HomeMy WebLinkAbout10-23-61 Council Meeting MinutesREGULAR MEETING OCTOBER 23, 1961 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers on Monday, October 23, 1961, at 8:12 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL ' PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. PETITION Petition of Royal Hughes to rezone three lots on Falcon Street North of Western Avenue. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Genevive Winkler, et al, to rezone land at 937 South Bend Avenue. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. REPORT OF TRAFFIC AND TRANSPORTATION COMMITTEE A meeting of the Council Traffic and Transportation Committee was held in the Council chamber, on Monday Night, October 16, 1961. Present were committee members Joseph Kroll, Paul Krueper, Chester Muszynski, and Eugene Ladewski. Also present were Traffic Engineer Clem Hazinski, and Parking Meter Supt. Bert Danielowicz. Absent were Albert Tellson and Walter Glass. Mr. Danielowicz reported that 132 parking fine boxes would be required to do an adequate job. Other cities that use the fine boxes have realized twice to three times an increase in fines collected. It is more convenient for a motoris to pay a fine at the box instead of going to the City Hall. The following fine boxes were examined: Park -o -Fine, cost $12.95; Traf- O- Teria, cost $24.95; Fine -O- Meter, cost $16.50; Rockwell, cost $15.85. The committee unanimously recommends that the Board of Public Works procure 132 parking fine boxes from the Park -O -Fine Co., Jackson, Mich., at a cost of no more than $12.95, at an early date. These boxes will be used in conjunction with a new envelope type of parking ticket. The subject of Meter Maids was discussed. Mr. Danielowicz reported that Police Chief Dutrieux has received many good recommendations from cities that use this system of parking meter enforcement. A married woman, between the ages of 25 and 35 seems to be the best suited for this work. Six Meter Maids would adequately be able to patrol all of the parking meters. This in turn would relieve six police patrolmen for other duties. A savings in salaries and motorcycle equipment could also be effected. The Meter Maids would walk their "beats ". The committee unanimously recommends the hiring of six wome to work in the Parking Meter Department as meter Maids, to begin work at the first of the year, at a salary to be determined by the Board of Works. Clem Hazinski discussed the traffic hazard at the Memorial Hospital parking lot entrance on N. Michigan St. He said that there should be a sufficient gap in traffic to permit entrance and exit. Mr. Hazinski thinks that vehicles should enter the lot from Main St., and exit on Michigan St. However, it is necessary for him to gather more data through a study before definite recommendations can be made. A meeting will be called when this information is available. /s/ Eugene Ladewski Eugene Ladewski, Chairman Traffic and Transportation Committee Councilman Allen made a motion that the report be accepted and placed on file and that the chairman of the Committee be complimented on the detailed and thorough report. Councilman Lehman seconded the motion. Motion carried. Mr. Smith, City Attorney, recommended that the Traffic and Transportation Committee meet with the Judge of-the City Court,who has jurisdiction over the fines, and ask his cooperation on the preparation of an Ordinance covering Meter Maids and collection of fines. REPORT OF ORDINANCE COMMITTEE To the Common Council of the City of South Bend: October 23, 1961 Your Committee on Ordinances, to whom was referred The T. V. Ordinance, did meet on October 6, 1961 and October 20, 1961, and Respectfully report that they have examined the matter and that in their opinion Said ordinance as referred should be amended; revised and re- introduced as a new ordinance and in connection therewith tenders for lst and 2nd reading the attached amended and revised ordinance for the regulation and examination and licensing of TV technicians and TV antenna installers of home type TV sets and antennas. /s/ J. REPORT OF CITY CLERK The Common Council October 23, 1961 City of South Bend South Bend, Indiana Gentlemen: In keeping with your action in 1960 authorizing this office the sum of Seven Thousand ($7,000.00) Dollars for the recodification of the Municipal Code and the printing thereof, I wish to advise you that I have asked the Board of Public Works to advertise for bids on this work on November 3rd and November 10th, 1961, with bids to be received by the Board of Public Works on November 20th, 1961., I hope this meets with your approval. