of South Bend, Indiana, has requested the City of South Bend, Indiana, to approve a site comprising approximately 2.40 acres of land located in the City of South BEnd, St. Joseph County, Indiana, and described as follows, to -wit: A parcel of land in the City of South BEnd, St. Joseph County, Indiana, bounded on the North by Western Avenue, on the East by Scott Street, on the South by the first East -West public alley North of Monroe.Street, and on the West by Chapin Street, for the purpose of constructing thereon a low -rent housing project consisting of approximately Twenty (20) units; REGULAR MEETING RESOLUTION NO. 32 - - -63 (continued) APRIL 3, 1963 553 WHEREAS, the Housing Committee of the Common Council of the City of South Bend, Indiana, has inspected said site and has determined that it would be a desirable location for the construction of a low -rent housing project; NOW, THEREFORE, BE IT RESOLVED, BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, that a site consisting of a parcel of land in the City of South Bend, Indiana, hereinabove described, be and the same is hereby approved as a desirable site for a low -rent housing project consisting of approximately Twenty (20) units to be constructed by The Housing Authority of the City of South Bend, Indiana. This Resolution shall be in full force and effect from and after its passage. Passed by the Common Council this 8 day of April, 1963. /s/ Joseph T. Motion carried by a roll call vote of 7 ayes (Councilmen Kroll, Allen, Ladewski, Tellson, Krueper, Lehman and Muszynski), 2 nays (Councilmen Coleman and Glass). NEW BUSINESS Councilman Lehman made a motion that the Regular Meeting of the Common Council which would occur on April 22, 1963, be cancelled. Councilman Ladewski seconded the motion. Motion carried. There bding no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Muszynski seconded the motion.
