COMMITTEE OF THE WHOLE MEETING MARCH 25, 1963
Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in
the Council Chambers in the City Hall on Monday, March 25, 1963, at 8:10 P.M., with all members present. The meeti
was called to order by Councilman T. W. Lehman, Chairman, who presided.
ORDINANCE
AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702
(Land between Lincolnway West and Crumstown Avenue)
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an
opportunity to be heard thereon. Councilman Kroll made a motion that the Ordinance go to the Council as favorable.
Councilman Ladewski seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS AMENDED
(Land along the West side of Arnold Street)
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an
opportunity to be heard thereon. Councilman Muszynski made a motion that the Ordinance go to the Council as favorab]
Councilman Kroll seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702
(Land on Sheridan between Lincolnway West and Crumstown Avenue)

opportunity to be heard thereon. Councilman Kroll made a motion that the Ordinance go to the Council as favorable.
Councilman Ladewski seconded the motion. Motion carried.

AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED,
(Relative to procedure of amendments)
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given j
an opportunity to be heard thereon. Councilman Ladewski -made a.motion that the Ordinance go to'-the Couhcil as favor -!
able, Councilman Kroll seconded the motion. After discussion Councilman Ladewski withdrew his motion. Councilman
Kroll withdrew his second to the motion. Councilman Kroll made a motion that the Ordinance be referred to the
Ordinance committee for study and a report back to the Council in two weeks. Councilman Ladewski seconded the
motion. Motion carried.
ORDINANCE'
AN ORDINANCE FIXING THE ANNUAL SALARIES PAYABLE FROM THE GENERAL FUND, FOR
OFFICERS OF THE CITY OF SOUTH BEND, TO BE ELECTED FOR THE TERM COMMENCING
JANUARY 1, 1964, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT
The Clerk read the following communications:

March 22, 1963
This Association wishes to point out that the new salary ordinance of the city of South Bend failed to meet the
statutory requirements, as set forth in Chapter 107 of the Acts of 1959, Section 6, Burns 48 -1233, pages 224 and 2259
In our opinion corrective <iCetp'sy are required in order that elected city officials may draw their salaries during
their tenure in office beginning January 1, 1964. Should this serious error on the part of the city administration
go uncorrected, salary payments to these elected officials could be challenged by legal action initiated by any
citizen. It is, we believe, the duty of the administration to avoid such a hazard by immediate action.
We wish to see the action of the City Council fully and legally in effect. Salary increases reflected in the salary
ordinance have been long delayed with respect to the officials involved, and we believe the stature of these
particular positions merits recognition through more adequate compensation. Your prompt action appears imperative
to prevent future embarrassment and even serious financial hardship for the elected city officials who will take,
office January 1, 1964.

Dear Mrs. Noble
The salaries of the Mayor, City Clerk, City Judge and Councilmen were discussed at the Board of Directors Meeting
of the Chamber of Commerce of South Bend - Mishawaka, Friday, March 22nd. It was noted that these salaries are
presently below those of other Indiana cities of our size.
It was the unanimous recommendation of our Directors that:

1. The salaries of these elected officials be established at a comparable level with other Indiana cities of similar
size.
2. A non - partisan study commission be appointed to engage in a long range study of the salaries of all elected
officials in our community.

Speaking in favor of the above Ordinance were the following: Richard A. Kirkman, 1118 Queen Street; Ronald Ormsby,
611 North Cushing Street; Miss Virginia Guthrie, South Bend Civic Planning Association: Speaking against the
proposed Ordinance were the following: John Wise, 1126 Victory Avenue; Howard Goodhew, 1709 Kessler Boulevard;
Bert Handwork, 1438'East Madison; Mrs. Leroy Allen, 125 West Marion,-Street; Joseph Kolecki, 2220 Kemble Street;
Rpbert Mahowald, McKinley Avenue; Michael Nyikos, 114 Marquette, Robert Meiszberg, 1774 Prairie Avenue and Council
Glass. Councilmen Krueper, Kroll and Tellson spoke in favor of the Ordinanc
Councilman Kroll moved for a five minute recess. Councilman Glass seconded the motion. Motion carried and the
Committee of the Whole Meeting recessed at 9:03 P.M. The Meeting reconvened at 9:18 P.M.
Councilman made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the
motion. Motion carried.
There being no further business to come before the Committee of the Whole, Councilman Muszynski made a motion to
adjourn. Councilman Kroll seconded the motion. Motion carried and the Committee of the Whole Meeting adjourned at
9 :19 P.M. -
