TIP-meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervison of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Coleman made a motion that the report be accepted and placed on file. Councilman Krueper seconded the motion. Motion carried. COMMUNICATION To the Honorable Council: Feb. 11, 1961 I want to thank you and express my sincere appreciation for all the kind thoughts extended to me by the City Council, Plan Commission and city personnel during my illness. Communication from Mayor Charles A, Mobley, Flint, Michigan relative to House Bill 3647 which would abolish the 10% Federal Excise Tax levied against Automobiles manufactured in this Country. Mayor Mobley asked the Council to study this proposed Bill and act upon it. Councilman Lehman made a motion that the communication be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATION The Common Council February 24, 1961 City of South Bend City Hall South Bend, Indiana Gentlemen of the Council: At a regular meeting of the South Bend - Mishawaka Board of Realtors held February 17, 1961, the enclosed resolution was adopted. R E S O L U T I O N Whereas, a parking survey of South Bend may be proposed before the Common Council at a cost of $15,000 to the taxpayers of this community: Now Therefore, it is resolved by the South Bend - Mishawaka Board of Realtors to oppose the expense of such a survey, for the following reasons. 1. The survey is not necessary. 2. The survey can be made by the local newspaper and by public spirited groups, such as, service clubs, Boy Scout and Camp Fire Girls at a much lower cost. COMMUNICATION SOUTH BEND, INDIANA FEBRUARY 23, 1961 LINDEN AVENUE NEIGHBORHOOD CLUB The Linden Avenue Neighbor -hood Club at their regular meeting con the above date in the Linden School passed the following resolutions: L\L' V V 7JGa L 4'L _ t - WHEREAS, the Linden Avenue Neighborhood Club met on the above date at the Linden School to discuss, the ar- ticles which appeared in the South Bend Tribune on January 17th, 1961, and on February 10th, 1961. The article of January 17th, 1961, proposed the clearance of some 160 acres in the Linden Area by Mr. Henry Sucher, executive director of the redevelopment program; and, WHEREAS, such a program would displace in excess of some one thousand families, home owners, tax payers and decent citizens, AND, WHEREAS, many of these homes in said area are homes of retired factory workers, who own these homes with no expense but up keep and taxes to pay out of their retirement income, and can live comfortably from such income, AND, WHEREAS, if this 180 acres is cleared, and these homes destroyed by the redevelopment clearance program, as stated in an article of February 10th., 1961, in the South Bend Tribune, and.these families are forced out of their own property, and forced to live in a housing project, and also forced to pay rent in such project from their retire- ment income, they would become displaced citizens of the United States of America, and would not be able to meet their daily needs from their retirement income, AND, WHEREAS, the citizens, tax-payers and home owners of this area are very much disturbed and upset over these publications in the South Bend Tribune on January 17th, 1961, and on February 10th., 1961, which said articles propos to seize and destroy their homes and property in the 180 acre clearance program of the redevelopment commission, and are opposed to such seizure and destruction of their homes and property. NOW, THEREFORE, BE IT RESOLVED, that the property owners and tax payers of this area go on record as oppos the redevelopment commission in this act of seizure and destruction of their homes and property in this proposed 180 tract. BE IT FURTHER RESOLVED, That copies of these resolutions be sent to Mayor Frank J. Bruggner, to Mr. Henry Sucher, executive director of the Urban Redevelopment Commission, to Mr. Martin Segal, Regional Director of the Redevelopment Commission, Chicago, Illinois, to Mr. Joseph T. Kroll, President of the Common Council of South Bend, Indiana, and to the South Bend Tribune, South Bend, Indiana. /s/ Zilford Carter Zil£ord Carter, Chairman of the Neighborhood Club on Redevelopment Councilman Coleman made a motion that this Communication be accepted and placed on file and that a copy of same be given to the members of the Council's Urban Redevelopment and Housing Committee for their consideration. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATION A communication addressed to Fire Chief Andrzejewski was brought to the attention of the Council. The communication pertained to self - service coin - operated dry cleaning machines and the danger involved if no attendant was present during hours when the machines would be operated. Councilman Lehman made a motion that the communication be referred to the Board of Public Works and Safety and that a copy be sent to City Attorney Irving J. Smith, for his study and report back to the Council. Councilman Coleman seconded the motion. Motion carried. PETITION Petition of Marjorie Drinski to rezone land in the 500 block of North William Street. