HomeMy WebLinkAbout02-26-62 Council Meeting MinutesREGULAR NESTING FEBRUARY 26, 1962 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers on Monday, February 26, 1962, at 8:07 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman;; Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Motion carried.- Petition to annex 38.9 acres of land, being a triangular piece of land between the Pennsylvania Railroad tracks and the City Limits between Ireland Road and Chippewa. Councilman Glass made a motion that the petitition be referred to the City Planning Commission. Councilman Tellson seconded the motion. Motion carried. Petition to annex .6 acres of land in Wilmette Park. Councilman:Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. Petition to annex 5 acres of land on Dunn Road. Councilman Coleman made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. Petition to annex 213 acres of land along Gertrude Street south of Rum Village Park. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. ORDINANCE NO. 4434 - - -62 AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Fairs, displays, shows and exhibits) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION February 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Scottish Rite of the Masonic Lodge to rezone Lots Numbered 207 and 208, as shown on the Original Plat of the Town, now City of South Bend, together with the vacated alley lying between said lots being more generally described as lying in the 400 block of North Lafayette Boulevard from "B" Residential Use and "C" Height and Area District to "C" Commercial Use and "F" Height and Area District was legally advertised under date of January 22, 1962, and given public hearing on February 1, 1962. The following action was taken: After due consideration the Commission found that the proposed zoning would result in an unwarranted intrusion of commercial zoning into a residential area; and further that it would not be in the best interests of surrounding property. It was therefore duly moved, seconded and unanimously carried (one member abstaining) that the petition be recommended unfavorably to the Council. REPORT OF CITY PLANNING COMMISSION February 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Riverview Development Company to rezone a parcel of land in the 1900 block of Norths Boulevard being bounded on the north by Northside Boulevard and on the South by the St. Joseph River from "B" Residential Use and "A" Height and Area District to "B" Residential Use and "C" Height and Area District was legally advertised under date of January 22, 1962 and given public hearing on February 1, 1962. The following action was taken: After due consideration the Commission found that substantial justice would be done by the granting of the petition and that the prpoposed apartment building would be an asset to the City of South Bend. REPORT OF CITY PLANNING COMMISSION February 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex,to the City of South Bend, Indiana a parcel of land containing 9.99 acres, more or less, in the Northwest One Quarter of Section 27, T38N, R2E, and more commonly known as the South Bend Police Pistol Range was legally advertised under date of January 23, 1962 and given public hearing on February 1, 1962. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. REPORT OF CITY PLANNING COMMISSION February 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend, Indiana a parcel of land bounded on the west by Portage Avenue, on the north by the Northern Indiana East -West Toll Road, and on the east and south by the present city limits containing approximately 192 acres, and more commonly known as the County Home and the County Highway Garage, was legally advertised under date of January 23, 1962 and given public hearing on February 1, 1962. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. REPORT OF CITY PLANNING COMMISSION February 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Tri Valley Council, Inc., Boy Scouts of America and the Indiana and Michigan Electric Company to annex to the City of South Bend, Indiana a parcel of land being bounded on the south by Douglas Road (also known as Lathrop Avenue), on the west by Maple Road, on the North by the present city limits extended west (also known as the east -west centerline of Section 27, T38 N, R2E), and on the east by the present city limits containing approximately 114 acres was legally advertised under date of January 23, 1962 and given public hearing on February 1, 1962. The following action was taken: After due consideration the Commission found that the six determinants'of annexation exist. The following action was taken: After due consideration the Commission found the petition. It was therefore duly moved, recommended favorably to the Council. REPORT OF THE CITY PLANNING COMMISSION February 9, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to zone the recently annexed land being more generally descr as being a parcel of land 305 feet north and south•by 154 feet east and west at the southeast corner of Ironwood Road and Roosevelt Street "C" Commercial Use and "A" Height and Area District was legally advertised under date of January 22, 1962 and given public hearing on February 1, 1962. The following action was taken: After due consideration the Commission found that this is the most logical zoning for said area and that substantial justice would be done by the granting of the petition. The following action was taken: After due consideration the Commission found that the six determinants of annexation exist. