Be it remembered that the Common Council of the City of South Bend Indiana, met in Regular Session in the Council Chambers, City Hall, On Monday, March 13, 1961, with all members present. The meeting was called to order at 9:42 P.M., by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervison of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Lehman seconded the motion. Motion carried. COMMUNICATIONS PATROL BOAT - ST. JOSEPH RIVER Michiana Watershed, Incorporated 129 North Michigan Street South Bend, 1, Indiana March 10, 1961 RESOLUTION OF THE BOARD OF GOVERNORS OF MICHIANA WATERSHED INC. WHEREAS the increasing use of the St. Joseph River by boaters is creating an increasingly serious hazard to life and limb; and WHEREAS the only effective way to police the boat traffic on any body of water is from a police boat; NOW, THEREFORE, Be it resolved by the Board of Governors of MICHIANA WATERSHED, INC., that the appropriate governmental bodies of St. Joseph County, Indiana be, and they are hereby urged to provide their police with the equipment necessary adequately to patrol the St. Joseph River and to police the boat traffic thereon. Jefferson Road City Council Mishawaka, Indiana City Hall March 10, 1961 South Bend, Indiana Gentlemen: Speaking for hundreds of river front residents we feel some additional comments are necessary with reference to the subject of boating on the St. Joseph River. On Monday, March 6th the South Bend Tribune had an editorial entitled "River Patrol Question" and another article "Patrol Boat Plan Wins 2 -Way O.K. ". People who are running boats on the river are making life miserable for the river -front residents - washing out shore- lines, driving away wildlife, washing waves over piers so many cannot use their waterfronts anymore, etc. The wild boaters are violating the good state boating law that we have, also the county ordinances, and federal laws pertaining to wild life. The law states: "All peace officers shall enforce this law ". City and county law enforcing officers should enforce this present law. The editorial in the Tribune asks whether a patrol is actually needed. They state that two studies were made last summer with the conclusion that a patrol is not needed. We wonder how often and at what time of day and day of the week the studies were made. Any summer evening (given enough time for the people to get home from work, eat supper and into their boat).we can show you a quite narrow place in the river where "smarties" congregate with their high powered boats and circle and churn the water so there is so much motor buzzing and churning waves that it is impossib to sit within five feet of one's own shoreline without getting wet. If the Common Council wants a "convincing bill of barticulars ",,there are enoughh residents along the river, and enough organizations and conservation clubs who will be glad to speak out. If South Bend now has a patrol Boat ordered, Mishawaka and the County should also have a boat available at all times (in the water). A few arrests with heavy fines would show all the boaters that the law will be enforced. A license plate similar to car plates (short numbers printed large) would make it easy to report a boat and the fee would bring money in to help pay the extra law enforcing officer. We don't think anyone is "rushing whimsically into patroling the river during the boating season ". Instead of a plea- sant body of water where sensible boats ran. up and down the river, some people fished, some rowed quietly around, duc paddled around and people sat on the shore and enjoyed the summer, the river has now become a "roadway" for a bunch of high powered boats flinging skiers close to piers, churning the water in circles and seeing how close to the shore they can go. Highways cannot be used this way for cars, why does the river have to be left for the "lawless ". REPORT OF BOARD OF PUBLIC WORKS AND SAFETY To the Common Council City of South Bend Gentlemen: March 7, 1961 With reference to your Directive of February 28, 1961, concerning the request of Councilman Glass for a St. Joseph River Patrol, referred to the Board of Public Works & Safety, the following action was taken at the regular meeting o the Board of Public Works & Safety on Monday, March 6, 1961: ST. JOSEPH RIVER PATROL It appearing to the Board that members of the South Bend Common Council and the Police Department met with reference to the St. Joseph River .control, the Board is advised that Councilman Tellson made a motion, seconded by Councilman Glass, and carried, that the City purchase a boat for such control and the Park Department supervise the policing. After review, the Board hereby accepts the proposal and will confirm the action of said Councilmen and Police Depart- ment, subject to Park Board Supervision. A motion by Councilman Krueper that the Traffic Engineer make safety signs and post same was seconded by Councilman Tellson and carried. The Board approved Councilman Krueper's motion and asks Traffic Engineer to post signs at strategic locations in accordance with said motion. Complaint of Councilman Muszynski concerning dogs running at large in the 3700 block of Belle Vista and the 800 block of Wellington and Kenmore. Item II. Request of Councilman Lehman for a check on dogs in the Fifth District. 