HomeMy WebLinkAbout01-09-61 Council Meeting MinutesREGULAR MEETING JANUARY 9, 1961 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, on Monday,--January 9, 1961, at 8:31 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. /s/ Joseph T. Kroll /s/ T. W. Lehman Committee /s/ Albert Tellson South Bend, Ind., January 9, 1961 Minutes of Meeting of December 12, 1960 and January 3, 1961 Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Lehman seconded the motion. Motion carried. PETITION Petition of Northern Indiana Development Company, Inc., and Lowell E. Buschbaum to zone recently annexed land at Barbie Street between Michigan and Main Streets. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana ' Gentlemen: January 6, 1961 The attached petition of Joseph Lee and Mary Lee, et al, to rezone lots Numbered Ninety -three (93), Ninety -four (94), Ninety -five (95), One Hundred Twenty (120), One Hundred Twenty -one (121), and One Hundred and Twenty -two (122), as shown on the Recorded Plat of Hartman and Miller's Plat, an addition to the City of South Bend, Indiana most commonly known as 1201 -1221 South Bend Avenue from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "E" Height and Area District was legally advertised under date of December 19, 1960 and given .�raLVUrai�i 7, 1701 public hearing under date of January 5, 1961. The following action was taken: After due consideration the Commission found that the proposed zoning represented a continuation of strip zoning. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended unfavorably to the Common Council. HB /mah Attach. Councilman Lehman seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN TIE PROJECT EXPENDITURES ACCOUNT FUND (URBAN REDEVELOPMENT BOND FUND) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made ,a motion for sw pension of rules. Councilman Lehman seconded the motion. After some discussion Councilman Muszynski withdrew his motion and Councilman Lehman withdrew his second to the motion. Then, Councilman Muszynski moved that the Ordira nce be set for public hearing on January 23, 1961. Councilman Lehman seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITONAL APPROPRIATIONS IN 1960 GENERAL STREET IMPROVEMENT FUND $372,450.67 The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion That the Ordinance be set for public hearing on January 23, 1961. Councilman Lehman seconded the motion. Motiaz carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE ELECTRICAL DEPARTMENT $1,420.00 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on January 23, 1961. Councilman Allen seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SOUTH BEND - ST. JOSEPH COUNTY BUILDING AUTHORITY The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on January 23, 1961. Councilman Krueper seconded the motion. Motion carried. ORDINANCE NO. 4356 - - -61 AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 536 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951 The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of the rules. Councilman Ladewski seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Clerk then gave the Ordinance its third reading and it was passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4357 - - -61 AN ORDINANCE APPROVING AN OPTION TO RENEW A LEASE BETWEEN THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, AND NORTHERN INDIANA TRANSIT, INC., AN INDIANA CORPORATION FOR THE PREMISES KNOWN AND DESCRIBED AS FOLLOWS: A CERTAIN GARAGE SPACED LOCATED AT 402 S. NOTRE DAME STREET, SOUTH BEND, INDIANA, BEING AN AREA OF APPROXIMATELY 4,000 SQUARE FEET, WHICH AREA IS NOW COMMONLY KNOWN AS "BUS DRIVERS' ROOM AND EXTEND SOUTHERLY TO THE SOUTH END OF THE BUILDING A DISTANCE OF APPROXIMATELY 180 FEET, PLUS AN AREA APPROXIMATELY 22 FEET WEST OF A ROW OF STEEL POSTS. The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays The Ordinance was then given third reading and - passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4358 - - -61 AN ORDINANCE APPROVING AN OPTION TO RENEW A LEASE BETWEEN THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, AND.PETER F. NEMETH AND MARGARET K. NEMETH FOR THE PREMISES COMMONLY KNOWN AS 114 SOUTH CHAPIN STREET, AS WELL AS THE USE OF A PORTION OF LAND ADJACENT THERETO The Ordinance "was given first reading by title and second reading in full. Councilman Lehman made a motion for suspension of rules. Councilman Krueper seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4359 - - -61 AN ORDINANCE APPROVING AN OPTION TO RENEW A LEASE BETWEEN THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, AND ALBERT MEILSTRUP, D /B /A MEILSTRUP CARTAGE COMPANY OF SOUTH BEND FOR THE PREMISES COMMONLY KNOWN AS 412 EAST TUTT STREET AS WELL AS PORTION OF LAND ON THE OPPOSITE SIDE OF THE STREET. The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for sus- pension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. 285 REGULAR MEETING ORDINANCE, FIRST AND SECOND READING JANUARY 9, 1961 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Approximately 134.3 acres of land along Edison Road between Ironwood and Ivy Roads.) The Ordinance was given first reading by title and second reading in full Councilman Glass made a motion that the Ordinance be referred back to the City Planning Commission for action. Councilman Lehman seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, - COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Real Estate involved located on Portage Avenue -- -700 Block), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. Kroll ALL COMMITTEE REPORTS SHALL BE IN WRITING COMMUNICATION I The Clerk read the following communication from Councilman T. W. Lehman: Common Council January 9, 1961 City of South Bend South Bend, Indiana (Gentlemen: As you will recall, I was elected Chairman of the Committee of the Whole in January of 1960 for a term of four years. Mayor Bruggner has requested that I continue to act in that capacity. However, it is my feeling that this Council shall be the judge of whether my services as Chairman -in 1960 have been adequate. Notwithstanding the fact that Mayor Bruggner has repeatedly requested me to retain this post, I herewith submit my resignation in order that the Council may again fill the vacancy and further determine my adequacy in said position. I shall be willing to continue as Chairman should the Council so desire. Respectfully submitted, /s/ T. W. Lehman T.W. Motion carried and the regular meeting of the Common Council adjourned at 9:15 P.M.