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes and 0 nays. ORDINANCE NO. 4441 - - -62 AN ORDINANCE APPROVING, RATIFYING AND CONFIRMING A CERTAIN CONTRACT AND AGREEMENT MADE AND ENTERED INTO BY AND BETWEEN THE CITY OF SOUTH BEND, INDIANA, ACTING BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND SAFETY, AND NORTHERN INDIANA TRANSIT,INC., ITS SUCCESSORS AND ASSIGNS, WHICH SAID CONTRACT RELATES TO THE RATES CHARGED FOR BUS TRANSPORTATION SERVICE UPON CERTAIN STREETS AND HIGHWAYS IN SAID CITY The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9 ayes and 0 nays. The Ordinance was then .given third reading and passed by a roll call vote of 9 ayes and 0 nays. I' ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE STREET AND TRAFFIC FUND, $15,000.00 AND IN THE FAIR EMPLOYMENT.PRACTICE COMMISSION, $155.42 The Ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for suspension of rules. Councilman Lehman seconded the motion. After some discussion, Councilman Tellson withdrew his motion and.Councilman Lehman withdrew his second to the motion. Councilman Coleman then moved that the Ordinance be set for public hearing on March 26, 1962. Councilman Lehman seconded the motion. Motion carried. TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: There are insufficient funds in the General Fund of the City to meet operating needs which were included in the regular budget and appropriation adopted for the year 1962 which are required to be met prior to the receipt of taxes in the year 1962. It will be necessary to authorize and make a temporary loan for the General Fund in the amount of $500,000.00, and I recommend that a temporary loan be authorized for the General Fund in the amount of $500,000.00, and that the warrants evidencing said loan be made payable June 15, 1962. The net assessed valuation of taxable property in the City, as shown by the assessment made for City and County tax in the year 1961, is in the amount of $226,517,410.00. The tax levy made for the General Fund for the year 1962 was $2.803 on each $100.00 taxable valuation, and I estimate that the total amount to be received from such tax levy REGULAR MEETING will be approximately $2,265,174.00. ORDINANCE NO. 4442 - - -62 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAKING OF A TEMPORARY LOAN FOR THE GENERAL FUND AND THE ISSUANCE AND SALE OF WARRANTS OF THE CITY FOR SUCH PURPOSE. The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 9 ayes and 0 nays The Ordinance was then given third reading and passed by a roll call vote of 9 ayes and 0 nays. RESOLUTION A Resolution relative to proposed Housing Sites, continued from the January 26th meeting, was to have been acted upon at. this meeting, but upon motion of Councilman Lehman, seconded by Councilman Allen, was set over until the next Special or Regular Meeting of the Council. RESOLUTION NO. 4 RESOLUTION TO TRANSFER $180,000.00 FROM THE GENERAL SINKING FUND OF THE CIVIL CITY OF SOUTH BEND TO THE GENERAL FUND OF THE CIVIL CITY OF SOUTH BEND WHEREAS, by authority of Chapter 71 of the Acts of 1961, of the General Assembly of the State of Indiana, also found in Burns Indiana Statutes 61 -1207 and 61 -1208, the Common Council of the City of South Bend has the authority to transfer monies from one fund having a sufficient balance to another fund which is depleted; and WHEREAS, the General Sinking Fund of the Civil City of South Bend has a sufficient balance and the General Fund of the Civil City of South Bend is depleted; and WHEREAS, monies have not been delivered by the St. Joseph County Treasurer and the St. Joseph County Auditor to the Civil City of South Bend from the 1961 taxes payable in 1962; and WHEREAS, funds are necessary for the City to operate its business, pay its obligations due and owing; and WHEREAS,.sufficient monies will be available from the St. Joseph County Treasurer and Auditor to pay to the City, monies due and owing to and by virtue of taxes to be derived from personal and real property; and WHEREAS, said monies are anticipated to be received on or before the 15th day of June, 1962, NOW, THEREFORE, BE IT RESOLVED, that the Controller of the City of South Bend, be authorized to transfer the sum of $160,000.00 out of the General Sinking Fund of the Civil City of South Bend, to the General Fund of the Civil City of South Bend and that said transfer be a temporary transfer and that said repayment from the General Fund to the General Sinking Fund be effected on or before the 15th day of June, 1962, and BE IT FURTHER RESOLVED, that the Controller issue a warrant and receipt for the amount of said transfer, and that said warrant shall be endorsed and deposited in the depository account designated for said General Fund, and BE IT FURTHER RESOLVED, that no appropriation shall be required for the said transfer, and said repayment, and that no interest shall be charged on said temporary transfer. /s/ Joseph T.