1 At the regular meeting of the Board of Public Works & Safety on Monday, March 6, 1961 this Directive was examined and referred to the Department of Health for investigation and report. REPORT OF BOARD OF HEALTH Att: Councilman Muszynski Att: Councilman Lehman 3 -13 -61 Reference the above complaint, the Board of Health, has received numerous complaints on the above neighbor -hoods and districts. This matter has been taken up and advised to the Humane Society. Mr. Gilbert, of the humane society is aware of the fact and has his men trying to pick up the dogs. Respectfully submitted, Sgt. A. M. REPORT OF CITY ATTORNEY South Bend Common Council City Hall South Bend, Indiana ATTN: Freda Noble, Clerk Gentlemen: March 2, 1961 At the meeting of the Common Council held on the 27th day of February, 1961, a communication addressed to Alex Andrzejewski, Chief of the South Bend Fire Department, was read to the Common Council in reference to coin - operated cleansing machines being used in South Bend and the toxic, noxious and poisonous solvents used within these machines. You will recall you referred this.letter to my office inasmuch as I informed you I was meeting with individuals ac- quainted with this particular field. I wish to call your attention to the fact I have just completed a conference with Mr. Charles Mintz, an officer of MARCH 13,_1961 the Swank Dry Cleaners Inc., and Leonard Opperman, an officer of Sunshine Cleaners. They have submitted to me information disseminated by their national organization setting out a very serious health and safety problem to the community in reference to said coin - operated drycleaning machines. From their discussion, as well as the examination of the materials submitted, it would be my thinking this Council should make a study in reference to the operation of businesses containing coin - operated drycleaning machines. I' would respectfully call your attention to the fact that it is a matter of controlling the operation rather than prohibition. It would be necessary, from my observation, for an attendant to be present in each building where a coin - operated drycleaning machine is placed. I am making a study of this matter as well as conditions in other parts of the United States and I will, subject to your approval, submit to you a proposed ordinance for the introduction of control of this type of operation. Smith City Attorney Councilman Allen made a motion to accept the report of the City Attorney and that the City Attorney be requested to continue his investigation and that it be left to the discretion of the City Attorney to prepare a proper form of Ordinance to present to the Council. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE TO AMEND AN ORDINANCE ESTABLISHING A FIXED MILEAGE RATE FOR REIMBURSEMENT FOR CITY OFFICIALS AND EMPLOYEES IN THE USE OF PRIVATE CONVEYANCES FOR CITY BUSINESS, TO AMEND ORDINANCE NO. 3977, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. REPORT.OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE, AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY THE MUNICIPAL CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, DESCRIBED AS FOLLOWS: All of the East Washington Street right of way which lies between the East race and the St. Joseph River, subject to air rights and sewer easements, all in the City of South Bend, St. Joseph County, State of Indiana, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED That Mr. Krueper withdrew his motion to set Ordinance for Public Hearing. Mr. Glass withdrew his second to motion. Mr. Kroll cD nfirmed the above action seconded by Mr. Ladewski. March 13, 1961 /s/ T. W. Councilman Coleman made a motion to withdraw the Ordinance for the sale of Municipally owned land described above. Councilman Ladewski seconded the motion. Motion carried. Ordinance withdrawn. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred an Ordinance FOR ADDITIONAL APPROPRIATIONS IN THE STREET AND TRAFF FUND (Off Street Parking), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED that it be held in Committee for further study. ORDINANCE NO. 4367 - - -61 AN ORDINANCE TO AMEND AN ORDINANCE ESTABLISHING A FIXED MILEAGE RATE FOR REIMBURSEMENT FOR CITY OFFICIALS AND EMPLOYEES IN THE USE OF PRIVATE CONVEYANCES FOR CITY BUSINESS, TO AMEND ORDINANCE NO. 3977 Che Ordinance was given third reading and passed by a roll call.vote of 8 ayes, 0 nays, 1 absent,(Councilman Lehman vas called from the meeting and therefore absent when the vote was taken). 1EPORT OF CITY PLANNING COMMISSION 'he Honorable Common Council March 10, 1961 ;ity of South Bend, South Bend, Indiana ,entlemen: 'he attached proposed Ordinance originated by the City Planning Commission relative to Section "17A" of Ordinance f 300 REGULAR MEETING MARCH 13, 1961 No. 3702, (as amended) commonly known as the Zoning Ordinance of the City of South Bend, Indiana was legally adver- tised on February 20, 1961, and given public hearing under date of March 2, 1961. The following action• was taken: After due consideration the Commission found that substantial justice would be done by the amendment of Ordinance No. 3702, as proposed in said ordinance. It was therefore duly moved, seconded and unanimously carried that the proposed ordinance be approved and submitted to the Common Council for adoption. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Parochial Schools) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on March 27, 1961. Councilman Glass seconded the motion. Motion carried. OLD BUSINESS Councilman Tellson rose to ask the Council to again consider his suggestion to remove two parking meters from in front of the Public Library for the purpose of creating a loading zone. Councilman Allen made a motion that the matter be referred to the Traffic and Transportation Committee of the Council. Councilman Tellson seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Muszynski made a motion to adjourn. Counci Allen seconded the motion.
