HomeMy WebLinkAbout07-10-61 Council Meeting MinutesREGULAR MEETING JULY 10, 1961 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council - Chambers in the City Hall on Monday, July 10, 1961, at 9:12 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervison of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION The City Council % City Clerk City Hall South Bend, 1, Indiana Gentlemen: June 30, 1961 The Northern Indiana Chapter, of The American Institute of Architects, which also represents The St. Joseph Calley Architects, wish to go on record as indorsing Building Commissioner Mr. Verner Lane's proposed new Building Ordinanc which in the best interest of our community will replace the now outdated 1925 law. Report of Traffic Engineer Members of the Common Council July 5, 1961 South Bend City Hall South Bend, Indiana Gentlemen: At the regular meeting of the Common Council of the City of South Bend on June 12, 1961, Councilman Muszynski reques that an investigation be made to determine why inter -City trucks were using Olive Street between Western Avenue and Sample Street. Investigation was made by this department and "Through Trucks Prohibited" signs have been installed. Also, the police ll department traffic division has been notified to enforce these signs. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1962, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED favorable as amended. /s/ T. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole,, to whom was referred AN ORDINANCE CREATING AN OFFICIAL BUILDING CODE FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED favorable as amended. /s/ T. ORDINANCE NO. 4380 - - -61 AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1962, AS AMENDED. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4381 - - -61 AN ORDINANCE CREATING AN OFFICIAL BUILDING CODE FOR THE CIVIL CITY OF SOUTH BEND, INDIANA., AS AMENDED The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: July 10, 1961 The attached petition of Clarence W and Martha Dockery to rezone property generally described as being two adjacent parcels of land on the west side of Hickory Road 160 feet North of McKinley Avenue (U.S. 20) from "A" Residential Use District to "C" Commercial Use District and "B" Height and Area District was legally advertised under date of June 26, "'330 REGULAR MEETING 1961, and given public hearing under date of July 6, 1961. The following action was taken: JULY 10, 1961 After due consideration the Commission found that surrounding land use was predominantly commercial in character and that public welfare would best be served by commercial zoning of subject property. It was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. RLH /mah Attach. Councilman Muszynski seconded the motion. Motion carried. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: July 10, 1961 The attached petition of Robert Edwards, et al, to annex to the City of South Bend, Indiana the property generally described as being a parcel of land 660 feet north and south by 726 feet east and west at the northeast corner of Edison and Ironwood Roads was legally advertised under date of June 26, 1961 and given public hearing under date of July 6, 1961. The following action was taken: The Commission was of the opinion that the six determinants of annexation exists. ORDINANCES FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (McKinley & Hickory) -I- The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for sus- pension of rules. Councilman Muszynski seconded the motion. Motion lost upon the negative vote of Councilman Coleman. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 24, 1961. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (McKinley & Hickory (2) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion lost upon the negative vote of Councilman Coleman. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 24, 1961. Councilman Allen seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (NE CORNER IRONWOOD DRIVE AND EDISON ROAD - 11 acres more or less) The Ordinance was given first reading,by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 24, 1961. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE CITY CLERK, $339.00, POLICE DEPARTMENT, $1500.00, FIRE DEPARTMENT, $18,200.00, BOARD OF HEALTH, $1,000.00 The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the Ordinance be set for public hearing on August 14, 1961. Councilman Lehman seconded the motion. Motion.carried. There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Glass seconded the motion.
