The Meeting was called to order by President Joseph T. Kroll, who presided. CALL REP PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper and Lehman. ABSENT: Councilman.Muszynski To the Comm Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes of the previous meeting of the Council approved. South Bend, Ind, February 11th, 1963 the minutes, would respectfully report that they have inspected and found them correct. They therefore recommend that the same be /s/ Joseph T. Kroll /s/ T. W. COMMUNICATION A communication from the Housing Authority of the City of South Bend, Indiana, by Jesse L. Dickinson, Director, was read by the Clerk. It was a progress report on the three sites. Councilman Lehman made a motion that the communica- tion be accepted and placed on dile. Councilman Allen seconded the motion. Motion carried. Councilman Allen seconded the motion. Motion carried. ANNUAL REPORT OF PARK COMMISSIONERS All of the Councilmen have a copy of the Report. Councilman Coleman moved that the report be accepted and placed on file. Councilman Krueper seconded the motion. Motion carried. REPORT OF COMMITTEE ON ORDINANCES To the Common Council of the City of South Bend: Your Committee on Otdinancep to whom was referred AN ORDINANCE TO AMEND SECTIONS 8, 13 and 25 OF CHAPTER 30 OF THE GENERAL ORDINANCE NO. 3709, SAID CHAPTER 30 REFERRING TO TREES AND SHRUBS, Respectfully report that they have examined the matter and that in their opinion it should be reported favorably and set for public hearing in the Committee of the Whole. /s/ J. ORDINANCE NO. 4557 - - -63 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Land on Lathrop east of Huey) The Ordinance was given third reading and passed by a roll call vote of 8 ayes and 0 nays, 1 absent (Councilman Muszynski). ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Four corners of Hamilton and Olive Streets) The Ordinance was given third reading and lost by a roll call -vote of 0 ayes and 8 nays, 1 absent (Councilman Muszynski). ORDINANCE NO. 4558 - - -63 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Woodland, Elwood, Ardmore Trail and Sheridan) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Muszynski). ORDINANCE NO. 4559 - - -63 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (East side of Olive between Lathrop and Pershing) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays 1 absent (Councilman Muszynski). ORDINANCE AN ORDINANCE TO AMEND "THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA ", ALSO KNOWN AS ORDINANCE NO. 3702, BY THE ADDITION OF EXTRA REQUIREMENTS IN REGARD TO THE USE OF LAND FOR THE MAINTENANCE OF USE AND OPERATION OF STREET SURFACE, OPEN LOT AUTOMOBILE WASHING OPERATIONS, The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for publid hearing on March 11, 1963. Councilman Coleman seconded the motion. Motion carried. PP__ 536 REGULAR MEETING ORDINANCE AN ORDINANCE AUTHORIZING THE DONATION OF LAND TO AID IN THE ERECTING OF AN ARMORY IN THE CITY OF SOUTH BEND FEBRUARY 25, 1963 The Ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for suspension of rules. Councilman Lehman seconded the motion. Upon discussion, Councilman Tellson withdrew his motion and Councilman Lehman withdrew his second to the motion. Councilman Coleman made a motion that the Ordinance be set for public hearing on March 11, 1963. Councilman Lehman seconded the motion. Motion carried. RESOLUTION NO. 29 - - -63 WHEREAS, Albert E. Tellson, who has been a venerable member of the Common Council of the City of South Bend for a great many years, and his wife Gladys Tellson, celebrated their Fiftieth wedding anniversary February 17, 1964, and WHEREAS, all of the members of the administration of the City of South Bend, including members of the Com Council, are indebted to and deeply grateful for the civic services performed by Mr. Tellson for the Community, and WHEREAS, it is our desire to congratulate Mr. and Mrs. Tellson on their fiftieth wedding anniversary and to express our appreciation and gratitude for the many years of civic service performed by Mr. Tellson for the community IT IS, THEREFORE, RESOLVED: That Mr. and Mrs. Albert.E. Tellson be and they are hereby congratulated on their fiftieth wedding anniversary and that we hereby express our appreciation and gratitude for the many years of civic service performed by Mr. Tellson for the community. IT IS FURTHER RESOLVED: That from and after the passage, enrollment, attestation and signature by the Clerk and presiding officer and approval by the Mayor,:: this resolution shall become effective. /s/ Joseph T. Councilman Allen seconded the motion. Motion carried upon a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Muszynski). OLD BUSINESS Councilman Tellson brought up the matter,of parking meters in front of the Public Library. After discussion, Counc Krueper made a motion that this matter be referred to the Traffic Committee of the Council who should meet with the Traffic Engineer and the Chief of Police. Councilman Allen seconded the motion. Motion carried. President Kroll stated that Councilman Muszynski, who was unable to be present at the meeting, requested that the Council take some action relative to the coal dust problem at Harris and Huron Streets. The residents have taken the matter up with the Prosecuting Attorney. Mr. William Hosinski, Assistant City Attorney, stated that there is a State Statute which would cover this problem and action should be taken through the State. NEW BUSINESS President Kroll stated that he felt the Board of Works or Police .Chief should rescind the order relative to with- drawing Police'Escorts from funerals. Discussion followed. Councilman Coleman moved that the matter be taken up with the traffic committee who should meet with the Board of Works, the Chief of Police as well as representatives of the Funeral Directors in order to come to a decision as to whether the off -duty police would serve as escorts and be paid by the Funeral Directors. Councilman Lehman seconded the motion. Motion carried. Councilman Glass stated that the spring clean -up of the river should be considered and perhaps a committee be appointed by the Mayor to spur this clean -up program on and have it completed early in the year. The President stated that the Public Improvements Committee would work on this clean -up program. In line with this suggestion, Mr. Kroll presented a resolution which was adopted by the Michiana Watershed Inc., relative to river clean -up. Councilman Allen moved that the resolution be referred to the Public Improvements Committee for consideration. Councilman Lehman seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Coleman seconded the motion.
