HomeMy WebLinkAbout06-12-61 Council Meeting MinutesREGULAR MEETING JUNE 12, 1961 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular session in the Council Chambers on Monday, June 12, 1961, at 8:14 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Lehman seconded the motion. Motion carried. PETITITON Petition of Riverview Development,;Inc., to rezone land on Northside Boulevard. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. PETITION Petition of Clarence and Martha Dockery to rezone land on Hickory Road north of McKinley Highway. (1). Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Clarence and Martha Dockery to rezone land on Hickory Road north of McKinley Highway. (2) Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. PETITION Petition of Robert Edwards et al to annex land at Ironwood Drive and Edison containing approximately eleven (11) acres. s Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. Motio carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE MORRIS CIVIC AUDITORIUM FUND AND THE BUILDING DEPARTMENT FUND $888.48, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. W. Lehman, Chairman June 12, 1961 Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Lehman seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE MORRIS CIVIC AUDITORIUM FUND AND THE BUILDING DEPARTMENT FUND $888.48 The Ordinance was given third reading. President Kroll asked for a roll call vote. Five Councilmen, Joseph Kroll, J. Chester Allen, Eugene Ladewski, Albert Tellson and Paul E. Krueper voted aye and Four Councilmen, Harold L. Cole- man, Walter Glass, T. W. Lehman and Chester Muszynski, voted nay. Mr. Smith, City Attorney, informed the Council thz an Ordinance relative to the appropriation of money required a two - thirds affirmative vote for passage. Councilman Glass moved to reconsider the vote. -Councilman Allen- seconded the motion. Motion carried. Councilman Glass made a motion that the third reading of the Ordinance be held on June 26, 1961. Councilman Lehman seconded the motion. Motion carried. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: June 9, 1961 The attached petition of Hartman Builders, Inc., and Thomas Szabo, Jr., to rezone Lots Numbered 23, 24 and 25 and Lots Numbered 46, 47 and 48 in Alward's Subdivision to the City of South Bend, Indiana, being generally described as in the 3300 block of Lincolnway West, from "B" Residential Use and "A" Height and Area District to "C" Commercial use and "E" Height and Area District was legally advertised under date of May 22, 1961 and given public hearing under date of June 1, 0961. The following action was taken: After due consideration the Commission found that: 1. The granting of the petition would result in a continuation of strip zoning. 2. Said zoning would face residential zoning and use on the opposite side of Lincolnway West. 3. Termination of existing zoning at the present point will be in the best interests of the area. 4. The motel is a logical and effective buffer between commercial use to the east and existing residential zoning to the west of subject property. 5. The Hartman property could logically and justifiably be used under their present zoning classification; that residential use exists on similar property in the vicinity. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended unfavorably to the Common Council. Very truly yours, CITY PLANNING COMMISSION /s/ Robert L. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (REAL ESTATE INVOLVED LOCATED ON THE SOUTH SIDE OF LINCOLNWAY WEST, BETWEEN IOWA AND RYER STREETS) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing, on June 26, 1961. Councilman Lehman seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE BOARD OF HEALTH FUND $1000.00 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on June 26, 1961. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE CREATING AN OFFICIAL BUILDING CODE FOR THE CIVIL CITY OF SOUTH BEND, INDIANA Councilman Muszynski made a motion that the Ordinance go to the Committee of the Whole for further study before it is given first and second reading. Councilman Tellson seconded the motion. Motion carried. 323 REGULAR MEETING DVQIIT TTTTnNT JUNE 12, 1961 A Resolution introduced at the May 8th meeting of the Council by Councilman Krueper was set for action at the May 22, 1961, meeting, and continued from that time until the meeting of June 12th. Councilman Krueper made a motion that the Resolution be put in the Committee of the Whole of the Council for study. Councilman Muszynski seconded the motion. Motion carried. OLD BUSINESS Councilman Muszynski complained that inter -city trucks are still using Olive Street even though Sample Street is now completed. He asked that an investigation and check be made and that something be done to alleviate this situation. There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Muszynski seconded the motion.
