HomeMy WebLinkAbout04-24-61 Council Meeting MinutesMKA.LL 4,*. 17U1 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, in the City Hall, on Monday, April 24, 1961, at 10:53 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION Committee Councilman Lehman seconded the Memorandum to the City Clerk for the attention of Council Members stating that the 1961 Annual Conference of the United States Conference of Mayors will be held at The Statler Hilton, Washington, D.C., June 11 -14. 'Councilman Lehman made a motion that the communication be accepted and placed on file. Councilman Muszynski s the motion. Motion carried. PETITION Petition of Hartman Builders, Inc., and Thomas Szabo, Jr., to rezone land in the 3300 Block of.Lincolnway West. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING - ORDINANCE (South Bend Avenue between Burns and Duey) The Ordinance was given third reading and lost by a roll call vote oa 8 nays, 1 aye (Councilman Allen). REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indianan Gentlemen: April 17, 1961 The undersigned hereby petitions your honorable body to amend Section "4 -A" of Zoning Ordinance No. 3702, (as amended), commonly known as the Zoning Ordinance of the City of South Bend, Indiana by the addition thereto of the following:(6) self- service laundry establishments, provided: 1. Said use is located on a lot adjoining a major thoroughfare as designated by the Major Thoroughfare Plat for the City of South Bend. 2. Illuminated signs shall not have source of light visible nor project intermittent or flashing lights. 3. One improved off - street parking space shall be provided on the same lot as the principal building for every three principal operating machines. 4. Before the issuance of a building permit the proposed parking area and all proposed improvements thereto shall be submitted to the Board for approval,-and the same shall be subject to any reasonable conditions that the Board may impose. /s/ Chester Muszynski Chester Muszynski Councilman Lehman made a motion that the report be accepted and placed on file. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: April 14, 1961 The attached petition of Michael and Elizabeth Ett1, et al, to rezone Lots Numbered Twenty -five (25) through Thirty -two (32), inclusive, in Oakside Second Addition, being more generally described as the west side of Michigan Straet, between Eckman and Oakside Street, from "B" Residential Use District and "A" Height and Area District to e�Tn ) S REPORT OF CITY PLANNING COMMISSION (continued) "C" Commercial Use District and "D" Height and Area District, was legally advertised under date of April 6, 1961. After due consideration the Commission found the subject property to be zoned commercially on all sides except the west which is zoned light industrial. The Commission also found very predominant commercial use in the property immediately surrounding except to the west wherein there is a small amount of commercial and industrial use. The Commission found that in view of the surrounding land uses and zoning there is substantial justice in granting this petition. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Self- service Laundry Establishments) The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the Ordinance be set for public Hearing on May 8, 1961. Councilman Allen seconded the motion. Motion carried. ORDINANCE NO. 4374 - - -61 AN ORDINANCE AMENDING ORDINANCE NO. 37021 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (S. Michigan between Oakside and Eckman) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Clerk then read Ordinance No. 4374 - - -61 for its thrid reading and it was passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE CONTROLLING THE OPERATION OF COIN - OPERATED DRY - CLEANING ESTABLISHMENTS The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the Ordinance-be set for public hearing on May 8, 1961. Councilman Muszynski seconded the motion. Motion carried. RESOLUTION - -- -TIME R E S O L U T I O N WHEREAS, there is now existing Central Standard Time throughout the year in the State of Indiana, and WHEREAS, it is desirable for the City of South Bend to maintain the same time as Chicago and other cities in the immediate area, NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: That the people of the City of South Bend and its environs, schools, churches, governmental units and departments of governments, courts, business, commerce and industry are requested for