The meeting was called to order by President Joseph T. Kroll, who presided. \3 ROLL CALL: PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Glass, Krueper, Lehman and Muszynski. ABSENT: Councilman Coleman. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Lehman South Bend, Inc., October 9, 1961 Minutes of Meeting of September 25, 1961 Councilman Lehman made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Place and Company to annex land on Jackson Road east of Miami. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE Councilman Allen, Chairman of the Ordinance Committee, reported that they had met in Committee to study the revised Television Ordinance. He recommended that the revised verstion of the Original Television Ordinance be withdrawn and a new Ordinance be introduced and set for public hearing. After some discussion, Councilman Krueper moved that the report be accepted but any action on a new Ordinance be delayed until the next meeting. Councilman Tellson seconded the motion. Motion carried. REPORT OF TRAFFIC ENGINEER Members of the Common Council City Hall South Bend, Indiana Gentlemen: October 9, 1961 At the regular meeting of the Common Council on September 25, 1961, this department was directed to investigate a complaint reference damage to Vine Street one -half block west of its intersection with 20th Street. The Complaint signed by Matthew and Anna Zangerle, 1001 So. 20th St., states that damage to the street was done by construction equipment used during the building of Indiana University Extension Center on Northside Boulevard. Investigation shows that a dust problem will result with use of the parking lot. I conferred with officials at the lndtana University Center and have, also written to Indiana University at Bloomington, Indiana. I am awaiting a reply and will report to the Council upon its receipt. Respectfully submitted, /s/ Clem F. Hazinski CLEM F. ORDINANCE NO. 4403 - - -61 AN ORDINANCE AMENDING ORDINANCE NO.. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Eddy Street between Sorin and Campeau) The Ordinance was given third reading and passed by a roll call vote of 6 ayes, (Councilmen Ladewski, Tellson, Glass, Krueper, Lehman and Muszynski), 2 nays, (Councilmen Kroll and Allen) and 1 absent (Councilmean Coleman). ORDINANCE, THIRD READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Northeast corner of Bendix Drive and Crumstown Avenue) The Ordinance was given.third reading and lost by a roll call vote of 8 nays, 0 ayes, 1 absent (Councilman Coleman). ORDINANCE NO. 4404 - - -61 AN ORDINANCE AMENDING ORDINANCE #3702, ADOPTED BY THE COMMON COUNCIL ON THE 13th DAY OF JUNE, 1949 (West side of Olive St., North of Lincolnway West) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Coleman)I ORDINANCE NO. 4405 - - -61 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE POLICE DEPARTMENT - $2,300.00 The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Coleman REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: October 9, 1961 The attached petition of the Common Council to rezone the property being described as beginning at the northeast corner of Bendix Drive and Ardmore Trail, thence north along the east right -of -way line of Bendix Drive for a distance of 218 feet, more or less, thence southeast parallel with the south right -of -way line of Lincoln Way West for a distance of 310 feet, more or less, to a point on the north right -of -way line of Ardmore Trail, thence southwest along the north right -of -way line of Ardmore Trail to the point of beginning from "B" Residential Use and "A" Height and Area District to "C "Commercial Use and "D" Height and Area District was legally advertised under date of September 25, 1961, and given public hearing on October 5, 1961. The following action was taken: After due consideration the Commission found: 1. That the land in question is the south one -half of a triangular shaped lot the north .one -half of which is used and zoned commercially. 2. That the land in question is vacant and always has been. 3. That the best use of the land in question is commercial. ORDINANCE NO. 4406 - - -61 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Bendix Drive and Ardmore Trail) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the rules be suspended. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 8 ayes, and 0 nays, 1 absent (Councilman Coleman). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Coleman). REGULAR MEETING OCTOBER 9,1961 ORDINANCE NO. 4407 - - -61 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE AND SALE OF BONDS OF SAID CITY FOR THE PURPOSE OF PROVIDING FUNDS TO BE APPLIED ON THE COST OF THE CONSTRUCTION OF STORM, SANITARY AND OTHER SEWERS TO MAPLE ROAD FOR THE NORTHWEST INDUSTRIAL DEVELOPMENT AREA, AS WELL AS IN THE AREA OF LAFAYETTE BOULEVARD AND IROQUOIS AVENUE LOCATED NORTH OF THE ST, JOSEPH RIVER AND IN THE CHIPPEWA AVENUE AND IRELAND ROAD AREAS; ALSO, FOR THE ACQUIRING OF LANDS AND RIGHTS -OF -WAY FOR A NEW SAMPLE STREET BRIDGE AND FOR MAKING MAJOR THOROUGHFARE IMPROVEMENTS AND ACQUIRING OF RIGHTS -OF -WAY THEREFOR, TOGETHER WITH THE INCIDENTAL EXPENSES TO BE INCURRED IN CONNECTION THEREWITH. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE OF THE CITY OF SOUTH BEND APPROPRIATING THE SUM OF ONE MILLION, ONE HUNDRED THOUSAND DOLLARS ($1,100.00.00) TO BE APPLIED ON THE COST OF THE CONSTRUCTION OF STORM, SANITARY AND OTHER SEWERS TO MAPLE ROAD FOR THE NORTHWEST INDUSTRIAL DEVELOPMENT AREA, AS WELL AS IN THE AREA OF LAFAYETTE BOULEVARD AND IROQUOIS AVENUE LOCATED NORTH OF THE ST. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE STREET AND TRAFFIC FUND, $1,458.48 The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on November 13, 1961. Councilman Lehman seconded the motion. Motion carried, ORDINANCE, FIRST AND SECOND READING. AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN 1959 GENERAL STREET IMPROVEMENT FUND $2,317.21 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on November 13, 1961. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SANITATION DEPARTMENT $500.00 The Ordinance was given first reading by title and second reading in full, Councilman Lehman made a motion that the Ordinance be set for public hearing on November 13, 1961. Councilman Muszynski seconded the motion. Motion carried. TZF.SnT.1TTT0N WHEREAS, The Common Council of the City of South Bend is desirous of working more closely with the various appointed and elected officials of the City; and, WHEREAS, The Common Council wishes to become better informed of their activities, their plans, their budgets, and the general operations of the various departments. NOW, THEREFORE, BE IT RESOLVED: That the Common Council of the City of South Bend, shall hold an informal meeting immediately prior to the.first Council meeting of each quarter, said meeting to be held at 6:00 P.M., at a place designated by the President of the Council. BE_.IT FURTHER RESOLVED, That there be invited to said meetings such appointed or elected officials as might be deemed necessary to assist in providing a better liaison between the Council and the various departments of the City. /s/ Paul E. NEW BUSINESS Councilman Tellson made a motion that the Urban Redevelopment and Housing Committee of the Council, the Park Depart- ment Board, The Housing Authority and the Redevelopment Commissioners meet with Mr. Sucher in his office on Friday, October 13th, 1961, at 7:00 P.M.. Councilman Lehman seconded the motion. Motion carried. Councilman Tellson remarked about the hazardous traffic situation on North Michigan Street at the entrance to Memorial Hospital by persons endeavoring to make a left turn into the Hospital entrance. He made a motion that this be referred to the Traffic and Transportation Committee of the Council. Councilman Muszynski seconded the motion Motion carried. 364 REGULAR MEETING OCTOBER 9, 1961 There being no further business to come before the Council, Councilman Lehman made a motion to adjourn.
