HomeMy WebLinkAbout01-08-62 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, January 8, 1962, at 8:10 P.M., with all members present. The meeting was calle( to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. JOSEPH COUNTY ) TO: THE COMMON COUNCIL OF THE CITY OF SOUTH BEND and SOUTH BEND CITY PLANNING COMMISSION JOHN L. WARRICK, Attorney of record for certain petitioners, who filed a petition September 8, 1961, for the re- zoning of certain real estate in said petition described, which said petition was presented to the Common Council of the City of South Bend, Indiana, on September 11, 1961, and was referred by said Council to the South Bend City Planning Commission on September 11, 1961, now moves the Common Council of the City of South Bend and the South Bend City Planning Commission to withdraw the submission of hearing on said petition and to dismiss the petition. /s/ John L. PETITION Petition of Riverview Development Company to rezone land in the 1900 block of Northside Boulevard. Councilman Lehman made a motion that the petition be referred to.the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. DEPARTMENTAL REPORT 7AVUnDA MnTTM TO: COMMON COUNCIL MEMBERS FROM: HENRY SUCHER, EXECUTIVE DIRECTOR SOUTH BEND REDEVELOPMENT DEPARTMENT DATE DECEMBER 26, 1961 SUBJECT: CHAPIN STREET LAND REUSE Fourteen (14) of the nineteen (19) acres of reusable land in the Chapin Street Project Area,are committed: Nine (9) acres to the Park Board and five (5) acres to the Housing Authority. The remaining five (5) acres are in question. In original discussion with the Council, park and public housing were the only projected uses. A petition by nine (9) owners of commercial buildings along the south side of Western Avenue asking to be exempted from clearance, and the fact that five. (5) acres remained after the Park Board and Housing Authority got all the land they wanted, prompted inclusion of a five (5) acre controlled shopping center. At this stage the required reuse appraisal for the land to be cleared was prepared under contract between the Redevelopment Department and Mr. John Pence, local realtor with extensive experience in this field. Subsequently 'a meeting with a number of Council Members produced the impression that a majority of the Council opposed the inclusion of the Shopping Area in the Redevelopment plan. We therefore contacted Mr. Pence, asking him to revise his reuse appraisal, and eliminating the commercial area. Mr. Pence replied that while he was willing to reappraise the land, his opinion was that the highest and the best use for the five (5) acres was commercial, and that he would have to state this in his reappraisal. This would mean that the Urban Renewal Administration would require the City of South Bend to absorb the entire project cost increase due to the drop in proceeds from the resale of the five (5) acres from $249,000 (at about $50,000 per acre for commercial use) to.about $60,000 (at $12,000 - $13,000 per acre for residential use). Yhis would increase the project cost to the City from $330,000 to $520,000, or by $190,000. The Commercial use woul also bring in about $20,000 per year in taxes. Residential reuse, whether public or private, would bring in a lower figure, unless high density private apartments were built. The Redevelopment Department could, if the Council does not accept the commercial reuse, get an entirely new appra which would not mention commercial reuse at all. Chances are that such an appraisal would not be acceptable to the Federal Authorities however, who carefully review all appraisals. /s/ Henry Sucher Henry Sucher HS /iu Councilman Muszynski made a motion that the report be accepted and placed on file. DEPARTMENTAL REPORT MEMORANDUM TO: MEMBERS OF THE COMMON COUNCIL FROM: HENRY SUCHER, EXECUTIVE DIRECTOR DATE: JANUARY 3, 1962 SUBJECT: Application for Recertification of South Bend's Program for Community Improvement Annual Recertification of this program is required before the Housing and Home Finance Agency will participate in Urban Renewal, Public Housing or similar programs in a City. The Application for Recertification you are being asked to approve summarizes progress made during 1961 and sets out the program for 1962. The enclosed summary gives the highlights of this entire application. I hope to attend the Council Meeting Monday Night to answer any questions which might arise. /s/ Henry Sucher Henry Sucher HS:iu The City of South Bend during 1961 has adopted its new Building Code (BOCA Basic Building Code). Code enforcement personnel has been increased and activity stepped up. Enforcement of electrical and heating codes, formerly separate, is now handled by the Building Department, strengthening the administrative organization. In the area of Public Housing, the 235 unit first project was completed and is now fully rented. The Housing Authority has obtained an Annual Contributions Contract for a second project of 160 family units. It has also committed itself to purchase five (5) acres in the Chapin Street Redevelopment Area for the purpose of erecting 100 additional low rent units for the aged. Relocation has proceeded more successfully than anticipated. 210 families of the estimated total of 300 in the Sample Street Clearance Area have been relocated in suitable standard housing during the past twelve months. Only fourteen (14) are now in the on -site workload, and five (5) families are in the off -site workload. Public Housing, use of Sec. 221 mortgages for both new and existing housing, and the very substantial number of homes listed for sale in the South Bend area at present, all have facilitated relocation. Only one family in the present on -site relocatic workload is considered in the critical category, i.e., considerable difficulty is expected in relocating it. Three months.ago eight families were in this classification. In 1962 the City intends to start carrying out the Chapin Street Redevelopment Project. Also scheduled are a General Neighborhood Renewal Program in the LaSalle Park Area and a Renewal Feasibility Study for the Central Area of the City. The City Planning Staff, strengthened by the addition of an assistant director during 1961, hopes to complete the Fire Station Locations Plan, to have the Subdivision Ordinance approved,:.and to make further progress on its compre- hensive revision of the zoning ordinance. In the field of Neighborhood Analysis work is scheduled to be done in connection with the LaSalle Park General Neigh- borhood Renewal Program. The question of the advisability of undertaking a Community Renewal Program will also be considered. Councilman Lehman made a motion that the report be accepted and placed on file. REPORT OF THE CITY PLANNING COMMISSION January 8, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to -annex to the City of South Bend, Indiana, a parcel of land being bounded on the south by Ireland Road and lying between Lafayette and Michigan Streets containing approximately 49.5 acres, was legally advertised under date of December 23, 1961, and given public hearing on January 4, 1962. The following action was taken: After due consideration the Commission found that in their opinion: 1. The annexation is in the best interests of the City and of the territory sought to be annexed. REPORT OF CITY PLANNING COMMISSION (continued) 2. The area is urban in character, being an economic and social part of the annexing city. 3. The city is financially able to provide municipal services to the annexed area within the reasonably near future. 