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE CONTROLLER, $850.00, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. ORDINANCE NO. 4408 - - -61 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE CONTROLLER, $850.00 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION October 18, 1961 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone Lots Numbered 2, 4, and 6, Hickey's Sub., Lots Numbered 19, 20, 21 and 22, University Place, and also beginning at the northwest corner of Howard Street and Lawrence Street, thence west 159.37 feet, more or less, thence north 198.feet, thence east 159.37 feet, thence south to the place of beginning containing three lots, and also beginning at the south west corner of Howard Street, thenc West 159.37 feet ;. more or less, thence South 198 feet, thence east 159.37 feet, thence north 198 feet, containing three lots, being generally described as being the four corners formed by the intersection of Howard and Lawrence Streets, from "C" Commercial Use and "D" Height and Area District to "B" Residential Use and "B" Height and Area District was legally advertised under date of May 22, 1961 and given public hearing on June 1, 1961. The following action was taken: After due consideration the Commission found that all of the lots in question except the northwest corner of Howard and Lawrence Streets have over the years been used for residences and not commercially, that the immediate area is comprised of sound residential dwellings, and that any further expansion of commercial uses is unwarranted and could adversely affect the residential character of the area. it.was therefore duly moved, seconded, and unanimously carried that the petition be recommended favorably to the Common Council. ORDINANCE, FIRST AND SECOND_'READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA' (Four Corners of Howard and Lawrence Streets) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on November 27, 1961. Councilman Krueper seconded the motion. Motion carried. Councilman Lehman moved that the original Television Ordinance, which was referred to the Ordinance Committee, be withdrawn so that a new Ordinance could be introduced. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO REGULATE THE BUSINESS OF INSTALLING AND SERVICING TELEVISON EQUIPMENT IN THE CITY OF SOUTH BEND; TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE; AND TO PROVIDE A PENALTY FOR THE VIOLATION OF THE TERMS THEREOF. The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on November 27,. 1961. Councilman Allen seconded the motion. Motion carried. OLD BUSINESS Councilman Tellson requested the City Attorney to investigate regulations concerning fallout shelters. The City Attorney 'informed Mr. Tellson that the new Building Code would adequately covern construction of a fallout shelter, but would suggest that Mr. Tellson and Mr. Krueper meet with the Building Commissioner, Verner Lane, for discussion. NEW BUSINESS Councilman Allen stated that he wished to call to the attention of the Council the new procedure of our very com- petent City Clerk, a written resume of the previous Council Meeting, and he made a motion that the Council thank the City Clerk for the procedure and trust that she will keep it up. Councilman Lehman seconded the motion. Motion carried. Councilman Ladewski presented the following petition which was read by the Clerk: October 23, 1961 PETITION WHEREAS, There has been a very apparent increase in vehicular traffic in the 1600 block of Western Avenue due to increased construction of residential and commercial buildings, and, WHEREAS:, this very marked increase in traffic creates a hazardous condition for both pedestrian and motorist alike, and, REGULAR MEETING OCTOBER 23, 1961 RM WHEREAS, the more than 1200 members of Pulaski Post 357, The American Legion, including its Past Commanders Council, whose Post Home is located at 1606 Western Avenue, do fear that this condition will become much worse and result in traffic mishaps which could lead to serious injury or possible fatality. THEREFORE, we the members of Pulaski Post 357, have authorized the undersigned to hereby petition the Honorable City Council and the City Traffic Engineer to intercedefor us to the Highway Engineer of the great State of Indiana, to remedy this hazard through the installation and operation of a traffic signal at the intersection of Western Avenue (State Route 2) and Kosciuszko Street, as soon as is possible. Nowinski, Adjutant Councilman Coleman made a motion that the petition be referred to the Traffic Engineer for appropriate action, and thata' copy be submitted to the Board of Public Works and Safety so they can give the Traffic Engineer authority to proceed. Councilman Lehman seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Lehman made a motim to adjourn. Councilman Muszynski seconded the motion.
