HomeMy WebLinkAbout02-11-63 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, February 11, 1963, at 8:25 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they haveinspeeted the minutes of the previous meeting of the Council and found them correct. ORDINANCE NO. 4554 - - -63 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SANITATION FUND - $1,077.55 The Ordinance was given third reading and passed by a roll call vote of 9 ayes and 0 nays. REPORT OF CITY PLANNING COMMISSION February 8, 1963 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen; The attached petition of the City Planning Commission to rezone from "C" Commercial Use and "D" Height and Area District to 11A" Residential Use District and "A" Height and Area District the property being generally described as the east side of Olive Street between Lathrop Street and Pershing Street was legally advertised under date of January 28, 1963 and given public hearing on February 7, 1963. The following action was taken: After due consideration the Commission found that the best zoning for subject property would be REPORT OF CITY PLANNING COMMISSION (continued) residential. REPORT OF CITY PLANNING COMMISSION February 8, 1963 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "C" Commercial Use and "D" Height and Area District to "A" Residential Use District and "A" Height and Area District the property generally described as the intersection of Hamilton and Olive Streets was legally advertised under date of January 28, 1963 and given public hearing on February 7, 1963. The following action was taken: After due consideration the Board found that the best zoning for subject property would be residential. REPORT OF CITY PLANNING COMMISSION February 8, 1963 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "B" Residential Use District and "A' Height and Area District the property generally described as being bounded on the west by Woodland Ave., on the north by Elwood Avenue, on the south by Ardmore Trail and on the east by Sheridan Avenue, plus Lots 32 -39 inclusive and lot 141 which are bounded on the west by Sheridan Avenue was legally advertised under date of January 28, 1963 and given public hearing on February 7, 1963. The following action was taken: After due consideration the Commission found that the best zoning for the subject property would be "A" Residential. Residential Use District and "A' Height and Area District the property generally described as Lot 73 and part of Lot 26 in Jacksons Proposed Sub. having 498.25 feet frontage on Lathrop Street and 125.6 feet frontage on Huey Street was legally advertised under date of January 28, 1963. Councilman Glass made a motion that the Ordinance be set for public hearing on February 25, 1963. Councilman Lehman seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Woodland, Elwood, Ardmore Trail and Sheridan) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on February 25, 1963. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Four Corners of Hamilton and Olive Streets) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on February 25, 1963. Councilman Allen seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (East side of Olive Street between Lathrop and Pershing) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on February 25, 1963. Councilman Allen seconded the motion. Motion carried. ORDINANCE NO. 4555 - - -63 AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF THE GRANT OFFER OF THE UNITED STATES OF AMERICA BY THE MUNICIPAL CITY OF SOUTH BEND The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for sus- pension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes and 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes and 0 nays. ORDINANCE NO. 4556 - - -63 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA AUTHORIZING THE MAKING OF A TEMPORARY IRAN FOR THE GENERAL FUND AND THE ISSUANCE AND SALE OF WARRANTS OF THE CITY FOR SUCH PURPOSE. The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for sus- pension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes and 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes and 0 nays. RESOLUTION NO. 28 - - -63 RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE CITY PLANNING COMMISSION FUND - $50.00 AND THE TRANSFER OF SAME FROM ONE ACCOUNT TO ANOTHER IN THE SAME CATEGORY OF THE CITY PLANNING COMMISSION WHEREAS, certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it is now necessary to appropriate more money than was appropriated in the annual budget for the various funct of City. Government to meet such extraordinary emergencies; and WHEREAS, Account No. 252, .described as Repairs to Equipment, Was not included under the City Planning Commission budget and the sum of Fifty ($50.00) Dollars is needed forthwith; and WHEREAS, Under Account No. 241, described as Printings, Other than Office Supplies, under the City Planning Commission Fund, there is Fifty ($50.00) Dollars that will not be needed at this time, NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, that the sum of Fifty ($50.00) Dollars be transferred from Account No. 241, described as Printing, Other than Office Supplies under the City Planning Commission Fund, to Account No. 252, described as Repairs to Equipment, under the City Planning Commission Fund. /s/ Chester Muszynski Member of the Common Council The Resolution was adopted upon a roll call vote of 9 ayes and 0 nays. OLD BUSINESS REPORT Mr. President February 11, 1963 The undersigned as Chairman of the special committee appointed by the President at the last regular meeting of the Council held January 28, 1963, begs leave to make the following report: The Chairman of this special committee, with Councilmen Chester Muszynski and Joseph T. Kroll, conferred with Senator Donald Yeagley regarding the introduction of legislation to authorize the conducting of a referendum at an election period to ascertain the opinion of the public with reference to the question of time to be followed in the City of South Bend, viz: EST; or a combination of the two times. Senator Yeagley having been advised of our coming had a preliminary draft of a bill ready for our examination which authorized the County Council to submit the questio to the electorate at a regular county -wide election, it being his feeling that all the people of the county should have opportunity to express their opinion on the question. The Senator also informed the committee that there were some legal questions which had been raised by Judge Smith, counsel for the Senate, and that these legal aspects were to be checked before introduction of the bill. This conference was had on Thursday February 7th. We again conferred with Senator'Yeagley on Friday February 8th, 1963 at which time he assured your committee that upon approval of.the form by Judge Smith the bill would be introduced for passage by the Senate not later than February 11, 1963. NEW BUSINESS President Kroll announced the reappointment of all committees of the Council and advised to Committee on Fees and Salaries that the Salary Ordinance must be passed by April L, 1963. Councilman Ladewski moved that the Clerk be directed to send a congratulatory message to Councilman and firs. Albert Tellson upon the occasion of their Fiftieth Wedding Anniversary and to prepare a Resolution for adoption by the Council relative to this occasion. Councilman Allen seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Muszynski made a motion to adjourn. Council- man Coleman seconded the motion.
