MARCH 271 1961 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers,:'Monday, March 27, 1961, at 8:19 P.M., with all members present except Councilman Glass. The meeting-was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Krueper, Lehman and Muszynski. ABSENT: Councilman Glass REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision.of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Motion carried. � 302 REGULAR MEETING COMMUNICATION MARCH 27, 1961 Communication from Harold E. Wagner, Jr., opposing the proposed annexation of the Airport and surrounding land. Councilman Lehman made a motion that the communication be accepted and placed on file. Councilman Allen seconded the motion. Motion carried. PETITION Petition of The First Bank and Trust Company of South Bend, Indiana, to annex land North of the Toll Road and West of Roseland. Councilman Lehman made a motion that the peitition be referred to the City Planning Commission. Councilman Ladewski seconded the motion. Motion carried. PETITION Petition of Michael Ettl, et al, to rezone land on the East side of Michigan Street in the 2700 block which lies between Eckman and Oakside. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE STREET AND TRAFF FUND (Off Street Parking Survey), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE WITHDRAWN. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Parochial Schools), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED favorable. ORDINANCE NO. 4368 - - -61 AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Parochial Schools) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). ORDINANCE NO. 4369 - - -61 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SUM OF $2,500.00 FROM THE GENERAL FUND TO THE BOARD OF HEALTH The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). ORDINANCE NO. 4370 - - -61 AN ORDINANCE AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY THE MUNICIPAL CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA,(South.of Pokagon and Northwest of State Road 31) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). ORDINANCE NO. 4371 - - -61 AN ORDINANCE AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY THE MUNICIPAL CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA (South of Angela and North of Pokagon) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: March 23, 1961 The attached proposed ordinance originated by the Common Council to annex to the City of South Bend, Indiana, the property generally described as bounded on the north by the east -west center section line of Sections 28 and 29 T. 38 N., R.2 E, and the Indiana Toll Road; on the east by Portage Avenue and the present City Limits; on the south by the present City Limits and Lincolnway West and on the west by Butternut Road, containing approximately 1,544 acres was legally advertised on February 28, 1961 and given two public hearings under the dates of October 27, 1960 and March 2, 1961. In addition to the public hearings two meetings were held between the Planning Commission's Committee on Annexation and a committee of residents from the proposed annexation area. The following action was taken: After due consideration the Commission found that in their opinion: 1. The annexation is in the best interests of the city and of the territory to be annexed. 2. The area is urban in character, being an economic and social part of the annexing city. 3. The city is financially able to provide municipal services to the annexed area within the reasonably near future. 4. The area sought to be annexed is needed for development of the city in the reasonably near future. 5. The lines of the annexation are so drawn as to form a compact area abutting the municipality. It was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably_ to the Common Council. Very truly yours, CITY PLANNING COMMISSION Is/ Robert L. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council March 24, 1961 City of South Bend South Bend, Indiana Gentlemen: The attached petition of Marjorie Drinski to rezone a part of Lot Numbered Five (5) as shown on the recorded plat of ` Burrough's Subdivision of Bank Out Lot One Hundred Fifteen (115) of the Third Plat of the Out Lots to the Town, now City of South Bend, described as follows: Beginning at a point Sixty -four (64) feet south of the northwest corner of said Lot Numbered 5 thence south a distance of Thirty -seven and One Tenth (37.1) feet, thence southeasterly a distance of One Hundred Fifty -seven (157) feet, thence northeasterly on the south boundary line of said Lot Numbered Five (5) a distance of Two and Five Tenths (2.5) feet, thence north to a point directly east of the place of beginnin thence west a distance of Seventy -three (73) feet to the place of beginning which said description also includes the south portion of the west one -half of the vacated alley lying east of and adjoining said Lot Numbered Five (5), excepting therefrom that part of said lot taken for the opening of William Street, from "C -1" Commercial Use District to "C" Commercial Use District was legally advertised under date of February 20, 1961 and given public hearing under date of March 2, 1961. After due consideration the Commission found there to be a lack of demonstrated need for additional "C" Commercial zoning in the area. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE APPROPRIATING FROM PARKING METER FEES AND FUNDS THE SUM OF $16,000.00 FOR AN OFF- STREET PARKING SURVEY TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinanca be set for public hearing at the next regular meeting of the Council. Councilman Ladewski seconded the motion. Motion. carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS '(Airport and land adjacent thereto) The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the Ordinance be set for public hearing at the next regular meeting of the Council. Councilman Lehman seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (REAL ESTATE INVOLVED LOCATED ON WILLIAMS STREE, NAVARRE STREET AND PORTAGE AVENUE) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing at the next regular meeting of the Council. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE FIRE DEPARTMENT $1,800.00 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing at the next regular meeting of the Council. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE (South Bend Avenue between Burns and Duey) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public bearing at the next regular meeting of the Council. Councilman Krueper seconded the motion. Motion carried. Corporal Miller, Coordinator for the Mayor's Traffic Commissionfled the following communications: Mr. Joseph Kroll, President Common Council City of South Bend, Indiana Dear Sir: March 27, 1961 The members of the Mayor's Citizens Traffic Commission hereby respectfully request permission of the council to hol the weekly sessions of the "Drivers Improvement School" in the council chambers. School sessions to be held each Wednesday from 7:00 P.M., to 9:00 P.M., and each Saturday-from 10:00 A.M. to noon. Permission is also requested to store our equipment in the council storage room of which a suitable lock with keys to be given to the council - members. The traffic school is intended for all cizitens of this community on a volunteer basis as well as those students assigned by the city court. RWM /md Respectfully submitted, Albert V. Dear Sir: MARCH 27, 1961 March 27, 1961 30 The Members of the Mayor's Citizen Traffic Commission respectfully invite the umbers of the Common Council to attend the opening session of the "Driver Improvement School ", to be held Wednesday, April 5, 1961, at 7 :00 P.M., Sharp in the council chambers. New Business Councilman Lehman made a motion that the next regular meeting of the Council be cancelled since the members will be attending the Press Club Hoaxes on April 10, 1961. Councilman Muszynski seconded the motion. Motion carried. r - Councilman Lehman presented a copy of a letter addressed to Mayor Bruggner from the Chamber of Commerce, signed by John A. Toth, President, relative to an ordinance before the Council appropriating money for a parking survey. Councilman Lehman made a motion that the Clerk make copies of the letter and furnish same to each Councilman. Council man Muszynski seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Krueper made a motion to adjourn. Councilman Lehman seconded the motion.
