HomeMy WebLinkAbout07-10-61 Council Committee of the Whole Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole, in the Council Chambers, City Hall, on Monday, July 10, 1961, at 8:04 P.M., with all members present. The meeting was called to order by Councilman T. W. Lehman, Chairman, who presided. ORDINANCE AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1962 This being the time heretofore set for public hearing on the above. Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Kroll made a motion to amend the salary Ordinance as follows: On page 2, Park Department, Recreation Director, strike $3,266.00 and insert $3,100.00; Assistant Recreation Directox strike $2,194.00 and insert $1,950.00; Secretary Recreation Director, strike $1,400.00 and insert $1,260.00; and on Page 4, Urban Redevelopment, Draftsman, strike $5,000.00 and insert $5,040.00. Councilman Glass seconded the motion. Motion carried. Miss Virginia Guthrie, Civic Planning Association, was heard. Councilman Kroll made a motion that the Ordinance, as amended, go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried ORDINANCE AN ORDINANCE CREATING AN OFFICIAL BUILDING CODE FOR THE CITY OF SOUTH BEND, INDIANA This being the time heretofore set for Public Hearing on the above Ordinance, Councilman Kroll made a motion, seconde by Councilman Allen, that the proposed Ordinance be amended, as follows: The Clerk read the following amendment: 1. Add to Section 1143.32 this sentence: A Class A, Class B, Class C or Class D license shall not be required for the sale, installation, use, maintenance, alteration or repair of window air co ditioning units of two (2) horsepower or less or electric baseboard, cable or panel heatinz uni 2. Change Sub - Section 113.1 of the Basic Building Code by adding the following sencence: Public utility poles wires, cables and related appurtenances not constituting a part of a building are exempt from the provisons of this Code. 4. Delete all of Section 1105.0 of the Basic Building Code. 5. Change Section 1704.73 to read as follows: An Appliance Dealer, within the meaning of this code, shall be any person who offers for sale to the general public, plumbing fixtures and appliances; who shall maintain a shop or store as an outlet for the sale of such fixtures and appliances; who contracts for the installation of water - softeners, water heaters, automatic clothes washing machines, automatic dishwashing machines, and garbage disposals in one -and two- family dwellings only; and who shall have passed the examination and be licensed by the Citv as herein required 6. Change Section 1708.31 to read as follows: The examination of applicants for license shall be in such form as the Board may deem necessary to determine fitness and ability of the applicant, in accordance with the rules and regulations as established by said Board: except that applicant for Appliance Dealer's License shall be given a written examination to determine his fitness and ability to install water - softeners water heaters automatic clothes washing machines2 automatic dishwashing machines and gar bage disposals in one -and two - family dwellings only. If the applicant shall, in the opinion of the Board, have satisfactorily passed the examination, said applicant shall be entitled to a license. 7. Change Section 1708.33 to read as follows: The provisions of this code requiring examination do not apply to any Master Plumber, or Journeyman Plumber qualified and licensed under the provisions of any ordinance or code heretofor.in effect. 8. Change 1704.12 to read as follows: Repairs or replacements involving a defective faucet or the working parts of a faucet and the emergency repair of leaks and the clearance of stoppages where no removal or alteration of Pipe or fixtures is involved may be made without permit. _ 9. Change 1708.4 to read as follows: The Plumber's Examination Board shall present each successful applicant with a certificate stating that said applicant is entitled to a license as Master Plumber, Journeyman Plumber, or as a Plumbing Appliance Dealer. Upon receipt of said certificate, along with bond and fee as herein required, the City Controller shall issue license to said successful applicant. The license as issued shall be in the name of the successful applicant and in the event the applicant id an employee of a company or corporation, may show the name of the employer. No license as such shall be issued in the name of a corporation or company. 10. In Section 7 of the adopting ordinance delete reference to Ordinance No. 4193 so that the same shall remain in full force and effect. : ouncilman Kroll added Item 11 to the proposed amendment as follows: 11. Sec. 1707.0 to read "Board to consist of one (1) master plumber, one (1) appliance dealer and the Building Commissioner." lotion carried. 323 COMMITTEE OF THE WHOLE MEETING REGULAR MEETING JULY 10, 1961 Proponents and opponents were given an opportunity to be heard thereon. Those who spoke were Mr. Joseph T. Helling, Attorney, representing the Plumbers; Mr. William E. Voor, Attorney, representing Water Softener Dealers. Councilman Kroll made a motion for a five minute recess. Councilman Glass seconded the motion. Motion carried. Meeting recessed at 8:50 P.M. Meeting reconvened at 9:08 P.M. Councilman Kroll -made a motion to delete Item 11 from the amendment. Councilman Coleman seconded the motion. Motion carried. Councilman Krueper made a motion, seconded by Councilman Kroll, to amend the amendment as follows: In Item 6 after the words.Appiiance Dealers License, insert the words: "Amd all appliance installers ", and after the words one -and two - family dwellings only, insert the words: "The Board to give said examination shall consist of the Building Commissioner, one (1) Master plumber and one (1) appliance dealer, said appointments to the Board to be made by the Mayor and they shall serve until their successors are appointed!. The remainder of said Item 6 shall be a new paragraph. Motion carried. Councilman Kroll made a motion that the Ordinance go to the Council as favorable, as amended. Councilman Ladewski seconded the motion. Motion carried. There being no further business to come before the Committee of the Whole, Councilman Muszynski_'made : aiihotibn that. meeting be adjourned.
