HomeMy WebLinkAbout05-08-61 Council Meeting MinutesREGULAR MEETING MAY 8, 1961 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, on Monday, May 8, 1961, at 10:25 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL" PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend, Indiana: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION To the South Bend Common Council South Bend, Ind. Dear Sirs: ATTENTION: Joseph T. Kroll, Pres. 301 E. Haney Avenue South Bend, 14, Indiana May 5, 1961 I am writing in regard to the proposed appropriation of $16,000.00 for a Parking Survey. As I see it, the downtown area is fast becoming a "ghost" town mainly because of the lack of adequate, low -cost, public transportation. If you will think back to the time when we had good reasonable transportation to the downtown area, very few people bothered to get out their cars to go downtown -- -they took the bus, because they could get off right in the heart of the shopping area. Each time the Bus Co., increased fares people scouted around and got a ride elsewhere or pooled with other car drivers until now the buses carry very few passengers and service has been drastically curtailed. We who are widows living on Social Security have no transporation on Sunday and can't afford to take taxis - -can't even go to church on Sunday unless we beg someone for a lift. People wouldn't bother to go to the shopping centers on Sunday or after work if they could get this shopping done during the week because everyone likes to enjoy Sunday afternoon instead of making it a shopping jaunt. Besides, it's much pleasanter to shop downtown. A city the size of South Bend surely should be able to do something about it's public transportation. That is the real cause of all the congestion downtown, and no matter how many parking lots there are, they can't all be in the center of town, unless the city does go in for Municipal Parking. Better subsidize the Bus Co., and save the down- town Business establishments that are still there. Bus fares in New Orleans, La., are lOp and everybody rides the bus - -- there's no congestion of cars downtown, and a bus almost any time you want one. However, the Bus Co., the Elec. Co., and the Gas Co., operate as one entity. I really think if the City of South Bend cannot, itself, subsidize the Bus Co., it should make an effort to get some other company to do it.. The Associates Investment Co., Sears - Roebuck & Co., Romy Hammes, or some other well estab- lished concern. Yours for a greater Downtown South Bend, /s/ Mrs. C. R. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE APPROPRIATING FROM PARKING METER FEES AND FUNDS THE SUM OF $16,000.00 FOR AN OFF STREET PARKING SURVEY TO THE BOARD OF PUBLIC WORKS AND SAFETY TO THE CIVIL CITY OF SOUTH BEND, INDIANA, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED UNFAVORABLE. /s/ T. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED, (Self- service Laundries), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. W. Lehman, Chairman May 8, 1961. Councilman Glass made a motion that the report be accepted and placed on file. Councilman Ladewski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINAM E NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, (REAL ESTATE INVOLVED LOCATED ON WILLIAMS STREET, NAVARRE STREET, PORTAGE AVENUE), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE CONTINUED FOR TWO WEEKS. /s/ T. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE CONTROLLING THE OPERATION OF COIN - OPERATED DRY CLEAN ESTABLISHMENTS, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPOR UNFAVORABLE. /s/ T. ORDINANCE, THIRD READING AN ORDINANCE APPROPRIATING FROM PARKING METER FEES AND FUNDS. THE SUM OF $16,000.00 FOR AN OFF- STREET PARKING SURVEY TO THE L 0 S T BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA The Ordinance was given third reading and lost by a roll call vote of 5 nays (Councilmen - Ladewski, Tellson, Glass, Krueper and Muszynski) and 4 ayes (Councilmen Kroll, Allen, Coleman and Lehman). ORDINANCE NO. 4375 - - -61 AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Self- service Laundries) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE, THIRD READING AN ORDINANCE CONTROLLING THE OPERATION OF COIN - OPERATED DRY CLEANING L 0 S T ESTABLISHMENTS The Ordinance was given third reading and lost by a,roll call vote of 9 nays, 0 ayes. ORDINANCE, FIRST'AND SECOND READING AN ORDINANCE APPROVING A LEASE ENTERED INTO BY AND BETWEEN THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, HEREINAFTER REFERRED TO AS THE "LESSOR" AND SOUTH BEND SCREW PRODUCTS, INC., HEREINAFTER REFERRED TO AS THE "LESSEE" FOR THE PREMISES DESCRIBED AS: THAT PORTION OF EAST WASHINGTON STREET IN THE CITY OF SOUTH BEND, INDIANA, EXTENDING FROM THE ST. JOSEPH RIVER ON THE WEST TO THE EAST RACE ON THE EAST The Ordinance was given first reading by title and second reading in full. Councilman Krueper made a motion that the Ordinance be amended in that the legal description of said property include: "To exclude the area that would be the width of Gintz Avenue extended on the East." Councilman Lehman seconded the motion. Motion carried. Councilman Lehman made a motion that the Ordinance be set for public hearing on May 22, 1961. Councilman Muszynski seconded the motion. Motion carried. RESOLUTION RESOLUTION OF COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING UNDERTAKING OF SURVEYS AND PLANS FOR URBAN RENEWAL PROJECT ON THREE - FOURTHS CAPITAL GRANT BASIS AND FILING OF REQUEST FOR CONCURRENCE BY ADMINISTRATOR IN COMMENCEMENT