HomeMy WebLinkAbout04-27-61 Council Special Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in Special Session in the Council Chambers on Thursday, April 27, 1961, at 12 :10 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. The Clerk then read the call for a Special Meeting. CALL FOR A SPECIAL MEETING OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA We, the undersigned members of the Common Council, hereby call a Special Meeting of the Common Council of the City of South Bend, Indiana, to convene at the Council Chambers at the City Hall at 12 noon, on the 27th day of April, 1961, for the purpose of taking action on the following: APPROVING A SITE OR SITES FOR THE CONSTRUCTION OF A LOW RENT HOUSING PROJECT The Chief of Police or any member of the Police Force is hereby directed to forthwith serve a copy of this notice on each and every member of the Common Council and make due return of such service of said Special Meeting. ROLL CALL P V Q 0T MP T ANT PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski ABSENT: None A RESOLUTION APPROVING TWO SITES FOR THE CONSTRUCTION OF A LOW RENT HOUSING PROJECT CONSISTING OF APPROXIMATELY ONE HUNDRED EIGHTY -FIVE (185) UNITS, AND IN NO EVENT EXCEEDING TWO HUNDRED (200) UNITS, THE FIRST COMPRISING APPROXI- MATELY FIVE (5) ACRES OF LAND CONSISTING OF A TRIANGULAR PARCEL OF LAND BETWEEN WESTERN AVENUE AND THE NEW YORK CENTRAL RIGHT OF WAY WEST OF LAUREL STREET, IN THE CITY OF SOUTH BEND, INDIANA; AND THE SECOND SITE CONSISTING OF APPROXIMATELY SEVEN AND FIVE - TENTHS (7.5) ACRES OF LAND LYING NORTH OF SOUTH BEND AVENUE AND COMPRISING EIGHTEEN (18) LOTS IN THE HARTMAN AND WOODWORTH ADDITION TO THE CITY OF SOUTH BEND, INDIANA, AND A RECTANGULAR PARCEL OF LAND ONE HUNDRED NINETY -THREE (193) FEET IN DEPTH NORTH AND SOUTH, AND APPROXIMATELY ONE THOUSAND TWO HUNDRED FEET IN LENGTH, EAST AND WEST, LYING NORTH OF NAPOLEAN STREET BETWEEN WHAT WOULD BE THE EAST LINE OF GEORGIANNA IF EXTENDED, AND WHAT WOULD BE THE EAST LINE OF LOT NUMBERED THIRTY -ONE (31) IN THE HARTMAN AND WOODWORTH ADDITION, IF EXTENDED. WHEREAS, the City of South Bend, Indiana, has heretofore entered into a Cooperation Agreement with The Housing Authority of the City of South Bend, Indiana; WHEREAS, pursuant to the provisions of said Cooperation Agreement, The Housing Authority of South Bend, Indiana, has requested the City of South Bend, Indiana, to approve a site comprising approximately Five (5) acres of land located in the City of South Bend, St. Joseph County, Indiana; and described as follows, to -wit: A parcel of land bounded by a line starting at a point where the West line of Laurel Street intersects the Northerly line of the right of way line of the New York Central Railroad; thence North to a point where the West line of Laurel Street intersects the South line of Western Avenue; thence West along the South line of Western Avenue, a distance of approximately One Hundred Eighty (180) feet; thence Southwesterly along the center line of the abandoned right of way of the Grand Trunk Western Railroad Company to a point where said center line intersects with the Northerly right of way line of the New York Central Railroad; thence Southeasterly along the Northerly right of way line of said New York Central Railroad to the point of beginning, containing in all approximately Five (5) acres, and also to approve a site comprising approximately Seven and Five - Tenths (7.5) acres of land, as follows, to -wit: A parcel of land lying North of South Bend Avenue and comprising Eighteen (18) lots in the Hartman and Woodworth Addition to the City of South Bend, Indiana, and a rectangular parcel of land One Hundred Ninety -three (193) feet in depth North and South, and approximately One Thousand Two Hundred Feet (1,200') in length, East and West, lying North of Napolean Street between what would be the East line of Georgianna, if extended, and what would be the East line of Lot Numbered Thirty -one (31) if the Hartman and Woodworth Addition extended, for the purpose of constructing thereon a low -rent housing project consisting of approximately One Hundred Eighty- five (185) units, and not to exceed Two Hundred (200) units; WHEREAS, the Housing Committee of the Common Council of the City of South Bend, Indiana, has inspected said sites and has determined that they would be desirable locations for the construction of a low -rent housing project. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, That a site consisting of approximately Five (5) acres of land consisting of a triangular parcel of land between Western Avenue and the New York Central right of way West of Laurel Street; and a site consisting of approximately seven and five - tenths (7.5) acres of land lying North of South Bend Avenue embracing Lots Numbered Thirteen (13) to Eighteen (18), both inclusive, and Lots Numbered Twenty (20) to Thirty -one (31), both inclusive, in Hartman and Woodworth Addition, and also a rectangular parcel of land One Hundred Ninety -three (193) feet in depth North and South, and approximately One Thousand Two Hundred Feet (1,200') in length East and West, lying North of Napolean Street between what would be the East line of Georgianna, if extended, and what would be the East line of Lot Numbered Thirty -one (31) in the Hartman and Woodworth Addition, if extended, in the City of South Bend, Indiana, be and the same are hereby approved as desirable sites for a low -rent housing project consisting of approximately One Hundred Eighty -five (185) units an( not to exceed Two Hundred (200) units to be constructed by The Housing Authority of the City of South Bend, Indiana. s This Resolution shall be in full force and effect from and after its passage. Noble, City Clerk This resolution was approved and signed by me on the 27th day of April, 1961, at the hour of 2:35 o'clock P.M. /s/ Frank J Bruggner Frank J. Bruggner, Mayor of the City of South Bend, Indiana. The following persons being present were permitted to speak on the Resolution. In favor of the Resolution were: Lemuel H. Rouse, 1118 N. Burns Street; Ralph K. Weissert, 1010 Oak Ridge: Hattie Allen, 1243 South Bend Avenue, spoke against the Resolution as did Luther Pompey, 1043 Georgiana and Lonnie Luten, 824 West Monroe. Charles Howell, 1118 North Duey spoke in favor of the Resolution. Also..speaking in favor of the Resolution were Square Patterson, 422 S. Pine Street; Alan Pinato, 1241 Corby Boulevard; Roy Graham, 1050 Burns Avenue. Councilman Ladewski made the following statement for the record: "Our City and the University of Notre Dame have long enjoyed a friendly relationship. Through haste and lack of information, this relationship could possibly cease. I refer to the method in which the Rousing Authority seeks to acquire five acres of land that belong to the University of Notre Dame.. They.have future plans for this property and do not wish to sell. Many other schools have found themselves in the position of no room for future expansion. We can alleviate this situation by making public record the Housing Authority's statement that condemnation proceedings or undue pressure will not be used to acquire this property'." Mr. William E. Voor, Attorney for the Housing Authority, made the following statement for the record: "I said in my statemaEt, Mr. Ladewski and Members of the Common Council, that I did not think the Housing Authority would undertake to condemn the land of Notre Dame. I did not make any flat statement that they would not because I am only the Housing Authority and I merely stated that I did not think they would." Councilman Coleman moved the Adoption of the Resolution. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes (Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski), 0 nays. There being no further business to come before the Special Meeting of the Council, Councilman. Lehman made a motion to adjourn. Councilman Muszynski seconded the motion.
