HomeMy WebLinkAbout03-26-62 Council Meeting Minutes_____________________________ ____ ___ ___ ___ ________ _________ MARCH 26, 1962 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, March 26, 1962, at 8 :12 P.M., with all members present except Councilman Lehman. The Meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper and Muszynski. ABSENT: Councilman Lehman REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Motion carried. 412 REGULAR MEETING COMMUNICATION The City Clerk City Hall South Bend, Indiana. USA Dear S ir: MARCH 26, 1962 THE RETAIL MERCHANTS' ASSOCIATION OF CANADA, INC. March 13, 1962 I would like you to convey to your City Aldermen or Councillors the Congratulations of the Retailers of Manitoba on their passing of local ordinance, licensing T. V. Technicians and antenna installers as reported by the Electronics World, March issue. Ii We, in Manitoba, are attempting to secure such a law for the Province. Would you be kind enough to send us 6 copies so we can see where we may be wrong in what we are asking our local Govermmnent for and /or add any improvements your great city has enacted in your By -law. We believe an Act such as yours:is the only way to protect the public and to build an honest and trustworthy indus and our own provincial Government feels the same way. From the widespread talk of this South Bends Legislation just in Winniped, I am sure it is being repeated all over Canada and the U.S.A. Motion carried. COMMUNICATION A communication from John J. Gunther, Executive Director of The United States Conference of Mayors, Inviting °the Council to attend the Annual Conference of Mayors in Miami Beach, Florida, May 13 -16, at the Fontainebleau Hotel with a post - Conference tour to Puerto Rico and the Virgin Islands, May 16 -20, was read. Councilman Glass made a motion that the communication be accepted and placed on file. Councilman Tellson seconded motion. Motion carried. PETITION Petition to annex 13.2 acres of land on Ironwood north of Ireland Road. Councilman Coleman made a motion that the petition be referred to the City Planning Commission. Councilman Krueper seconded the motion. Motion carried. REPORT OF CONTROLLER FOR THE MONTH OF FEBRUARY, 1962. Councilman Coleman seconded the motion. Motion carried. ANNUAL REPORT OF BUILDING DEPARTMENT Councilman Krueper made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. ANNUAL REPORT OF SEWAGE DISPOSAL PLANT Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS_ IN THE STREET AND TRAFFI FUND, $15,000.00, AND IN THE FAIR EMPLOYMENT PRACTICE COMMISSION, $155.42, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE favorable, as amended. /s/ Eugene Ladewski, Acting Chairman March 26, 1962. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City, of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (East side of Ironwood, North of Edison Road), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ Eugene Ladewski, Acting Chairman March 26, 1962. Motion carried, ORDINANCE NO. 4445 - - -62 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE FAIR EMPLOYMENT PRACTICE COMMISSION, $155.42, AS AMENDED The Ordinance was given third reading and passed by a roll call vote of 8 ayes and 0 nays, 1 absent (Councilman Lehman). ORDINANCE NO. 4446 - - -62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (East side of Ironwood North of Edison) The Ordinance was given third reading and passed by a roll call vote of 8 ayes and 0 nays, 1 absent (Councilman Lehman). ORDINANCE NO. 4447 - - -62 AN ORDINANCE TO LICENSE POOL ROOMS, POOL HALLS, BILLIARD ROOMS AND BILLIARD HALLS The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays,. 1 absent (Councilman Lehman).1 ORDINANCE NO. 4448 - - -62 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE WALLACE '& TIERNAN & COMPANY, INC., OF NEWARK:, NEW JERSEY, FOR THE PURCHASE OF TWO CHLORINATORS FOR THE NORTH PUMPING STATION ALL FOR THE SUM OF $5,110.00 The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion for sus- pension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Lehman). The Clerk then gave the Ordinance its third reading and it was passed by a roll call vote of 8 ayes, 0 nays 1 absent (Councilman-Lehman). RESOLUTION RESOLUTION OF COMMON COUNCIL OF SOUTH BEND, INDIANA, APPROVING UNDERTAKING OF GENERAL NEIGHBORHOOD RENEWAL PLAN AND FILING OF APPLICATION FOR FEDERAL ADVANCE OF FUNDS WHEREAS, under Title I of the Housing Act of 1949, as amended, the Housing and Home Finance Administrator is authori to extend financial assistance to localities in the elimination and prevention of the spread of their slums and urban blight through the planning and undertaking of urban renewal projects; and WHEREAS, under Section 102(d) of said Title I, the Housing and Home Finance'Admihigtra.tor may make advance of funds for the preparation of :General Neighborhood Renewal Plans for urban renewal areas of such scope that the urban rene activities therein may have to be carried out in stages over a period of not more than ten (10) years; and WHEREAS, it is desirable and in the public interest that the City of South Bend, Department of Redevelopment prepare such a General Neighborhood Renewal Plan, presently estimated at Eighteen Thousand, Eight Hundred Fifty Dollars ($18,850) in that certain area, proposed as an Urban Renewal "Area, situated in the City of South Bend, County of St. Joseph, and State of Indiana, and described as follows: Linden Avenue; proposed park - playground, and the New York Central Railroad on the north; the first alley east of Meade Street on the east; Western Avenue on the south; and the first alley west of Chicago Street on the west. NOW, THEREFORE, BE IT RESOLVED by the Common Council, City of South Bend, Indiana as follows: 1. That the proposed Urban Renewal Area described above is an area of such scope that it is estimated that the urb renewal activities therein may have to be carried out in stages over a period of not more than ten (10) years. 