HomeMy WebLinkAbout01-22-62 Council Meeting MinutesREGULAR MEETING JANUARY 22, 1962 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, January 28, 1962, at 8:40 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Bruggner City Hall South Bend, Indiana Dear Mayor Bruggner: January 20, 1962 The South Bend Urban League and Hering House, Inc., is a social work organization. Our concerns are primarily to improve the conditions under which all minorities (not just Negroes) live and work, always striving to develop a better climate of interracial understanding. We address ourselves to the present matter before Council for decision, which is in effect the "Proposed Eastside Public Housing Development." We believe that a public housing development, so placed, would not be in the best interest of that community, specifically, and the City of South Bend as a whole, for the following reasons: 1. That this selected site represents the only Class "A" Residential Section of the city where Negro homes have been constructed in the $10,000.00- $50,000.00 price range. 2. That public housing per se is not desirable by all minority group people in search of better housing. 3. That there are many families who now reside in the area designated for blight removal who are not desirous of moving to the:Eastside. One of their reasons being that there is a nostalgic attachment by them for the present neighborhood where they have spent many enjoyable; years, some since childhood. 4. If it is the primary aim of you gentlemen to give a face - lifting to the city of South Bend, then why not take a look at some of the existing structures in all sections of the city where there are delapidated houses, stores, etc., which do not lend beauty. Why not purchase these properties and place a development on those sites? Further before setting forth an alternate proposal for your consideration, we should like it to be known that Negro people in general are not interested in living in a neighborhood because it is all white or predominantly so, but are desirous of the kind of housing for their families which is only found, generally speaking, in such areas as aforementioned. We present the argument for new, private home construction on the proposed slum clearance site: The land involved is about 26 acres bounded east by Scott Street, south by the New York Central Railroad, west by Laurel Street, and north by Western Avenue. These individual family units should be rental property with option to buy. We believe that with such permanent -like, attractive, individual homes constructed, some of the sterotype notions held by white people about the lowering of property values by Negroes where they live would be dispelled. It is also out belief that this housing would appeal to white people alike who need good substantial housing regardless of its location. We base our assumption on the many good experiences we've heard the white occupants in the Plaza Apartments and Public Housing Development speak about. We have absolutely no objection to increased housing facilities for Senior Citizens in this area. In conclusion, gentlement, we implore you, (1) to not place increased public housing in the present proposed re- development areas, (2) to not include in this development area C -2 commercial -type constructionw Sir, this letter is designed to give you our thinking prior to our presentation at your Council session on Monday, January 22, 1962. Councilman Lehman seconded the motion. Motion carried. Petition to annex 192 acres of land (County Home and County Garage). Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. Petition to annex 2 acres of land fronting on Edison Road east of Ironwood. Councilman Lehman made a motion that II the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried.1 Petition to annex 114 acres of land - Maple Road and Lathrop. Councilman Muszynski made a motion that the petition be referred to the City - Planning Commission. Councilman Lehman seconded the motion. Motion carried. COUNCIL REPORT To the Common Council of the City of South Bend: Your Committee on Urban Redevelopment and Housing to whom was referred the proposed land re -use of the Chapin Street Project area, Respectfully report that they have examined the matter and would recommend to the Council as favorable the plan in which the Commercial re -use area will occupy the Western two thirds of the frontage on Western Avenue between Chapin and Scott Streets. /s/ Chester Muszynski, Chairman Councilman Allen made a motion, seconded by Councilman Lehman, to reject the report. Motion carried. Councilman Allen seconded the motion. Motion carried. REPORT OF SEWAGE TREATMENT PLANT December 31, 1961 FOURTH ANNUAL REPORT OF WATER SERVICE INSURANCE PROGRAM To the Honorable Frank J. Bruggner, Mayor and The Honorable Members of the Common Council of the City of South Bend, Indiana In keeping with the custom heretofore adopted by this department we submit our annual report to you which is as follows: Bank Balance as of January 1, 1961 Receipts for 1961 Disbursements for 1961 Total Reserve Fund Total Receipts for four years operation Total Disbursements for four years operation Total Reserve Fund We installed 198 new services from curb to house We installed 18 new lead services from main to curb We repaired ::226 house services Total 442 repairs or replacements for 1961 Average cost per job in 1961 -- $112.82 $71,138,19 68,051.70 $ 3,086.49 $229,609.90 $218,016.74 $ 11,593.16 We have repaired or replaced 1843 services in the four years