HomeMy WebLinkAbout11-28-60 Council Meeting MinutesREGULAR MEETING NOVEMBER 28, 1960 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, Monday, November 28, 1960, at 8:38 P.M., with all members present except Councilmen Allen and Tellson. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Ladewski, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: Councilmen Allen and Tellson. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. South Bend, Ind., November 28, 1960 Minutes of Meeting of November 14, 1960; Joseph T. Kroll Committee T. W. Noble, City Clerk of South Bend; requesting that the street crossings on the G.T.W.E.E. in South Bend be put in good condition. I have received a letter from Mr. W. A. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Northern Indiana Developmentn Compnay, Inc., Lowell E. Buschbaum and John W. Blenke to rezone land immediately South of Albert Street between Michigan and Main Streets - -- Feeney and Str.atigos, Attorneys for Petition Councilman. Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Coleman seconded the motion. Motion carried. Councilman Lehman seconded the motion. Motion carried. DEPARTMENTAL REPORTS Mr. Irving J. Smith, City Attorney City of South Bend South Bend, Indiana Dear Mr. Smith: November 21, 1950 I have investigated the complaint concerning St. Vincent Street registered by City.Councilman J. Chester Allen. First, this is a dirt street which has been oiled several times in the past. A crust of sorts has been built up whi permits patching in a few scattered places. Where possible these spots have been patched routinely. One week previous to Mr. Allen's complant on the council floor, October 18, 1960, to be exact, a Street Department crew scraped the surface of this street and filled in the holes as best they could with cinders. At that time Councilman Allen spoke to our crew and to Mr. Dempsey, the foreman in charge. A further complaint was received on October 31, 1960, requesting filling of the holes in the alley approach along 718 St. Vincent. This order was completed on November 15. The street was again worked on and the holes filled on November 17. At this same time leaves were again removed the entire length of the street. During the year 1960, 15 complaints on various problems have been received on this street which runs approximately five blocks. All of these orders have been executed in addition to routine work which has been done. I have been unable to find any record of work requested that was not completed nor have I been able to find any employee who has ignored any request from this area, or any other street. It is true, however, that since this is an unimproved street we are limited in work we can do on it. When chuck holes develop we cannot patch them unless there is sufficient crust for adhesion of asphalt. A solution would be to scarify and grade the entire street. However, this would destroy what semblance of surface there is now and I am sure the residents would not approve. If Mr. Allen wishes us to.grade this street we will do so upon his request. Sabo, Clerk Board of Public Works and Safety November 28, 1960 In reply to your inquiry concerning Councilman Tellson's complaint on Hibberd Court at Michigan Street, please be advised as follows: The crosswalk on Michigan Street crossing Hibberd Court is approximately 3" below the sidewalk level. This is not an unusual circumstance in the City since a great many crosswalks do have a step -down. We have investigated this situation and find that water does not stand in the crosswalk and do not believe a hazard exists. If the Board of Works so desires we will build this crosswalk up to a level with the existing sidewalk. However, we feel this will create a rise which vehicles must cross over when using the Court, which may cause cars to drag their undercarriage at this point. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Real Estate involved located on Portage Avenue - - -700 Block), Respectfully report that they have examined the matter and that in their opinion it should be continued until December 12. /s/ T. ORDINANCE NO. 4351 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE DEPARTMENT OF PUBLIC WORKS AND SAFETY - OFFICE OF THE BOARD The Clerk then read Ordinance No. 4351 - - -60 for its third reading and it was passed by a roll call vote of 7 ayes, 0 nays 2 absent (Councilmen Allen and Tellson). ORDINANCE NO. 4352 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN STREET AND TRAFFIC DEPARTMENT $5,000.00 The Clerk then read Ordinance No. 4352 - - -60 for its third reading and it was passed by a roll call vote of 7 ayes, O nays, 2 absent (Councilmen Allen and Tellson). ORDINANCE NO. 4353 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SOUTH BEND - ST. JOSEPH COUNTY BUILDING AUTHORITY The Clerk then read Ordinance No. 4353 - - -60 for its third reading and it was passed by a roll call vote of 7 ayes, 0 nays, 2 absent (Councilmen Allen and Tellson). ORDINANCE, FIRST AND SECOND PLEADING AN ORDINANCE TO REGULATE THE PRODUCTION, TRANSPORTATION, PROCESSING, HANDLING, SAMPLING, EXAMINATION, LABELING AND SALE OF MILK AND MILK PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRIES, AND MILK PLANTS; THE ISSUANCE, SUSPENSION AND REVOCATION OF PERMITS TO MILK PRODUCERS, MILK HAULERS, MILK DISTRIBUTORS AND OPERATORS OF MILK PLANTS; APPOINTMENT OF INSPECTORS AND SANITARY POLICE; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND FIXING PENALTIES The Ordinance was given first reading by title and second reading in full. Councilman Lehman "made a motion that the Ordinance be set for public hearing on December 12, 1960. Councilman Muszynski seconded the motion. Motion carried. An application for re- certification of the Workable Program for the Housing and Home Finance Agency was explained by Mr. Henry Sucher in detail outlining the progress made in Urban Renewal projects under way. Mr. Sucher asked that the Council approve this application which was to be submitted to the United States Government Housing and Home Finance Agency. Councilman Lehman made a motion to approve the application. Councilman Glass seconded the motion. notion carried. RESOLUTION RESOLUTION AUTHORIZING CERTAIN PAYMENTS TO BE MADE TO SALARIED EMPLOYEES.OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana, is approaching the close of its fascal year; and, WHEREAS, the office of the City Controller will be required to make numerous payments and close its numerous and plicated accounts; and, WHEREAS, it is desirable that the work of said office be simplified; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana: RESOLUTION (continued) I. That all salaried officers and employees of the City shall be paid their salaries for the month of December, 1960, on the 20th day of December, 1960. II, The Controller of the City of South Bend is hereby authorized to make said salary payments upon said date. III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approva by the Mayor. /s/ Chester E. Motion carried by a roll vote of 7 ayes, 0 nays, 2 absent (Councilmen Allen and Tellson). There being no further business before the Council, Councilman Lehman made a motion to adjourn.