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Coleman seconded the motion. Motion carried. PETITION Petition bearing 11 signatures requesting a street light in the 400 block of West Madision Street. Councilman Coleman made a motion that the petition be referred to the Board of Public Works and Safety for attention. Counci Allen seconded the motion. Motim carried. REPORT OF CITY PLANNING COMMISSION February 9, 1961 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Northern Indiana Development Company, Inc., and Lowell E. Buschbaum to zone recently annexed land being Lots Numbered 73, 74, 103 and 104, as shown on the recorded Plat of Myer's and Funk's Third Plat of Chippewa Heights Addition to the City of South Bend, Indiana, said real estate being more commonly described as a parcel of land 100 feet by 328 feet between Michigan and Main Streets, and immediately south of.Barbie Street (formerly known as Albert Street) in the south edge of the City limits of the City of South Bend, to "C" Commercial Use District and "A" Height and Area District was legally advertised under date of January 23, 1961 and given public hearing under date of February 2, 1961. The following acting was taken: After due consideration the Commission found that the desired zoning for the property in question would be the best possible zoning for said land area in view of the following reasons: 1. The land area directly north of the property in question is zoned "C" Commercial Use and "A" Height and Area District. 2. The property in question lies between two designated major thoroughfares, providing adequate traffic circulation. 3. The land area east and south of the property in question is zoned by the County for Commercial purposes, and is completely in commercial use. ORDINANCE NO. 4366 - - -61 AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMCN LY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Albert Street between Michigan and Main Streets) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. 0RDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL RQPRIATION }`, IAN I E STREET AND TRAFFIC FUND The Ordinance was given first reading by title and sec reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on March 13, 1961. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND AN ORDINANCE ESTABLISHING A FIXED MILEAGE RATE FOR REIMBURSEMENT FOR CITY OFFICIALS AND EMPLOYEES IN THE USE OF PRIVATE CONVEYANCES FOR CITY BUSINESS, TO AMEND ORDINANCE NO. 3977 The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Lehman seconded -the motion. Motion lost. Councilman Lehman then made a motion that the Ordinance be set for public Hearing on March 13, 1961. Councilman Krueper seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY THE MUNICIPAL CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, DESCRIBED AS FOLLOWS: All of the East Washington Street right of way which lies between the East race and the St. Joseph River, subject to air rights and sewer easements, all in the City of South Bend, St. Joseph County, State of Indiana The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Krueper objected and asked that the motion be withdrawn. Councilman Muszynski withdrew his motion. Councilman Krueper then made a motion that the Ordinance bb set for public hearing on March 13, 1961. Councilman Glass seconded the motion. Motion carried. President Kroll thanked Miss Virginia Guthrie for the minutes which she had taken at the meeting of the Urban Redevel ment and Housing Committee. OLD BUSINESS Councilman Muszynski complained that dogs are again running at large in the 3700 block of Belle Vista and the 800 blo of Wellington and Kenmore. He requested that the Board of Health and the Board of Public Works and Safety give this matter their attention. Councilman Lehman requested a check on dogs running at large in the fifth district. Councilman Glass again requested that the Police Department purchase a patrol boat for the St. Joseph River. Presider. Kroll appointed a Special Committee to investigate the need for a patrol boat. The Committee, composed of Councilmen Glass, Chairman, and Councilmen Coleman, Lehman, Tellson and Krueper will meet at 9:30 A.M., Monday, March 4th, with the Board of Public Works and Safety and the Police Chief to discuss this matter. Councilman Tellson, Chairman of the Committee on Miscellaneous Business, give the following report: To the President, South Bend Common Council: February 27, 1961 Dear Sir: The Committee on Miscellaneous Business, to which was referred Councilman Allen's suggestion for the prepara- KLUMAtim 11C. L• 111YU tion of an annual report of the acts of the Common Council, met on Tuesday, February 21, 1961. The suggestion was favorably acted upon and the committee recommends that the Common Council, by appropriate resolutio or ordinance, instruct the Clerk to have printed an annual report as to the year's activities, as do other departments of the city government; and that a reasonable sum be included in the 1962 budget for that purpose.