of operation. $ 8,506.67 3,086.49 $11,593.16 $11,593.16 I would be happy to elaborate more fully at any time convenient to the Mayor or Members of the Common Council. In conclusion we wish to advise that our experience with this program to date would indicate that no increase in the tax rate will be necessary at this time. (937 South Bend Avenue) The Ordinance was given third reading and passed by a roll call vote of 5 ayes (Councilmen Kroll, Ladewski, Coleman, Lehman and Muszynski), 4 nays (Councilmen Allen, Tellson, Glass and Krueper). REPORT OF CITY PLANNING COMMISSION January 8, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached proposed ordinance originated by the City Planning Commission to amend Section 18, Sub - section E -(2) of Ordinance No. 3702, commonly known as the Zoning Ordinance of the City of South Bend, Indiana, was legally advertised under date of December 231 1961 and given public hearing on January 4, 1962. The following action was taken: After due consideration it was moved, seconded and unanimously carried that this proposed ordinance be recommended favorably to the Common Council. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702,, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Fairs, displays, shows and exhibits). The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on February 26, 1962. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE.NO. 4433 - - -62 AN ORDINANCE APPROVING A LEASE BETWEEN THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, AND ALBERT MEILSTRUP, d /b /a MEILSTRUP CARTAGE COMPANY The Ordinance was given first reading by title and second reading in full. Councilman Ladewski made a motion for suspension of rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given 'third reading and passed by a roll call vote of 9 ayes, 0 nays. RESOLUTION A RESOLUTION APPROVING AN ADDITIONAL TRACT OF LAND AS A.'PART OF PROPOSED LOW RENT HOUSING PROJECT INC. 15 -3, WHICH TRACT CONSISTS OF APPROXIMATELY TWO AND ONE -HALF (2 -1/2) ACRES OF LAND LYING SOUTH OF HOWARD STREET AND EAST OF JACOBS STREET IN THE CITY OF SOUTH BEND, INDIANA President Kroll announced that persons interested would be heard and asked that individuals limit themselves to three minutes and anyone representing a group would be allowed five minutes. Councilman Krueper spoke and was followed by Rabbi Albert Shulman. Then speaking in opposition to the proposed Resolution were Charles Wills, 1311 Corby; Tom Singer, 217 Wakewa represenging the Urban Leage and Hering House, Inc, Costella Taylor, 1429 East Corby; Lillian Stanton, 919 Oak Ridge Drive; Mrs. Ruth Bell, 1357 East Campeau; Mark Labe, 924 N. Twyckenham; Paul Wienegar, .910 N. Twyckenham; Josephine Curtis, 1053 North Elmer; Michael Curran, 814 Northwo& Charles Howell, 1118 Duey; Charles Dempsey, 1234 E. Howard. Jesse Dickinson of the Housing Authority was heard and Rabbi Shulman again spoke. Councilman Lehman made a motion for a fifteen minute recess. Councilman Allen seconded the motion. Motion carried and the meeting was recessed at 10:12 P.M. The meeting reconvened at 10:47 P.M. Councilman Lehman made a motion that the Resolution be placed in the Committee of the Whole and asked that informa- tion be obtained from Jesse Dickinson of the Housing Authority and Henry Sucher, Urban Redevelopment Director, on the need for further Public Housing. Councilman Allen seconded the motion. Motion carried. RESOLUTION NO. 3---62 WHEREAS, the need for further public housing in the City has been questioned, and WHE REAS, sufficient information regarding the effect of the Urban Renewal Program of the Chapin Street area on the need for public housing for displaced persons of this area, and the Sample Street Renewal area, is needed, now, therefore, BE IT RESOLVED, that the Executive Director of the Urban Renewal Commission and the Executive Director of the South Bend Housing Authority be directed to give to the Common Council and each member thereof, the last informa- tion on the following subjects: (1) The number of persons relocated and to be relocated by the Urban Renewal Commission in the' Sample Street area. (2) The number of persons to be displaced by the Chapin Street Urban Renewal Project and the number of these persons who will be eligible and /or in need of public housing. (3) The number of persons who have registered for public housing with the South Bend Housing Authority and who have-not been accomodated. /s / J. Chester Allen Member of the Common Council Councilman Muszynski made a motion for adoption of the Resolution. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. Resolution adopted. RESOLUTION Councilman Krueper presented a Resolution relative to the presentation of future Resolutions to the Common Council. Councilman Lehman made a motion for adoption of the Resolution if it is in legal form. Councilman Krueper seconded the motion. After some discussion, Councilman Lehman withdrew his motion for adoption of the Resolution providing the City Attorney will present an instrument at the next Regular Meeting of the Council pertaining to regulations on Resolutions. Councilman Krueper withdrew his second to the motion. NEW BUSINESS Due to the fact that the next Regular Meeting of the Common Council falls on February 12th, Lincoln's Birthday, which is a Legal Holiday in Indiana, Councilman Lehman made a motion that the next Regular Meeting of the Council be held on February 26, 1962. Councilman Allen seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Muszynski seconded the motion.
