REGULAR MEETING
MAY 28, 1962
Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council
Chambers in the City Hall on Monday, May 28, 1962, at 8 :34 P.M., with all members present. The meeting was called to
order by President Joseph T. Kroll, who presided.
ROLL CALL
PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, and Lehman
ABSENT: Councilman Muszynski
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected
tje minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same
be approved.

Councilman Lehman made a motion that the report be accepted and placed on file. Councilman Tellson seconded the
motion. Motion carried.
COMMUNICATION
Communication from Walter Ladewski thanking the Council for the floral spray sent at the time of the death of Mrs.
Martha Ladewski.
Councilman Lehman made a motion that the communication be accepted and placed on file. Councilman Tellson seconded
the motion. Motion carried.
Councilman Ladewski also expressed his appreciation for the sympathy extended by the Council.
PETITION
Petition to annex 1.4 acres on land on Rose Street.
Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Allen
seconded the motion. Motion carried.

examined the matter and that in their opinion IT SHOULD BE RETURNED TO THE CITY PLANNING COMMISSION WITH THE
RECOMMENDATION OF C -1 Zoning.

SOUTH BEND, INDIANA, CERTAIN LANDS (93.8 acres south of the Toll Road between Portage and Maple Road), Respectfully
report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE.

ORDINANCE, FIRST AND SECOND READING
AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SANITATION
FUND $15,767.55
The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that
the Ordinance be set for public hearing on June 25, 1962. Councilman Tellson seconded the motion. Motion carried.
RESOLUTION NO. 9
RESOLUTION TO TRANSFER $140,000.00 FROM THE GENERAL FUND OF
THE CIVIL CITY OF SOUTH BEND TO THE GENERAL SINKING FUND OF
THE CIVIL CITY OF SOUTH BEND
WHEREAS; by-authority of Chapter 71 of the Acts of 1961, of the General Assembly of the State of Indiana, also found
in Burns Indiana Statutes 61 -1207 and 61 -1208, the Common Council of the City of South Bend has the authority
to transfer monies from one fund having a sufficient balance to another fund which is depleted; and
WHEREAS, the General Fund of the Civil City of South Bend has a sufficient balance and the General Sinking Fund of
the Civil City of South Bend is depleted; and
WHEREAS, monies have not been delivered by the St. Joseph County Treasuruer and the St. Joseph County Auditor to the
Civil City of South Bend, from the 1961 taxes payable in 1962; and
WHEREAS, sufficient monies will be available from the St. Joseph County Treasurer and Auditor to pay to the City
monies due and owing to and by virtue of taxes to be derived from personal and real property; and
WHEREAS, said monies are anticipated to be received on or before the 15th day of June, 1962,
NOW, THEREFORE, BE IT RESOLVED, that the Controller of the City of South Bend, be authorized to temporarily trans-
fer the sum of $140,000.00 out of the General Fund of the Civil City of South Bend, to the General Sinking Fund of
the Civil City of South Bend, and that said repayment from the General Sinking Fund to the General Fund be effected
or before the 15th day of June, 1962, and
BE IT FURTHER RESOLVED, that the Controller issue a warrant and receipt for the amount of said transfer, and that
said warrant shall be endorsed and deposited in the depository account designated for said General Sinking Fund, and
BE IT FURTHER RESOLVED, that no appropriation shall be required for the said transfer, and said repayment, and that
no interest shall be charged on said temporary transfer.

Councilman Coleman made a motion for adoption of the Resolution. Councilman Lehman seconded the motion. Motion
carried by a roll call vote of 8ayes, 0 nays, l absent (Councilman Muszynski).
There being no further business to come before the Regular Meeting of the Council, Councilman Coleman made a motion
to adjourn. Councilman Lehman seconded the motion. Motion carried and the Regular Meeting of the Common Council
adjourned at 8 :55 P.M.
