The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL: PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Joseph T. Kroll T. W. Noble October 28, 1960 City Clerk City of South Bend, Indiana Your letter received in connection with repairing grade crossings in the City of South Bend. s Wish to advise that we are presently working on Arnold Street crossing, and intend to do Olive Street Crossing, starting next week, and will continue to make repairs to the balance of the crossings in South Bend. Please.-be advised.,.that we have patched our crossings in the city and we shall make anoter inspection and make any necessary repairs before November 15, 1960. Further, we plan to completely rehabilitate the crossing at Sample Street next spring in conjunction with your project of the widening of the street; at that time in connection with this we shall do the same to Garst Street. PETITION Petition of Louis Rappelli and Carmella Rappelli to rezone land at 1035 N. Notre Dame Avenue. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Emery Mak, et al, to rezone land on Lincolnway East at Twyckenham Drive. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. REPORT OF TRAFFIC ENGINEER Members of the Common Council November 14, 1960 City Hall South Bend, Indiana ,entlemen: RE: Installation of traffic signals at intersection of South Bend Avenue and Edison Road ks a result of studies and recommendations by this department during the summer of 1960, a request was submitted to Indiana State Highway Department to once again,consider the installation of traffic signals at the intersection of >outh Bend Avenue (SR23) and Edison Road. C recently received a copy of their survey, dated November 1, 1960, and installation of traffic signals and channeliza .ion has been recommended and forwarded to the State Highway Department at Indianapolis for further approval. REPORT OF TRAFFIC ENGINEER Members of the Common Council November 14, 1960 City Hall South Bend, Indiana Gentlemen: Ref: Petition -: requesting - 'traffic signal§ at intersection of Western Avenue (SR 2) and Lombardy Drive Shortly after the regular September 12, 1960 meeting of the Common Council a request was submitted to the Indiana State Highway Department to once again make necessary surveys and traffic counts at Western Avenue (SR 23) and Lombardy Drive to determine if traffic signals should be installed there. This work was done on October 17, 1960 by the Indiana State Highway Department and once again the results show that there are insufficient warrants for installation of traffic signals and therefore are not recommended. Traffic counts and surveys were also made on October 18, 1960 at Lincolnway West (US 20) and Sheridan Avenue and the request for traffic signals there has also, once again, been refused. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: November 14, 1960 The attached petition of Henry and Florence Kelly to rezone the property,most commonly known as 1301 North Michigan Street from "At° Residential Use District to "B" Residential Use District was legally advertisied under date of October 24, 1960 and given public hearing under date of November 3, 1960. The following action was taken: After due consideration the Commission found that due to the isolated character of the land and the topography feat which does not lend itself economically to "A6' Residential Use development the petition should be granted. Michigan) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on November 28, 1960. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE DEPARTMENT OF PUBLIC WORKS AND SAFETY - OFFICE OF THE BOARD The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on November 28, 1960. Councilman Coleman seconded the motion. Motion carried. ORDINANCE FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN STREET AND TRAFFIC DEPARTMENT, $5,000.00 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on November 28, 1960. Councilman Coleman seconded the motion. Motion carried. ORDINANCE FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SOUTH BEND - ST. JOSEPH COUNTY BUILDING AUTHORITY The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public Hearing on November 28, 1960. Councilman Coleman seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (2806 Lincolnway West), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. ORDINANCE NO. 4347 - - -60 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED The Ordinance was given third reading and passed by a roll call vote of 7 ayes, 2 nays (Councilmen Allen and Coleman). ORDINANCE NO. 4348 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE CITY CLERK IN THE AMOUNT OF $750.00 The Ordinance was given third reading and it was passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4349 - - -60 AN ORDINANCE TO REGULATE AND CONTROL THE SALE AND USE OF PLASTIC COVERINGS OR BAGS The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY To the Common Council City of South Bend RE: Your directive of September 13, 1960 Gentlemen: November 14, 1960 Refer: Our Letter Dated September 20, 1960 With further reference to your Directive of September 13, 1960, concerning a Motion made by Councilman Glass, Seconded by Councilman Lehman and duly Carried as to the possibility of procuring a patrol boat for the St. Joseph River in order to discourage speeding on the river, the subject was considered by the Board of Public Works and Safety at its regular meeting of November 14, 1960. A detailed report from Captain John F. Kasprzak who was assigned to make a survey of this suggested patrol by the Chief of Police was submitted to the Board, examined and ordered placed on file. Copy of Captain Kasprzak's Report is attached hereto and a complete file on this St. Joseph River Patrol is on file in the office of the Board of Public Works and Safety for examination of interested persons. RESOLUTION RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, on the 3rd day of June, 1957, the Common Council of the Municipal City of South Bend under Ordinance No. 4168 amended Section 82 of Chapter 29 of General Ordinance 3709, Sub - Section B to read as follows: If the Common Council shall determine that any truck route or access route shall be eliminated, changed, or established, or temporarily modified, it shall enact a resolution or ordinance effecting same, and WHEREAS, the Common Council of the City of South Bend has found it expedient to establish and change certain truck routes for traffic on certain streets in the City of South Bend, and, WHEREAS, it is believed that said changes are for the convenience and benefit of the public. IT IS, THEREFORE, RESOLVED: That 1. Inter -City Trucks southbound on Michigan Street (US 31 & 33) shall turn west on Madison Street to Main Street, then south on Main Street to South Street and then east on South Street to Michigan Street (US 31 & 33) and then continue on present southbound route, except that inter -City trucks southbound on US 33 shall turn east on Monroe Street and continue to present US 33 east of Michigan Street. 2. Inter -City trucks westbound on Colfax Avenue (US 20) and intending to travel southbound on US 31 shall continue west to Main Street and then south following US 31 southbound to South Street and then east on South Street to Michigan Street and then continue on present" south bound route. 3. Inter -City trucks westbound on SR 23 on Colfax Avenue (US 20) shall continue west on Colfax to Main Street then south on Inter -city truck route US 31 to Western Avenue (SR 2) and then west on Western Avenue to present SR 23. IT IS FURTHER RESOLVED: That from and after the passage, enrollment, attestation and signature by the Clerk and presiding officer and approval by the Mayor this resolution shall become effective. /s/ Chester E Muszynski Member of the Common Council Councilman Muszynski made a motion for adoption of the Resolution. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. Resolution adopted. OLD BUSINESS Councilman Ladewski commented on the improved appearance of the Council Chambers and suggested that the Clerk of the Board of Public Works and Safety be commended for having the repairs made. NEW BUSINESS Councilman Tellson complained that Hibberd Court, as it enters Michigan Street, is in need of repair. He stated that the pavement is lower than the walk. The Clerk was asked to advise the City Engineer and the Board of Public Works aid Safety of this condition in order that repairs may be made. There being no further business to come before the Council, Councilman Glass made a motion to adjourn. Councilman Lehman seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 9:15 P.M.