the sake of uniformity beginning at 2 :00 o'clock a.m. on the last Sunday in April of each year to 2:00 o'clock a.m. on the last Sunday in October of each year to commence each day and conduct all business in harmony with Eastern Standard Time. /s/ JOSEPH T. RESOLUTION - -- PUBLIC HOUSING A RESOLUTION APPROVING THE SITES FOR THE CONSTRUCTION OF A LOW RENT HOUSING PROJECT CONSISTING OF APPROXIMATELY ONE HUNDRED EIGHTY -FIVE (185) UNITS, AND IN NO EVENT EXCEEDING TWO HUNDRED (200) UNITS, THE FIRST COMPRISING APPROXIMATELY FIVE (5) ACRES OF LAND CONSISTING OF A TRIANGULAR PARCEL OF LAND BETWEEN WESTERN AVENUE AND THE NEW YORK CENTRAL RIGHT OF WAY WEST OF LAUREL STREET, IN THE CITY OF SOUTH BEND, INDIANA;;AND THE SECOND SITE CONSISTING OF APPROXIMATELY SEVEN AND FIVE - TENTHS (7.5) ACRES OF LAND LYING NORTH OF SOUTH BEND AVENUE AND COMPRISING EIGHTEEN (18) LOTS IN THE HARTMAN AND WOODWORTH ADDITION TO THE CITY OF SOUTH BEND, INDIANA, AND A RECTANGULAR PARCEL AND LAND ONE HUNDRED NINETY -THREE (193) FEET IN DEPTH NORTH AND SOUTH, AND APPROXIMATELY ONE THOUSAND TWO HUNDRED FEET IN LENGTH, EAST AND WEST, LYING NORTH OF NAPOLEON STREET BETWEEN WHAT WOULD BE THE EAST LINE OF GEORGIANNA IF EXTENDED, AND WHAT WOULD BE THE EAST LINE OF LOT NUMBERED THIRTY -ONE (31) IN THE HARTMAN AND WOODWORTH ADDITION, IF EXTENDED, Councilman Krueper moved to amend the Resolution by deleting "...and a site consisting of approximately seven and five- tenths (7.5) acres of land lying North of South Bend Avenue embracing Lots Numbered Thirteen (13) to Eighteen (18), both inclusive, and Lots Numbered Twenty (20) to Thirty -one (31), both inclusive, in Hartman and Woodworth Addition, and also a rectangular parcel of land One Hundred Ninety -three (193) feet in depth North and South, and approximately One Thousand Two Hundred Feed (1,200') in length East and West, lying North of Napoleon Street between what would be the East line of Georgianna, if extended, and what would be the East line of Lot Numbered Thirty -one (31) in the Hartman and Woodworth Addition, if extended;" and, to change the number of units from One Hundred and Eighty -five (185) units not to exceed Two Hundred (200) units to Seventy -five (75) units not to exceed One Hundred a. Fifty (150) Units,. or whatever number can be built on the remaining land. Councilman Ladewski seconded the motion. Motion lost upon a roll call vote of 5 nays (Councilmen Kroll, Allen, Tellson, Coleman and Muszynski), 4 ayes, (Councilmen Ladewski, Glass, Krueper and Lehman). Those who spoke in favor of the Resolution were William E. Voor, Rabbi Schulman and Mr. Jesse Dickinson. Councilman Muszynski made a motion for adoption of the Resolution. Councilman Allen seconded the motion. Motion lost upon a roll call vote of 5 nays (Councilmen Ladewski, Tellson, Glass, Krueper and Lehman) and 4 ayes (Councilmen Kroll, Allen, Coleman and Muszynski). RESOLUTION - -- MICHAEL DE KOVATS DAY WHEREAS: The freedoms and liberties enjoyed by Americans today spring from the sacrifices of the patriots of the American Revolution who were of many races and nationalities; and WHEREAS, in that early struggle of our country to achieve her independence, One Colonel Michael DeKovats, a Hungarian patriot serving without pay, was killed in action on May 11, 1778, at Charleston, South Carolina; and WHEREAS, today the people of the homeland of Michael DeKovats and those of many other countries are deptri of freedom and their liberties suppressed for which DeKovats gave his life on our soil; and WHEREAS, in this age when the freedom and liberty of the entire world is threatened by the forces of tyrann it is proper that we take note of the service and sacrifice of Michael DeKovats in order to gain inspiration in our fight against the forces of tyranny which would deptrive us of these cherished freedoms. NOW, THEREFORE, I, Frank J. Bruggner, Mayor of the City of South Bend, State of Indiana, do hereby proclaim Thursday, May 11th, 1961, as "MICHAEL DE KOVATS DAY'.' and that. "the'Mayor of said City, by appropriate proclamation, commemorate the life and sacrifice of that hero of the American Revolution. NEW BUSINESS A letter from Robert Stephan, Attorney, Addressed to Councilman Allen relative to the Northwest-Little Leage, was placed in the Grievance Committee. There being no further business to come before the Council, Councilman Ladewski made a motion to adjourn. Council Krueper seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 12:43 A.M.
