HomeMy WebLinkAbout11-27-61 Council Committee of the Whole Meeting MinutesM COMMITTEE OF THE WHOLE MEETING NOVEMBER 272 1961 Be it remembered that the Common Council df the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers on Monday, November 27, 1961, at 8 :07 P.M., with all members present. The meeting was called to order by Councilman T. W. Lehman, Chairman, who presided. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Jackson Road between Ironwood and Miami) This_being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking against the proposed Ordinance was Charles Evans, 19831 Dice Street, President of the Centre Town ship Planning and Improvement Association. Councilman Krueper and Councilman Ladewski were heard. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. Councilman Allen seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS, AS-AMENDED I (Ironwood, Edison and South Bend Avenue) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given a.n opportunity to be heard thereon. John Wagner, 5304 North Ironwood Road, representing the School Board of Clay Township, was heard. Also speaking against the Ordinance was_. Cletus McClain, 54929 Ironwood. Speaking in favor of the proposed Ordinance were Rocco Ameduri, 1102 South Bend Avenue; Vince Mejer, 17973 State Road 23; Ray Andrysiak, City Engineer; Jim Harmon, 18170 State Road 23. Councilman Kroll made a motion for a five minute recess. Councilman Glass seconded the motion. Motion carried. Committee of the Whole Meeting recessed at 8 :31 P.M. Committee of the Whole meeting reconvened at 8:43 P.M. Councilman Krueper made a motion to amend the Ordinance by deleting lines 12 through the first 3 words of line 26 and substituting therefore the following: "thence north parallel with the west line of said Quarter Section a distance of 305 feet, more or less, to the south right -of -way line of Roosevelt Street; thence west a distance of 234 feet, more or less, to the west right -of -way line of Ironwood Drive, thence north along the west right -of -way line of Ironwood Drive to the southerly right -of -way line of South Bend Avenue (Indiana 23);" And also by deleting the words "57 acres" in line 43 and substituting the words "51 acres ". Councilman Allen seconded the motion. Motion carried by a roll call vote of 7 ayes (Councilmen Kroll, Allen, Ladewski', Tellson, Glass, Krueper and Lehman), -2 nays, (Councilmen Coleman and Muszynski). Councilman Allen made a motion that the Ordinance, as amended, go to the Council as favorable. Councilman Kroll seconded the motion. Motion carried.by a roll call vote of 9 ayes, 0 nays. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Lawrence and Howard Streets - - -4 corners) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity-to be heard thereon. Councilman Allen made a motion that the Ordinance go to the Council as unfavorable. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 5 ayes (Councilmen Droll, Allen, Tellson, Glass and Muszynski), 4 nays (Councilmen Ladeski, Coleman, Krueper and Lehman), ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Grocery and Meat Markets, Banks and Laundry or Dry Cleaning Pickup stations) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. Councilman Allen seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING SECTION 24 OF CHAPTER 30, OF ORDINANCE NO. 3709, APPROVED JULY 12, 1949, COMMONLY KNOWN AS "MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1949" ALSO KNOWN AS ORDINANCE NO. 3423, SECTION 21, (Relating to Arborists) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Ralph Newman, 1711 East LaSalle Avenue, Superintendent of the Park Department. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. Councilman Krueper seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TO AMEND CHAPTER 11A, SECTION 7 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, ADOPTED in 1949, ALSO KNOWN AS ORDINANCE NO. 3925, ARTICLE I, SECTION 7 This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. Councilman Krueper seconded the motion. Motion carried. COMMITTEE OF THE WHOLE MEETING REGULAR MEETING ORDINANCE NOVEMBER 27, 1961 AN ORDINANCE-TO REGULATE THE BUSINESS OF INSTALLING AND SERVICING TELEVISION EQUIPMENT IN THE CITY OF SOUTH BEND; TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE: AND TO PROVIDE A PENALTY FOR THE VIOLATION OF THE TERMS THEREOF, AS AMENDED. 375 This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed Ordinance were the following: Roman Korpal, Paul Schwertley, Bill Davis, Julius Erdelyi, John Frick and Russ Bills. Speaking against the proposed Ordinance were Edward Fiwek, John Dutrieux, and Rich Kirkman. Councilman Glass and Councilman Coleman were also heard. Councilman Allen made a motion for a five minute recess. Councilman Krueper seconded the motion. Motion carried and the Committee of the Whole Meeting recessed at 9:12 P.M. Committee of the Whole Meeting reconvened at 9 :26 P.M. Councilman Glass made a motion to amend Section--5.2 --FEES, by striking T. V. Technician $25.00 and inserting T.V. Technician $10.00; and by striking T. V. Antenna Installer $15.00 and inserting T. V. Installer $10.00. Councilman Allen seconded the motion. Motion carried. Councilman Kroll made a motion that the Ordinance go to the Council as favorable, as amended. Councilman Glass seconded the motion. Motion carried. There being no further business to come before the Committee of the Whole, Councilman Kroll made a motion to adjourn. Councilman Krueper seconded the motion.