4. The area sought to be annexed is needed for development of the city in the reasonably near future. 5. The lines of the annexation are so drawn as to form a compact area abutting the municipality. REPORT OF THE CITY PLANNING COMMISSION January 8, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Place and Company, Inc., to zone the recently annexed land being bounded on the north by the present city limits or the south line of Scottsdale Addition, on the east by a line 1,320 feet west of Ironwood Road, on the south by the centerline of Jackson Road, and on the west by a line 1,788 feet east of Miami Road, said parcel containing 65 acres, more or less, "A" Residential Use and "A" Height and Area District, was legally adver- tised under date of December 23, 1961 and given public hearing on January 4, 1962. The following action was taken: After due consideration the Commission found that single - family use of subject property would be its highest and best use and that it-conforms with the plan for future land use. REPORT OF CITY PLANNING COMMISSION January 8, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Richard E. Landgraf, Std., and William and Marilyn Dvorak to rezone Lots Numbered 187, 188, and 189, as shown on the Second Plat of the Northwest Addition to the City of South B nd, Indiana, except 36 feet off of the east side of said Lots 188 and 189, and more commonly known as 1620 and 1628 Portage Avenue, from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "A" Height and Area District, was legally advertised under date of December 232 1961 and given public hearing on January 4, 1962. The following action was taken: After due consideration the Commission found that the granting of the petition would constitute spot zoning and that the shopping area south of Bulla Street was sufficient in size and diversity to adequately -handle the shopping requirements of the general neighborhood; and in addition that a relatively considerable amount of commercially zone land immediately across Portage Avenue from said shopping area was used residentially. REPORT OF CITY PLANNING COMMISSION January 8, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: Under date of January 4, 1962, the Commission took the following action in regards to your communication relative to amending the petition of Genevieve and Frederic C. Wimkler and Alfreda W. Walter to rezone the property most generall inown as 937 South Bend Avenue from "B" Residential Use and "B" Height and Area District to "C" Commercial Use and "D" Height and Area District, by excluding the west fifty feet of said property from the petition area: After due consideration the Commission unanimously voted to approve said amendment. Thereby, under the provisions of Chapter 174, Acts of 1947, the ordinance stands as passed by the Council, as of the date of the recording of the Commission's report to the Council. Councilman Muszynski made a motion that the Ordinance be set for public hearing on January 22, 19.62. Councilman Lehman seconded the motion. Motion carried. ORDINANCE NO. .4426 --- 62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (65 acres between Ironwood and Miami from the present City Limits South to Jackson Road) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for sus- pension of the rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays (Councilman Krueper being absent from the Council Chambers at the time the vote was taken). ORDINANCE NO. 4427 - - -62 AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS- TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE .GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945 AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951 The Ordinance was given first reading by title and second reading in full. ADMINISTRATION FOR EMPLOYEES OF THE CIVIL DEFENSE AGENCY OF THE CITY OF SOUTH BEND The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Coleman seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4429 - - -62 AN ORDINANCE ORDERING AND PROVIDING FOR THE SALE OF CERTAIN REAL ESTATE IN THE CITY OF SOUTH BEND, ST. RESOLUTION NO. 1 - - -62 R E S O L U T I O N WHEREAS, God, in His Infinite wisdom has called from this life, Paul M. Butler, former National Chairman of the Democratic Party, and WHEREAS, his untimely death has brought much grief and sorrow to his family and his many friends, and WHEREAS, Paul M. Butler was an integral part of the life of the City of South Bend, State of Indiana, and the United States, and WHEREAS, through his diligence and his efforts, he brought great respect and dignity to the field of politics, and WHEREAS, his participation in community affairs will be sorely missed. NOW, THEREFORE, BE IT RESOLVED, that we, the Common Council of the City of South Bend, do hereby extend to the entire family of Paul M. Butler, our sincere sympathy in this, their hour of sorrow, and BE IT FURTHER RESOLVED, that a page in the Council records of the City of South Bend be set aside, and this resolution be copied therein, and that a copy duly certified by the Mayor be delivered to the bereaved. /s/ T. RESOLUTION NO. 2 - - -62 R E S O L U T I O N WHEREAS, God in His infinite wisdom has called from this life, Howard A. (Bud) Noble, member of the staff of the South Bend Tribune, and WHEREAS, his untimely death has brought much grief and sorrow to his family and his many friends, and WHEREAS, Howard A. Noble was a most important facet in the field of journalism and political endeavor in the community, and WHEREAS, because of his knowledge of the field of government, he aided the City of South Bend in its operation of City Government for many, many years, and WHEREAS, he participated in many civic boards and groups as a voluntary nature without compensation, and WHEREAS, up until the date of his passing he was actively engaged in assisting our community in the field of Civil Defense. NOW, THEREFORE, BE IT RESOLVED, That we, the Common Council of the City of South Bend, do hereby extend to the entire family of Howard A.
