The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Telison, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMhIITTEE ON MINUTES To the Common Council of the City of-South Bend: Your Committee on the inspection and supervision -of the mtautes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION The Clerk read a communication from the American Municipal Association extending an invitation to the members of the Council to attend the 39th Annual Municipal Congress to be held in Philadelphia, Pennsylvania at the Sheridan Hotel on August 25 - 29, 1962. Councilman Lehman made a motion that the Communication be accepted and placed on file. Councilman Muszynski secondei the motion. Motion carried. Motion carried.- REPORT OF BOARD OF PUBLIC WORKS AND SAFETY To the Members of the n- Council City of South Bend, Indiana Gentlemen: RE: Councilman Muezvnski's complaint - Truck Traffic July 9, 1962 Attached are copies of a Report from Inspector Cornelius Nicholas to the Board of Public Works and Safety and a lett from the Northern Indiana Motor Carriers Association, Inc., with reference to the complaint concerning truck traffic and violations through Swygart Street and Indiana Avenue between Prairie and Walnut. REPORT OF BUILDING DEPARTMENT The Honorable Common Council Civil City of South Bend South Bend, Indiana Gentlemen: July 9, 1962 At the June 25th Regular Meeting of the Council a request was made that I investigate a report that an industrial coal yard was being built between Harris and Kosciuszko Streets South of Huron Street in the City of South Bead. Our investigation revealed that there has been a coal yard located in the approximate area (1512 Western Avenue) for a very long period of time. Ww also learned that the property in question is zoned "E" Heavy Industrial which would permit construction of the coal yard. However, our investigation failed to show that the existing coal yard has been extended or is intended to be extern, beyond the present and existing facilities. REPORT OF BUILDING DEPARTMENT (continued) Therefore, it is our conclusion that nothing has been done at the above foresaid location in violation of any existing laws and ordinances, and it is very unlikely that there is any intent to extend.the legal use of the prop However, you may be assured that this department will keep the subject property under surveilance and will assure any improvement will comply with all existing laws and ordinances. ORDINANCE NOT 4478 - - -62 AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1963 The Ordinance was given third reading and passed'by a roll call vote of 7 ayes (Councilmen Kroll, Allen, Ladeuski, Telison, Krueper, Lehman and Muszynski), 2 nays (Councilmen Coleman and Glass). REPORT OF CITY PLANNING COMMISSION July 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend, Indiana, 1.4 acres, more or less, in the Southwest One Quarter of Section 32, T38N, R3E, being generally described as bounded on the north by Rose Street and on the west, south, and east by the present city limits which boundaries are also the boundaries of Edison Park 4th Addition and Eastgate Estates Addition was legally advertised under date of June 25, 1962 and given public heari on July 5, 1962. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. CITY PLANNING COMMISSION July 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Maude H. Haberle and Blanche Turner to rezone from "B" Residential Use and "B" Height and Area District to "C" Commercial Use and "B" Height and Area District Lots, Numbered 5 and 6 in A. H. Cushing's Addi- tion, more generally described as the half block bounded on the south by Lincolaway West,:on the east by Allen Street, on the north by Lindsay Street, and on the west by a public alley was legally advertised under date of June. 5, 1962 and given public hearing on July 5, 1962. The following action was taken: After due consideration the Commission found "_that'the proposed zoning would result in an unwarranted intrusion of commercial zoning into a predominantly residential area; that the granting of the petition would constitute spot zoning; and that ample commercial zoning not used for commercial purposes presently exists in the Immediate vicinity. REPORT OF CITY PLANNING COMtIISSION July 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to zone "E" Heavy Industrial Use and "A" Height and Area District the recently annexed land being generally described as bounded on the west by Linden Road; on the south by Chippewa Avenue; on the east by the north -south centerline of Section 23, T37N, R2E, and on the north by the south property line of Rum Village Park was legally advertised under date of June 25, 1962, and given public hearing on July 5, 1962. The following actica was taken: After due consideration the Commission found that the best use for the area in question would be industrial. REPORT OF CITY PLANNING COMMISSION July 9, 1962 The Honorable Common Council City of South Bend South Bond, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend, Indiana 52.6 acres, more or less, in the Southeast One Quarter of Section 32, T38N, R3E, being generally described as bounded on the south by Edison Road, on the east by Edison Road Addition and Logan Street (Hickory Road), and on the north and west by the present city limits was legally advertised under date of June 25, 1962 and given public hearing on July 5, 1962. The follow- ing action was taken: After due consideration the Commission found that the six determinants of annexation exist. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO 3702, ADOPTED BY.THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14th DAY OF JUNE, 1949, COMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Land on Lincolaway, Allen and Lindsey) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public Hearing on July 23, 1962. Councilman Muszynski seconded the notion. Motion carried. Councilman Lehman made a motion that the Ordinance be set for Public Rearing on August 13, 1962. Councilman Muszynski seconded the mention. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE REDEVELOPMENT DISTRICT CAPITAL FUND - $195,789.76 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on August 13, 1962. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE NO. 4479 - - -6a AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Land on Ironwood north of Edison) This Ordinance was rejected by the Council on May 28, 1962, and returned to the City Planning Commission. President Kroll called a five minute recess. The Council recessed at 10 :17 P.M. The Council reconvened at 10:19 P.M. The Clerk then gave the Ordinance third reading and it was passed by a roll call vote of 7 ayes (Councilman Kroll,' Allen, Ladewski, Tellson, Glass, Lehman and Muszynski), 2 nays (Councilmen Coleman and Krueper). There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Muszynski seconded the motion. Motion carried and the Regular Meeting of the Comecon Council adjourned at 10 :24 P.M.
