HomeMy WebLinkAbout12-12-60 Council Meeting MinutesREGULAR MEETING DECEMBER 12, 1960 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, on Monday, December 12, 1960, at 8:17 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes,' would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Lehman seconded the motion. Motion carried. MUNICIPAL CODE 0 Councilman Allen requested that the Councilmen be furnished with copies of the Municipal Code. The Clerk informed the Council that there were no copies of the 1949 Municipal Code available. However, the Council had approved a sum of money in the City Clerk's 1961 Budget for the re- codification ar74 printing of a new Municipal Code. REPORT OF THE COMMITTEE OF TH WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Real Estate involved located on Portage Avenue - - -700 Block), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE deferred until next regular meeting. /s/ T. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South B-end: Your Committee of the Whole, to whom was referred AN ORDINANCE TO REGULATE THE PRODUCTION, TRANSPORTATION, PROCESSING, HAULING, SAMPLING, EXAMINATION, LABELING AND SALE OF MILK AND MILK PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRIES, AND MILK PLANTS; THE ISSUANCE, SUSPENSION AND REVOCATION OF PERMITS TO MILK PRODUCERS, MILK HAULERS, MILK DISTRIBUTORS AND OPERATORS OF MILK PLANTS; APPOINTMENT OF INSPECTORS AND SANITARY POLICE; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND.FIXING PENALTIES, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. DEPARTMENTAL REPORT Members of the Common Council City of South Bend City Hall South Bend, Indiana Gentlemen: December 8, 1960 RE: Traffic control at Mayflower Road (SR 123) and Sample Street (SR 223) On November 23, 1960, this department was advised by the Indiana State Highway Department that approval had been granted for the installation of a four -way stop at Mayflower Road (SR 123) and SAMPLE STREET (SR 223) intersection. Installation of these signs was made on December 5, 1960. To supplement this installation, an "all red" flasher beacon will be installed as soon as plans and specifications are received from the Engineer of Traffic Signals of the State Highway Department. ORDINANCE NO. 4354 - - -60 AN ORDINANCE TO REGULATE THE PRODUCTION, TRANSPORTATION, PROCESSING, HANDLING, SAMPLING, EXAMINATION, LABELING AND SALE OF MILK AND MILK PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRIES, AND MILK PLANTS; THE ISSUANCE, SUSPENSION AND REVOCATION OF PERMITS TO MILK PRODUCERS, MILK HAULERS, MILK DISTRIBUTORS AND OPERATORS OF MILK PLANTS; APPOINTMENT OF INSPECTORS AND SANITARY POLICE; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND FIXING PENALTIES The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: December 9, 1960 The attached petition of Louis and Carmella Rappelli, 614 North St. Peter Street, to rezone the property most commonly known as 1035 North Notre Dame Avenue from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "B" Height and Area District was legally advertised under date of .November 21, 1960 and given public hearing under date of December 1, 1960. The following action was taken: After due consideration the Commission found that the rezoning sought would constitute spot zoning. It was therefore duly moved, seconded, and carried (Comr. COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: December 9, 1960 The attached petition of Emery Mak to rezone Lots Numbered 1, 2, 3, 4, 5, 6, and 7-as shown on the recorded plat of Clapp's Subdivision of Lots Numbered 1, 2, 3, 9, 10, 11, and 12 in Kline's Addition and Lots Numbered 10 to 16, inclusive, in Leer's Subdivision of Partition Lot Numbered 4 of Samuel Leer Estate; and also the following described real estate: Commencing at a point of intersection of the North line of Lincolnway East and the East line of South Twyckenham Drive iii the City of South Bend, Indiana; thence Southeasterly along the Northerly line of Lincolnway East to the point of intersection with the East line of Caroline Street as extended; thence North to the St. Joseph River; thence Westerly along the meander line of the St. Joseph River to the East line of South Twyckenham Drive; thence South along the East line of South Twyckenham Drive to the point of beginning from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "EY Height and Area District was legally advertised under date of November 21, 1960 and given public hearing under date of December 1, 1960. The following action was taken After due consideration the Commission found that investigation had disclosed that the subject property north of the river was not possibly useable as a residential neighborhood and that the proposed rezoning was in accord with the spirit of the Zoning Ordinance. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: December 9, 1960 The attached petition of Northern Indiana Development Company, Inc., Lowell E. Buschbaum and John W. Blenke to annex to the City of South Bend, Indiana the following described property: Lots Numbered Seventy -three (73), Seventy -four (74), One Hundred Three (103), and One Hundred Four (104), as shown on the recorded plat of Myers and Funk's Third Plat of Chippewa Heights Addition to the City of South Bend, Indiana, that the above mentioned real estate is immediat ly south of Barbie formerly known as Albert Street between Main and Michigan Streets, being most commonly known as 4103 and 4105 South Michigan Street was legally advertised under date of December 5, 1960 and given public hearing under date of December 8, 1960. After due consideration the Commission found that the proposed annexation meets with the primary determinants of Chapter 269, Section 2 of the Acts of 1955. ORDINANCE, FIRST AND SECOND READING ORDINANCE BEING AN ORDINANCE AMENDING ORDINANCE NO. 3702, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Lincolnway East & Twyckenham Drive) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Tellson seconded the motion. After some discussion Councilman Muszynski with- drew his motion and Councilman Tellson withdrew his second to the motion. Councilman Lehman made a motion that the Ordinance be set for public hearing on January 9, 1961, Councilman Coleman seconded the motion. Motion carried. ORDINANCE NO. 4355 - - -60 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA (13"k) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. .Councilman Krueper seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND WHEREAS, the term of Arthur N. Shidler, appointee of the South Bend Common Council as trustee to the South Bend -St. Joseph County Building Authority expires January 3, 1961, and WHEREAS, it is the desire of the South Bend Common Council to re- appoint said Arthur N . Shidler as trustee to the South Bend - St. Joseph County Building Authority. IT IS THEREFORE RESOLVED that the Common Council herewith appoint Arthur N. Shidler as its representative trustee to South Bend -St. Joseph County Building Authority as of the 4th day of January, 1961. Ie- • REGULAR MEETING DECEMBER 12, 1960 IT IS FURTHER RESOLVED: That from and after the passage, enrollment, attestation and signature by the Clerk and presiding Officer this resolution and appointment shall become effective. /s/ Walter G. Glass Member of the Common Council Councilman Lehman made a motion for adoption of the Resolution. Councilman Krueper seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. Resolution Adopted. RECESS FROM 8 :25 P.M. to 8:40 P.M. NEW BUSINESS Councilman Muszynski made a motion, seconded by Councilman Lehman, that pursuant to Burns Annotated Indiana Statutes, Section 48 -8545, the name of ALOYSIUS KROMKOWSKI, be placed in nomination as Council Representative as South Bend Redevelopment Trustee for a period of four'years. Motion unanimously carried. Councilman Coleman made a motion to dispense with the Regular Meeting of the Council on December 26, 1960. Councilman Lehman seconded the motion. Motion carried. Councilman Coleman made a motion that the Organization meeting scheduled for the first Monday in January, be set for Tuesday, January 3, 1961 at 7:30 P.M. Councilman Tellson seconded the motion. Motion carried. Councilman Tellson spoke about the possibility of changing theCoii.ncil Meetings from Monday Night to some other night in the week. Councilman Coleman made a motion that the matter be put in the Miscellaneous Business Committee for study. Councilman Allen seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Krueper seconded the motion.
