HomeMy WebLinkAbout09-11-61 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, on Monday, September 11, 1961, at 8:25 P.M., with all members present except Councilmen Allen and Glass. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Ladewski, Tellson, Coleman, Krueper, Lehman and Muszynski ABSENT: Councilmen Allen and Glass. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY To the Common Council City of South Bend, Indiana Gentlemen: August 30, 1961 In answer to your Directive of August 15, 1961, concerning a Petition for a street light at an alley between Frederickson and Prast, this Petition was referred to the Electrical Department for investigation and report. Following the recommendation of the Electrical Department, the Board approved the installation of a 4000 lumen light at the alley intersection of the 900 Block North Goodland Avenue, between Frederickson and Prast. REPORT OF CITY PLANNING COMMISSION September 11, 1961 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of George K. and Cecelia Buechner to rezone Lots Numbered 38 and 39, as shown on the recorded Plat of Oliver Heights Addition to the City of South Bend, Indiana, from "A" Residential Use and "A" Height and Area District to "C -1" Commercial Use and "C" Height and Area District was legally advertised under date of August 28, 1961 and given public hearing on September 7, 1961. The following action was taken: After due consideration the Commission found that surrounding land use was predominantly commercial, that the two lots in question have been vacant for many years and that commercial zoning would be in the best interests of the general area and the City of South Bend. REPORT OF CITY PLANNING COMMISSION September 11, 1961 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached proposal to annex to the City of South Bend, Indiana, the following described property: Beginning at a point on Ireland Road (which point is also the present city limits), thence east along the center line of Ireland Road for a distance of 793 feet, more or less, thence north along the ast line of the west half of the NE'k of Section 30 for a distance of 2,152 feet, more or less, to the present city limits, thence west and south along the present city limits to the place of beginning containing 37.31 acres, more or less, was legally advertised binder date of August 28, 1961 and given public hearing on September 7, 1961. The following action was taken: The Commission was of the opinion that the six determinants of annexation exist. It was therefore duly moved, seconded, and unanimously carried that the attached proposal be recommended to the Common Council for favorable action. The following action was taken: After due consideration the Commission found the petition. It was therefore duly moved, un- favorably to the Common Council. REPORT OF CITY PLANNING COMMISSION September 11, 1961 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Robert M. Edwards, et al, to zone the recently annexed property generally described as bein a parcel of land 660 feet north and south by 726 feet east and west at the northeast corner of Edison and Ironwood Roads to "C" Commercial Use District and "A" Height and Area District was legally advertised under date of August 28, 1961 and given public hearing on September 7, 1961. The following action was taken: After due consideration the Commission found that said property was originally zoned commercial while under County jurisdication and that land use to the south of said property is zoned commercial. Councilman Lehman made a motion that the Ordinance be set for public hearing on September 25, 1961. Councilman Muszynski seconded the motion. Motion carried, ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED BY THE COMMON COUNCIL ON THE 13th DAY OF JUNE, 1949 (Olive and Lincolnway West) The Ordinance was given first reading by title and second reading in full. ORDINANCE NO. 4399 - - -61, AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (NE CORNER IRONWOOD DRIVE AND EDISON ROAD) (11 acres more or less) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Ladewski seconded the motion. Motion carried,by a roll call vote of 7 ayes, 0 nays, 2 absent (Councilmen Glass and Allen). ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE POLICE DEPARTMENT - $2,300.00 The Ordinance was given first reading by title and second reading in full. ORDINANCE NO 4400 - - -61 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAKING OF A TEMPORARY LOAN FOR THE GENERAL FUND AND THE ISSUANCE AND SALE OF WARRANTS OF THE CITY FOR SUCH PURPOSE The Ordinance was given first reading by title and second reading in full. Councilman Lehman, Chairman, asked the Clerk to read a communication from Mr. Davies, Controller. The Clerk read the following communication: Common Council Civil City of South Bend City Hall South Bend, Indiana Gentlemen: September 9, 1961 An examination of the records and monies available for the operation of the City of South Bend has shown that there is not sufficient cash to operate the city government for the next three months. The monies anticipated to be received from the St. Joseph County Treasurer, which monies have been levied, are not available at this time. These funds are in the process