The meeting was called to order by President Joseph T. Kroll, who presided. ROIL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Coleman made a motion, seconded by Councilman Lehman, that the report be accepted and placed on file. Motion carried. PETITION Petition of Virgil A. Place and others to annex 93.8 acres of land for the proposed Northridge Subdivision. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Coleman seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE STREET AND T FUND, $50,000.00, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE POSTPONED FOR TWO WEEKS. /s/ T. REPORT OF THE CITY PLANNING COMMISSION April 9, 1962 The Honorable Common Council City of South Bend, South Bend, Indiana Gentlemen :. The attached petition of the Common Council to annex to the City of South Bend, Indiana, a parcel of land bounded on the north, south and east by the present city limits and on the west by Lilac Road and being 613 feet south of Darden Road, said parcel containing 1.4 acres, more or less, was legally advertised under date of March 26, 1962 and given public hearing on April 5, 1962. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. REPORT OF THE CITY PLANNING COMMISSION April 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend, Indiana a triangular shaped parcel of land generally described as being bounded on the east by the east right -of -way line of the Pennsylvania Railroad, on the norty by the present city limits which is 200 feet south of Chippewa Avenue, and on the west by a line extend north from the intersection of the east right -of -way line of the Pennsylvania Railroad and the north right -of -way li of Ireland Road, said parcel containing 38.9 acres, more or less, was legally advertised under date of March 26, 196 and given public hearing on April 5, 1962. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. REPORT OF CITY PLANNING COMMISSION April 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend, Indiana a parcel of land bounded on the west by Linden Road, on the south by Chippewa Avenue and on the east and north by the present City limits, said parcel containing 213 acres, more or less, was legally advertised under date of March 26, 1962 and given public hearing on April 5, 1962. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. The following action was taken After due consideration the Commission found that the six determinants of annexation 'exist. April 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana The attached petition of the South Bend Sand and Gravel Corporation to zone "E" Heavy Industrial Use and "G" Height and Area District the recently annexed land being generally described as bounded on the west by Maple Road, on the north by Douglas Road (also known as Lathrop Avenue), and on the east and south by the present city limits contain- ing approximately 1•.00 acres was legally advertised under date of March 26, 1962, and given public hearing on April 5, 1962. The following action was taken: After due consideration the Commission found that this is the most logical zoning for said area and that substantial justice would be done by the granting of the petition. REPORT OF CITY PLANNING COMMISSION April 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend, Indiana a parcel of land generally described as being bounded on the east by Ironwood Road and on the south, west and north by the present city limits and lying 837 feet north of Inwood Road, said parcel containing 13.2 acres, more or less, was legally advertised under date of March 27, 1962 and given,public hearing on April 5, 196,2. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. REPORT OF CITY PLANNING COMMISSION April 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition originated by the City Planning Commission to zone "A" Residential Use and 1,'A" Height and Area District the recently annexed land being more generally described as containing 9.99 acres, more or less, in the Northwest One Quarter of Section 27, T38N, R2E, and more commonly known as the South Bend Police Pistol Range, was legally advertised under date of March 26,1962 and given public hearing on April 5, 1962. REPORT OF CITY PLANNING COMMISSION April 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached proposed ordinance originated by the City Planning Commission to zone "A" Residential Use and "A" Height and Area District the recently annexed_ land being generally described as fronting on Edison Road `726 feet east of Ironwood Road and bounded on the east and west by the present city limits containing 2 acres, more or less, was legally advertised under date of March 26, 1962, and given public hearing on April 5, 1962. The following action was taken: After due consideration the Commission found that this is the most logical zoning for said area and that substantial justice would be done by the granting of the proposed ordinance. REPORT OF CITY PLANNING COMMISSION April 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached proposed ordinance originated by the City Planning Commission to zone the recently annexed land being more generally described as being a parcel of land 620 feet north and south by 290 feet east and west at the north- west corner of Edison and Ironwood Roads "C" Commercial Use and "A" Height and Area District was legally advertised under date of February 19, 1962 and given public hearing on March 1, 1962. The following action was taken: After due consideration the Commission found that there is an apparent need for additional commercial zoning in the general area, and that the best use of subject land would be commercial. Councilman Lehman made a motion that the Ordinance be set for public hearing on May 14, 1962. Councilman Coleman seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (38.9 acres along the Pennsylvania Railroad Tracks) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on May 14, 1962. Councilman Coleman seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (.6 acres of land in Wilmette Park) The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the Ordinance be set for public hearing on May 14, 1962. 'Councilman Allen seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (213 acres - Gertrude Street south of Rum Village Woods) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance by set for public hearing on May 14, 1962. Councilman Coleman seconded the motion. Motion carried. Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the Ordinance be set for public hearing on May 14, 1962. Councilman Lehman seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Jackson Road west of Ironwood Road) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on May 14, 1962. Councilman Allen seconded the motion. Motion carried. ORDINANCE NO. 4451 - - -62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Zone recently annexed land on Maple Road) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for suspension of rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9 ayes and 0 nays. The Ordinance was then given third - reading and passed by a roll call vote of 9 ayes and 0 nays. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (13.2 acres of land on_ Ironwood North of Ireland) The Ordinance was given first reading by.:title and second reading in full. Motion carried. 424 REGULAR MEETING OLD BUSINESS APRIL 9, 1962 Councilman Muszynski requested the City Attorney to investigate and report on the status of the injunction against the use of the property at 2202 West Dunham Street as a junk yard. There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Coleman seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 9:43 P.M.
