The meeting was called to order by Councilman T. W. Lehman, Chairman, who presided. ORDINANCE AN ORDINANCE APPROPRIATING FROM PARKING METER FEES AND FUNDS THE SUM OF $16,000.00 FOR AN OFF- STREET PARKING SURVEY TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA The Clerk read the following communication: To the Common Council May 8, 1961 City Hall South Bend, Indiana Gentlemen: RE: Off Street Parking Survey A request has been made that the Board of Public Works and Safety state its position with reference to the Off Street Parking Survey, if the Council made the required funds available to the Board. If these funds were made available, the Board would include the following in the Plans and Specifications: 1. Origin and destination study. 2. Use and occupancy study. 3. A study as to whether or not curb parking spaces are being properly used, whether time limits and costs are proper, whether more police enforcements should be applied, and whether use of "Meter Maids" should be recommended. 4. A study of one way streets to and from the downtown business area. 5. A survey of a method of expediting traffic. 6. A survey of parking problems in all neighborhood business areas. 7. A study to ascertain whether more parking meters are necessary and whether unoccupied space should be used for meters. 8. An overall study of all matters pertaining to off street parking needs to expedite traffic in the community. Respectfully submitted, /s/ Irving J. Smith Irving J. Smith, Chairman IJS :ES Board of Public Safety Chaifman--Lehman stated that since proponents and opponents were given an opportunity to be heard at the Apr11'24th meeting of the�Committee of the Whole, they would not be heard again. However, since the Attorneys for both sides had attended a meeting, which had Councilman Krueper as its chairman, both the attorneys and chairman should make a report. Mr. Nicholas Cholis, Attorney for the proponents, was heard. Mr. Louis Chapleau, Attorney for the opponents spoke. Councilman Allen moved that the Ordinance be amended as follows: "That there be added to Sec,tion,l, a new paragrpah numbered 2 stating: The said Off Street Parking Survey to include the following in the plans and specifications: 1. Origin and destignation study. 2. Use and occupancy study. 3. A study as to whether or not curb parking spaces are being properly used, whether time limits and costs are proper, whether more police enforcements should be applied, and whether use of "Meter Maids" should be recommended. 4. Councilman Muszynski made a motion that the Ordinance go to the Council as unfavorable. Councilman Krueper seconded the motion. Motion carried by a roll call vote of 5 ayes (Councilmen Ladewski, Tellson, Glass, Krueper and Muszynski) 4 nays, (Councilmen Kroll, Allen, Coleman and Lehman). ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Self- service Laundries) This being the time heretofore set for public "'hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Coleman made a motion that the Ordinance go to the Council as favorable. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNWON AS THE ZONING ORDINANCE OF THE.CITY OF SOUTH BEND, INDIANA, (REAL ESTATE INVOLVED LOCATED ON WILLIAMS STREET, NAVARRE STREET, PORTAGE AVENUE) Councilman Muszynski made a motion that the Ordinance be continued for two weeks. Councilman Tellson seconded the motion. Motion carried. 14 COMMITTEE OF THE WHOLE MEETING REGULAR MEETING MAY 8, 1961 ORDINANCE AN ORDINANCE CONTROLLING THE OPERATION OF COIN - OPERATED DRY - CLEANING ESTABLISHMENTS The Clerk read the following communication from the Building Commissioner: May 2, 1961 Common Council of the Civil City of South Bend, Indiana. Gentlemen: It has come to my attention that on Monday, April 24, you gave first and second reading to an ordinance which would require a licensed attendant in self - service coin - operated dry cleaning establishments. I have read the subject ordinance and find no objections to the provisions as set forth therein. However, I do wish to call your attention several other hazards of the operation which should possibly be regulated. You will note from the enclosed article which I wrote for a building officials organization, that certain other hazards exist. In view of this fact, it would seem advisable to include the other safety precautions mentioned in the article in the proposed ordinance. If you should have any further questions concerning this matter, I will be in attendance at your meeting on May 8th, at which time I would attempt to answer those questions. Smith, City Attorney, asked permission to make a statement to clarify the situation. Permission granted. Mr. Smith stated that he had prepared the Ordinance on regulating coin - operated dry - cleaning establishments because some weeks ago he was asked by the Council to do so. This being the time set for public hearing on the above Ordinance, proponents and opponents were given an opportunit to be heard thereon. Speaking in favor of the Ordinance were Charles Mintz, 534 Coquillard; Morton Ziker, 1708 Eas Wayne Street;,Leonard Opperman, 305 Hawthorne; Irwin Rubin, 1219 East Wayne Street South; Charles Scoglund, 329 Ostemo Place. Opponents to the Ordinance were M. Edward Doran, representing the Low -cost Laundry and.DryyCleining,. Association of South Bend; William B. White, Sales Training Manager for Whirlpool, Benton Harbor, Michigan; James Bark, 4305 Payne Drive, Midland, Michigan; Dr. Latham Crandall, 3600 West Indiana, Elkhart, Indiana; George W. Manue 289 Perry Street, Dover, New Jersey. Speaking in rebuttal were Irwin Rubin and Charles Skoglund. Councilman Krueper made a motion that the Ordinance go to the motion. Motion carried by a roll call vote of 5 ayes and.4 nays (Councilmen Kroll, Allen, Coleman and Lehman) the Council as unfavorable. Councilman Muszynski seconded (Councilmen Ladewski, Tellson, Glass, Krueper and Muszynski , There being no further business to come before the Committee of the Whole, Councilman Muszynski made a motion to adjourn.