THEREOF. WHEREAS, under Title I of the Housing Act of 1949, as amended, the Housing and Home Finance Administrator is authorized to extend financial assistance to local public agencies in the elimination and prevention of the spread of their slums and urban blight through the undertaking of urban renewal projects; and WHEREAS, it is desirable and in the public interest that the City of South Bend, Department of Redevelopmeni prepare surveys and .plans, in order to undertake and carry out an urban renewal project on a three- fourths capital grant basis pursuant to Title I in that area proposed as an Urban Renewal Area,, situated in the City of South Bend, County of St. Joseph, and State of Indiana, which is known as Chapin Street Area: NOW, THEREFORE, BE IT REXOLVED BY THE COMMON COUNCIL, CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: 1. That the proposed Urban Renewal Area described above is a slum, blighted, deteriorated, or deteriorat area appropriate for an urban renewal project and that the undertaking by the City of South Bend, Department of Redevelopment of the preparation of surveys and plans for an urban renewal project of the character contemplated by Section 110(c) of Title I in the proposed Urban Renewal Area is hereby approved. 2. That the financial assistance available under Title I to assist urban renewal projects will be needed to enable the City of South Bend, Department of Redevelopment to finance;.the undertaking of the proposed Project. 3. That it is cognizant of the conditions.that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title I, including those relating to the relocation of site occupants and the provision of local grants -in -aid and the requirement that as a condition to the execution of a contract for a loan or capital grant for an urban renewal project the locality must present to the Housing and Home Finance Administrator a workable program, as set forth in Section 101(c) of Title I, for utilizing appropriate public and private resources to eliminate and prevent the development or spread of slums and urban blight; and that it is th( sense of this body: (a) that a feasible method for the relocation of families displaced from the Urban Renewal Area, in conformity with the requirements of Title I, can be prepared, (b) that local grants -in -aid can and will be provide( in an amount which will be -not less than one - fourth of the net project cost of the Project and which, together with the Federal capital grant, will generally be equal to the difference between gross project cost and the proceeds or value of project land sold, leased, or retained for use in accordance with the urban renewal plan, and (c) that, in addition to the local grants -in -aid, there will be provided funds in an amount necessary to pay such costs of the Project (including but without being limited to the costs of title, appraisal, negotiating, and any other expenditure: incidental to the acquisition of land, surveys -and plans, legal services, taxes, etc., and the administrative and overhead expenses of the City of South Bend, Department of Redevelopment with respect to the project) which, pur- suant.to the proviso in Section 110(e) of Title I with respect to projects on a three- fourths capital grant basis, are excluded from gross project cost. (4) That the filing by City of South Bend, Department of Redevelopment of a request for concurrence by the Housing and Home Finance Administrator in the commencement of surveys and plans for an urban renewal project to be undertaken on a three- fourths capital grant basis in the proposed Urban Renewal Area described above is- hereby approved. /s/ Joseph T. Motion carried by a roll call vote of 9 ayes, 0 nays. Resolution Adopted. 31 REGULAR MEETING MAY 8, 1961 Councilman Krueper presented the following Resolution for action by the Council, RESOLUTION BE IT RESOLVED by the Common Council of the City of South Bend that WHEREAS, this Council has, at a meeting held this day, rejected an Ordinance appropriating $16,000.00 for an off - street parking survey, and WHEREAS, the Council is cognizant of the existence of certain deficiencies in the downtown area, and WHEREAS, heretofore the City of South Bend, through its various departments, has made various studies and assembled reports pertaining to or related to the downtown problem, and WHEREAS, the Council is desirous of assisting in solving said problems, NOW, THEREFORE, BE IT RESOLVED that the City Traffic Engineer and the City Plan Commission be and they are hereby requested to furnish and make available to the Council all studies and reports pertaining to traffic, on-street parking, off - street parking, traffic signals and such similar information that might enable the Council to have a better understanding of the existing situation and BE IT FURTHER RESOLVED That said Traffic Engineer and said City Plan Commission be, and they are further requested to make recommendations to this Council in regard to the above matters, and BE IT FURTHER RESOLVED THAT THE MAYOR OF SOUTH BEND and he is hereby requested to appoint a committee to include three members of this Council and such other members as he may determine for the purpose of securing the cooperation of the entire community in bettering the City of South Bend, and particularly the downtown area. Councilman Coleman seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Lehman made a motio to adjourn. Councilman Glass seconded the motion. Motion carried and the Regular meeting of the Common Council adjourned at 11:13 P.M.
