Home My WebLink About03-13-61 Council Committee of the Whole Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers on Monday, March 13, 1961, at 8:05 P.M., with all members present. The meeting was called to order by Councilman T. W. Lehman, Chairman, who presided. ORDINANCE AN ORDINANCE TO AMEND AN ORDINANCE ESTABLISHING A FIXED MILEAGE RATE FOR REIMBURSEMENT FOR CITY OFFICIALS AND EMPLOYEES IN THE USE OF PRIVATE CONVEYANCES FOR CITY BUSINESS, TO AMEND ORDINANCE NO. 3977 This being the time previously set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Miss Virginia Guthrie, Executive Secretary of the South Bend Civic Planning Association, was heard. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. Council- man Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY THE MUNICIPAL CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, DESCRIBED AS FOLLOWS: All of the East Washington Street right of way which lies between the East race and the St. Joseph River, subject to air rights and sewer easements, all in the City of South Bend, St. Joseph County, State of Indiana. This being the time previously set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Krueper withdrew his motion to set the Ordinance for public hearing. Councilman Glass withdrew his second to the motion. Councilman Kroll made a motion to confirm the action. Councilor Ladewski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE STREET AND TRAFFIC FUND (Off Street Parking Survey) This being the time previously set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. The Clerk read a Resolution against the expenditure of city funds for an off - street parking survey and opposed to the City of South Bend entering into Municipal Parking, said resolution bears 102 signatures. A Resolution of the South Michigan Street Businessmen's Association, signed by Evelyn Kaetzer and Howard Sigrist, was read indicating that their Association is opposed to the City of South Bend spending money for an off - street parking survey and to Municipal Parking. A Resolution of the Rum Village Businessmen's Association, signed by Mathew Horvath, Jr., Alex Kobik, George M. Tschida, Myron Ransom, John S. Gruber and Charles M. Bakos, was read indicating that their Association is opposed to the City of South Bend spending money for an off - street parking survey and to Municipal Parking. A Resolution of the Portage Avenue Businessmen's Association, signed by Donald W. Huff, Joseph T. Serge and J. G. Borden, was read indicating that their Association is opposed to the City of South Bend spending money for an off - street parking survey and to Municipal Parking. A Resolution of the River Park Business Men's Association, signed by Donald F. Erhardt, President and Jack Watson, Secretary, was read indicating that their Association is opposed to the City of South Bend spending money for an off - street parking survey and to Municipal Parking. The following communication for the South Bend Civic Planning Association, Inc., was read: Committee of the Whole Common Council City of South Bend, Indiana Gentlemen: March 13, 1961 The Ordinance. appropriating $16,000.00 for an Off- street Parking Survey in the Street and Traffic Fund budget is before you for public hearing this evening.--.We note that the ordinance does not state where the funds are to be derived from, though some have said they are to be taken for the Parking Meter receipts. Because it is important for you, particularly, and the general public, to know how this is to be financed we present the following information: Street and Traffic Fund Budget for 1961 Balance in Fund January 1, 1961 M V H Distribution by state (estimated) Transfer from Parking Meter receipts Parking Meter Fund budget for 1961 32,250.00 Transfer to Street & Traffic Fund 82,000.00 Balance in Fund January 1, 1961 Receipts 1960 (no estimate for 1961) $1,104,795.04 $ 99,953.28 920,729.46 82,000.00 1,102,682 74 $ .- 2,112.30 31,012.60 114,250.00 $ 114,250.00 $ 145,262.60 This indicates that there would be sufficient funds to appropriate for a Survey, but such appropriation must be made from Meter Fund. We would state, however, that the actual M V H January distribution was $1,345.49 less than the amount anticipated when the budget was approved and that if this is a trend which. -would continue all year it will directly affect the Street and Traffic Fund which this year does not have a property tax rate. In addition to the above information, we mailed to our members and subscribers a memo and card questionaire (copy of which was sent you) and here is a tabulation of the replies totalling 175 card and two phone calls out of 838 mailed Q. Is there enough downtown parking now? 88 yes; 72 no; 16 no opinion; 1 yes and no. Q. Who should provide more ?. Government 28; Downtown Business 104; Both 5; No opinion 40. Q. A statement was presented by John A. Toth, President of the Chamber of Commerce of South Bend, Inc., endorsing having a competent and impartial survey of the current situation with respect to parking and traffic conditions in the cen- tral business district. - Speaking in favor of the proposed Ordinance were the following: Mr. Nicholas P. Cholis, Attorney, St. Joseph Bank Building; Mr. Albert Meilstrup, 1252 Sunnymede Avenue, South Bend, Indiana; Mr. Sam Dunnuck, Jr., from G. E. Meyer and Son, 209 South Main Street,.South Bend, Indiana; Dan Clark, who owns property at 104 North Michigan Street, South Bend, Indiana; Ernest F. Greenwood, who owns Ernies" Supermarkets; Kenneth Freshley, 2520 Pleasant Street; Mr. John A. Toth of the Chamber of Commerce; Mr. Robert Fischgrund, 1205 Garland Road, Treasurer of the Downtown Council; Vito Girone, Associate Professor of Architecture at Notre Dame; Jacob Burke, 559 River Avenue; Byron W. Sheets, 1425 E. LaSalle Avenue, who operates a business at 136 North Michigan Street; J. E.. Barkley, 1202 East Victoria; Dick Albright, 728 Marquette; Mary Sweeney, 102 West North Shore Drive. Speaking in opposition to the proposed Ordinance were Mr. Louis C. Chapleau, Attorney for the South Bend Parking Company; Mr. William E. Voor, Attorney representing The Green Arrow Parking Company of South Bend; Mr. Donald F. Erhardt, President of the River Park Business Men's Association. Mr. Jacob Mitchelin, 3820 South Michigan Street stated. that he was neither for nor against the proposed Ordinance by that he has a plan which would provide off - street parking and would like to present it to the Council. No action was taken. Speaking in rebuttal was Mr. Nicholas Cholis, Attorney. Also heard was Mr. Phillip Welber, President of the Down -To Council, Inc., and President of Robertson's Department Store. Councilman Kroll made a motion for a.five minute recess. Councilman Krueper seconded the motion. Motion carried. Recess granted at 9:30 P.M. The Committee of the Whole Meeting reconvened at 9:39 P.M. Councilman Allen made a motion that the Ordinance be held in Committee for further Study. Councilman Kroll seconded the motion. Motion carried. There being no further business to come before the Committee of the Whole Meeting, Councilman Kroll made a motion to adjourn. Councilman Coleman seconded the motion. Motion carried and the Committee of the Whole Meeting adjourned at 9:40 P.M.