2. That the undertaking by the City of South Bend, Department of Redevelopment of the preparation of a General Neighborhood Renewal Plan for the proposed Urban Renewal Area described above is hereby approved. 3. That it is cognizant of the intention of the City of South Bend, Department of Redevelopment to undertake an urban renewal project promptly upon completion of the General Neighborhood Renewal Plan and the preparation of an urban renewal plan for such project, which project shall embrace at least ten (10) percent of the Urban Renewal Area and shall be of the character contemplated by Section 110 (c) of said Title I. 4. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal assistance under Title I, including the requirements that a General Neighborhood Renewal Plan conform to the Workable Program of the community, as set forth in Section 101(c) of Title I, and to a general plan of the locality as a whole, as well as those requiring a feasible method of relocation and the provision of necessary local grants -in -aid. 5. That it is the intention of this body that the General Neighborhood Renewal Plan will be used to the fullest extent feasible as a guide for the provision of public improvements in such Area and that the Plan will be considered in formulating codes and other regulatory measures affecting property in the Area and in undertaking other local governmental activities pertaining to the development, redevelopment, rehabilitation, and conservation of the Area. 6. That the filing of an application by City of South Bend, Department of Redevelopment for an advance of funds from the United States in an amount not to exceed Eighteen Thousand, Eight Hundred Fifty (Dollars ($18,850) for the preparation of a General Neighborhood Renewal Plan for the Urban Renewal Area described herein is hereby approved. Noble City Clerk /s/ Chester Muszynski Member of the Common Council The President announced at this time that any interestei persons could be heard on this Resolution and speaking in favor of the Resolution were Clinton Harden, 134 South Kenmore; Richard Kirkman, 1118 Queen Street and Mrs. Charles Stokes, 409 East Paris Street. Councilman Glass asked about the possibility of including the Carroll Street project in this survey and Mr. Henry Sucher stated this survey is to cover a neighborhood project and the Carroll Street project and the LaSalle Park project could not possibly be called one neighborhood. Councilman Muszynski moved for adoption of the Resolution. Councilman Ladewski seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Lehman). The/following Memorandum from Mr. Henry Sucher, Executive Director of the South Bend Redevelopment Department, was accepted and placed on file. MEMORANDUM TO: Members of The Common Council FROM: Henry Sucher, Executive Director, South Bend Redevelopment Department DATE: March 22, 1962 SUBJECT: LaSalle Park General Neighborhood Renewal Plan Application The Resolution you are being asked to pass Monday night authorizes the Redevelopment Commission to apply for a federal advance of funds to make plans for the renewal of the entire LaSalle Park Neighborhood. After such a plan is prepared and approved by both you and the Urban Renewal Administration, the first of two (or possibly three) individual projects, each involving new construction, rehabilitation and some clearance, will be undertaken. The advance plus interest is repayable to the federal government out of funds used to finance the first project, consisting of one -third City and two- thirds federal money. I hope to attend the meeting to answer any questions you may want to ask. /s/ Henry Sucher Henry Sucher HS /iu 415 REGULAR MEETING R E S O L U T I O N MARCH 26, 1962 WHEREAS: God in His Infinite Wisdom has called from this life THEODORE SMITH, brother of City Attorney Irving J. Smith, and, WHEREAS: his untimely death has brought much grief and sorrow to his family. NOW, THEREFORE, BE IT RESOLVED: That we, the Common Council of the City of South Bend, Indiana, do hereby extend to his mother, Mrs. Ida Smith; his daughter, Carol; his son, J. Allan; his sister, Mrs. Sylvia Berebitsky; and his brothers, Irving J and Melvin, our sincere sympathy in this, their deepest hour of sorrow; and, BE IT FURTHER RESOLVED that a page be set aside in the Council Records in the City of South Bend and this Resolution be copied therein and a copy duly certified by the Clerk be sent to the members of his family.