of collection for the fiscal year of 1961, but will not be available in time to pay claims, salaries and wages. I have made a study of this matter and recommend to the Council that an Ordinance be introduced to authorize a temporary loan not exceeding $300,000.00 payable on or before the 15th day of November, 1961. RESOLUTION A RESOLUTION AUTHORIZING AN AMENDMENT TO THE COOPERATION AGREEMENT BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, The Housing Authority of the City of South Bend, Indiana, entered into a Cooperation Agreement on or about the 11th day of September, 1956, with the City of South Bend, Indiana; and WHEREAS, said Cooperation Agreement was amended on or about the 13th day of August, 1959, which amendment resulted the addition of "Section 10" to said Cooperation Agreement , which provided, in substance, for the repayment to the Public Housing Administration (herein called "PHA ") and to the Municipality, on behalf of the local public bodies involved, contributions made by said PHA and said Municipality to projects constructed by The Housing Authority of the City of South Bend, Indiana; and WHEREAS, The Housing Act of 1961, which became law on June 30, 1961, repealed Section 10 (j) of the United States Housing Act, and which said Section provided for the recapture of contributions made by the PHA and the Municipality; and, WHEREAS, The Public Housing Administration will not make any advances under a preliminary loan contract, or sign a new Annual Contributions Contract unless the Local Authority and the local governing bodies comply with the provis of the New Housing Act of 1961; NOW, THEREFORE, BE IT RESOLVED BY THE COMMCN COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1. That an amendment to the Cooperation Agreement, dated September 11, 1956, between the City of South Bend, Indiana, and The Housing Authority of the City of South Bend, Indiana, as amended on August 13, 1959, is hereby approved in the form set forth hereafter and the Mayor is hereby authorized to execute the same on behalf of the City of:South Bend, Indiana and The Housing Authority of the City of South Bend, Indiana, as amended on August 13, 1959, is hereby approved in the form set forth hereafter and the Mayor is hereby authorized to execute the same on behalf of the City and the City Clerk is hereby authorized to affix the Official Seal of the City to said amendment and to attest the same: AMENDMENT NO. TO COOPERATION AGREEMENT This amendatory Agreement entered into this day of , 1961, by and between The Housing Authority of the City of South Bend, South Bend, Indiana, (herein called "Local Authority ") and The City of South Bend, Indiana, (herein called "Municipality "), WITNESSETH: WHEREAS, the Municipality and the Local Authority have entered into a certain Cooperation Agreement dated September 11, 1956, and amended August 13, 1959, providing for aid and cooperation in respect to low -rent housing Projects developed and to be developed and operated by the Local Authority with the financial assistance of the Public Housing Administration (herein called "PHA "),and WHEREAS, the aforesaid Cooperation Agreement provides among other things that in respect to any Project for which no Annual Contributions Contract has been entered into prior to August 2, 1954 between the Local Authority and the PHA, the Local Authority would repay to the PHA and the Municipality on behalf of the local public bodies which have contributed to such Project in proportion to the aggregate contribution which the PHA and the local public bodies have made to such Project at the times and from the funds therein described; and WHEREAS, such repayment provisions were required by Sec. 18 (j) of the United States Housing Act of 1937, as added by the Housing Act of 1954 (68 Stat.590, 632) which requirement was repealed effective June 30, 1961 by the Housing. Act of 1961 (75 Stat. 149, 165); and WHEREAS, the Local Authority proposes to undertake the development and operation of one or more additional low -rent housing Projects to be initially covered by one or more annual contributions contracts with the PHA on or after June 30, 1961; and WHEREAS, the Local Authority and the Municipality desire to modify and amend the aforesaid Cooperation Agreement so as to make such repayment provisions inapplicable to Projects initially covered by an annual contributions contract on or after June 30, 1961; NOW, THEREFORE, the Local Authority and the Municipality do agree that the language preceding clause (1) of Section 1 of the aforesaid Cooperation Agreement be modified to read as follows: 1110. In addition to the Payments in Liew of Taxes and in further consideration for the public services and facilities furnished and to be furnished in respect to any low -rent housing Project for which an Annual Contributions Contract had been entered into prior to June 29, 1961, between the Local Authority and the PHA." RESOLUTION WHEREAS, there is need for increased liaison between the Common Council and the Board of Park Commissioners of the City of South Bend, and NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: That a Parks and Recreation Committeel of the Common Council consisting of five members be and is hereby appointed. /s/ T.
