The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Lehman seconded the motion. Motion carried. PETITIONS Petition of Place and Company to zone recently annexed land - - -65 acres along Jackson Road. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motim carried. Petition of Richard E. Landgraf, Sr., et al, to rezone 1620 Portage Avenue. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. Petition of Wm. and Marilyn Dvorak to rezone 1626 Portage Avenue. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. Petition of South Bend Sand and Gravel Company to annex land between Maple Road and Meade Street between Lathrop and Bergan Streets. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Allen seconded the motion. Motion carried. Petition originated by the Council to annex 593 acres of land bounded by Kern, Miami, Jackson and Ironwood Roads. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. Petition bearing 60 signatures against the proposed annexation of 593 acres of land bounded by Kern, Miami, Jackson, and Ironwood Roads. Councilman Allen made a motion to table the petition. Councilman Muszynski seconded the motic After some discussion, Councilman Allen withdrew his motion. Councilman Muszynski withdrew his second to the motion. Councilman Coleman made a motion that the petition be refused and returned to the petitioners. Councilman Allen seconded the motion. Motion carried. Councilman Lehspan seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Relative to area of residential lots), Respect - ftily report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. ORDINANCE NO. 4423 - - -61 AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Relative to area of residential lots) The Ordinance was given third reading and passed by a roll call vote of 9 ayes and 0 nays. ORDINANCE NO. 4424 -61 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE ELECTRICAL DEPARTMENT $305.00 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION December 11, 1961 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Genevieve and Frederic C. Winkler and Alfreda W. Walter to rezone Lot Number Two (2) in Sorin First Addition to the City of South Bend, excepting that part of the west end of said lot which is now zoned commercial, said lot more commonly known as 937 South Bend Avenue, from "B" Residential Use and "B" Height and Area District to "C" Commercial Use and "D" Height and Area District was legally advertised under date of November 27, 1961, and given public hearing an December 7, 1961.. The following action was taken: After due consideration, the Commission found that the proposed zoning would be a logical and needed extension of existing commercial district. REPORT OF CITY PLANNING COMMISSION December 11, 1961 The Honroable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached proposed ordinance initiated by the City Planning Commission was heard at. public hearing under date of July 6, 1961, at which time it was favorably recommended to the Common Council This Ordinance has been used by the Planning Commission for the past seven years as "rules and regulations" under provisions of Chapter 147, Acts of 1947. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (937 South Bend Avenue) The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion to amend the Ordinance by adding to the description "and also excepting 50 feet east and west taken off of the entire west side of said Lot Number 211. Councilman Ladewski seconded the motion. Motion carried. Councilman Coleman made a motion to return the amended Ordinance to the City Planning Commission for their study and report. Councilman Allen seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE PROVIDING FOR THE CONTROL OF LAND SUBDIVISION AND THE APPROVAL OF PLAT AND REPLAT OF LAND WITHIN THE TERRITORIAL JURISDICTION OF THE SOUTH BEND CITY PLANNING COMMISSION; PROVIDING PENALTIES FOR VIOLATION AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH The Ordinance was given first reading by title and second reading in full. Councilman. Allen made a motion that the Ordinance be set for public hearing on March 12, 1962. Councilman Krueper seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND ORDINANCE NO. 3913 (AS AMENDED) (ELECTRICAL INSP>CTION) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on January 22, 1962. Councilman Krueper seconded the motion. Motion carri ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND CHAPTER 12, ARTICLE II, SECTIONS 2 to 13 INCLUSIVE, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, APPROVED AND SIGNED BY THE MAYOR OF THE CITY OF SOUTH BEND, JULY 12, 1949, AND ALSO KNOWN AS ORDINANCE NO. 2948 The Ordinance was given first reading by title and second reading in full. Councilman Coelman made a motion to amend the title by striking "Ordinance No. 3948 and inserting Ordinance No. 3709 ". Councilman Allen seconded the motion. Motion carried. Councilman Lehman made a motion that the Ordinance be set for public hearing on January 22, 1962. Councilman Allen seconded the motion. Motion carried. ORDINANCE No. 4425 - - -61 AN ORDINANCE TO AMEND CHAPTER 2, SECTION 18 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion for suspension of rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass having left the meeting earlier). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). RESOLUTION RESOLUTION AUTHORIZING CERTAIN PAYMENTS TO BE MADE TO SALARIED EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana, is approaching the close of its fiscal year; and, WHEREAS, the office of the City.Controller will be required to make numerous payments and close its numerous and complicated accounts; and, WHEREAS, it is desirable that the work of said office be simplified; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana: 1. That all salaried officers and employees of the City shall be paid their salaries for the month of December, 1961, on the 20th day of December, 1961. 11. The::Controller of the City of South Bend is hereby authorized to make said salary payments upon said date. 111. This Resolution shall be in full force and effect from and after its.,adoption by the Common Council and approval by the Mayor. DATED: December 11, 1961 /s/ Paul E. Resolution adopted by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). Councilman Lehman made a motion to dispense with the Regular Meeting of the Council which would be on December 25, 1961. Councilman Krueper seconded the motion. Motion carried. 381 REGULAR MEETING DECEMBER 11, 1961 There being no further business to come before the Council, Councilman Tellson made a motion tb'Adjourn. Councilman Ladewski seconded the motion.
