HomeMy WebLinkAbout07-23-62 Council Meeting Minutes460 REGULAR MEETING JULY 23, 1962 Be it remepbered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, July 23, 1962, at 9:10 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Lehman made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATION A communication from the Citizen's Better Housing League inviting the members of the Council to a tour of Negro Homes on Sunday, July 29, 1962, from 2 :30 P.M. - 5:00 P.M., was read by the Clerk. Councilman Muszynski made a motion that the communication by accepted and placed on file. Councilman Lehman seconde< the motion. Motion carded. PETITIONS Petition to annex 10.2 acres of land at the Southwest corner of Helper and Hickory. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. 'Councilman Muszynski seconded the motion. Motion carried. Petition to annex 5.6 acres of land on Ironwood and South Bend Avenue (Greenwoods). Councilman Allen made a motion that the petition be referred to the City Planning Commission, Councilman Muszynski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N06 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Cherry Street South of Washington), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bead: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Both sides of Birdsell Street between Washington and Linden and the South side of Linden between Birdsall and Walnut), AS AMENDED, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE, AS AHMED.. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO., 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Both sides of Walnut Street between Washington and Napier), AS AMENDED, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE AS AMENDED. Motion carried, REPORT OF THE COMMITTEE OF THE WHOLE To-the Common Council of the City of South -Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Edison and Hickory), Respectfully report that they have examined the matter and that,in their opinion IT SHOULD BE REPORTED FAVORABLE. July 23, 1962. /s/ T. W. Lehman, Chairman Councilman Lehman made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE NO. 4480 - - -62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED, AS AHMED (Cherry Street South of Washington) Councilman Krueper made a motion to amend the Ordinance to read "A" Residential Use and "A" Height and Area District, Councilman Lehman seconded the motion. Motion carried. The Ordinance was then given third reading, as amended, and passed by a roll call vote of 8 ayes, l nay (Councilman Allen). ORDINANCE NO. 4481 - - -62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED, AS AMENDED (Birdsall Street) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 1 nay (Councilman Allen). ORDINANCE NO. 4482 - - -62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO_. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED, AS AMENDED (Walnut Street) The Ordinance was.given third reading and passed by a roll call vote of 8 ayes, 1 nay (Councilman Allen). ORDINANCE NO. 4483 - - -62 AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14th day of JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Lincolaway, Allen and Lindsey) The Ordinance was given third reading and passed by a roll call vote of 7 ayes, 2 nays (Councilmen Coleman and Krueper). ORDINANCE NO. 4484 - - -62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Chippewa and Gertrude Street) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4485 - - -62 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND INDIANA, CERTAIN LANDS (52.6 acres at Edison and Hickory) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays. 462 REGULAR MEETING ORDINANCE JULY 23, 1962 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (2800 Block South Michigan Street) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made.,a motion that Ordinance be set for public hearing on August 13, 1962. Councilman Glass seconded the notion. Motion carried. ORDINANCE N0. 4486 - - -62 AN ORDINANCE TO APPROVE GRANT OF REAL ESTATE EXECUTED BY THE BOARD OF PUBLIC WORKS The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of Rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9•ayes, 0 naps. The Ordinance was then given. third reading and passed by a roll call vote of 9 ayes. 0 nays. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE INDIANA EQUIPMENT COMPANY, INC., FOR THE PURCHASE OF A HOUGH MODEL H50B, 4 -WHEEL DRIVE PAYLOADER. FOR THE SUM OF $129599.00 The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion for sus - pension of rules. Councilman Lehman seconded the motion. Motion lost. Councilman Lehman made a motion that the Ordinance be set for public hearing on August 13, 1962. Councilman Muszynski seconded the motion. Motion carried, NEW BUSINESS. Councilman Krueper made a motion that the Council hold a Special Meeting on July 30, 1962, at 8:00 P.M., for the purpose of considering An Ordinance Appropriating Moneies for the 1963 Civil City Budget and An Ordinance Fixing The Tax Levy for the year 1963 for the Civil City of South Bend, Indiana. Councilman Lehman seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Muszynski made a motion to adjourn. Council- man Lehman seconded the motion. Motion carried and the regular meeting of the Common Council adjourned at 9:41 P..M.
