HomeMy WebLinkAbout10-10-60 Council Meeting MinutesREGULAR MEETING OCTOBER 10, 1960 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, on Monday, October 10, 1960, at 8:10 P.M., with all members present. The meeting was called to Order by President Joseph T. Kroll, who presided. ROLL CALL: Present: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. Absent: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF THE ORDINANCE COMMITTEE Councilman Allen, Chairman of the Ordinance Committee, reported as folows: To the Chairman of the Committee of the Whole: South Bend Common Council, South Bend, Indiana The Ordinance Committee to which was referred "An Ordinance to regulate and control the sale and use of plast VViVLLI\ 1V, 17VV coverings or bags" submits the following report: That said ordinance be amended as follows: In paragraph three thereof the words "in red color" be inserted after the word imprinted in the first line of said paragrpah. And that in the same paragraph three the words "if any" be stricken from line five of said third paragraph. That Section III of said ordinance be stricken and the following paragraph substituted therefor: "This Ordinance shall be in full force and effect from and after February 1, 1961." Your committee further recommends that after the amendments mentioned above said Ordinance be favorably recommended to the South Bend Common Council for passage as amended. /s/ J. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (119 S. Scott and 710 West Washington), Respectfully report that they have the matter and that in their opinion is should be reported unfavorable. /s/ T. W. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Real Estate involved located on Portage Avenue -- -700 block) Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE DEFERRED UNTIL OCTOBER 24th, 1960. /s/ T. ORDINANCE NO. 4340 - - -60 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE, AS HERETOFORE AMENDED AND SUPPLEMENTED The Ordinance was given third reading and passed by a roll call vote of 7 ayes, 2 nays (Councilmen Coelman and Krueperl ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (119 S.,�Cott Street and 710 West Washington) The Ordinance was given third reading and lost by a roll call vote of 9 nays, 0 ayes. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: October 7, 1960 The attached proposed Ordinance originated by the City Planning Commission relative to Section 4 -A of Ordinance No. 3702, (as amended), commonly known as the Zoning Ordinance of the City of South Bend, Indiana was legally adver- tised on September 26, 1960 and given public hearing under date of October 6, 1960. The following action was taken: After due consideration the Commission found that substantial justice would be done by the amendment of Ordinance No. 3702 as proposed in said ordinance. It was therefore duly moved, seconded and unanimously carried that the proposed ordinance be recommended favorably and submitted to the Common Council for adoption. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council October 7, 1960 City of South Bend South Bend, Indiana Gentlemen: The attached proposed ordinance originated by the City Planning Commission relative to Section 10 of Ordinance No. 3702, (as amended) commonly known as the Zoning Ordinance of the City of South Bend, Indiana was legally advertised on September 26, 1960 and given public hearing under date of October 6, 1960. The following action was taken: After due consideration the Commission found that substantial justice would be done by the amendment of Ordinance No. 3702 as proposed in said ordinance. It was therefore duly moved, seconded and unanimously carried that the proposed ordinance be approved and submitted to the Common Council for adoption. RLH /mah Attach. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: October 10, 1960 The attached proposed ordinance originated by the City Planning Commission to zone the recently annexed property generally described as bounded on the north by the present city limits, on the east by the east Section line of Section 26, T37N, R2E, on the south by Ireland Road, and on the west by the Pennsylvania Railroad tracks con- taining approximately 100.7 acres to "E" Heavy Industrial Use and "A" Height and Area District was legally ad- vertised under date of September 26, 1960 and,given public hearing under date of October 6, 1960. The following action was taken: After due consideration the Commission found that: 1. Subject property was zoned heavy industrial in the County and heavy industrial zoning exists contiguous to the north thereof. 2. The tract is served by a secondary major thoroughfare and the Pennsylvania Railroad. 3. The industrial use of said property will broaden and diversify the tax base of the City of South Bend and create primary job,-opportunities for its citizens. 4. In regard to the "A" Height and Area recommendation the Commission found that no hardship would accrue in meeting the requirements of said height and area and that said height and area would tend to stabilize property value and be of greater protection to all properties in the tract. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BENDM, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for Public Hearing on October 24, 1960. Councilman Glass seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED. The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for Public Hearing on October 24, 1960. Councilman Allen seconded the motion. Motion carried. ORDINANCE NO. 434. - - -60 AN ORDINANCE TO AMEND ORDINANCE N0, 3702 AS .AMENDED WHICH ORDNANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE`OF'THE CITY OF SOUTH BEND, INDIANA (Ireland & Penn R.R.) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. II ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE CONTROLLER IN THE AMOUNT OF $7,106.92 FOR THE YEAR ENDING DECEMBER 31, 1960 The Ordinance was given first reading by title and second reading in full. Councilman glass made a motion that the Ordinance be set for public hearing on October 24, 1960. Councilman Lehman seconded the motion. Motion carried. Councilman Tellson made a motion that the Ordinance relating to use and control of Plastic Bags be set for public hearing on October 24, 1960. Councilman Lehman seconded the motion. Motion carried. 11 OLD BUSINESS Councilman Muszynski complained about the railroad crossings at Arnold Street and Prairie Avenue. Councilman Allen made a motion that the railroads that are implicated in this controversy be immediately notified that the Common Council expects them, in conformance with a meeting held in November of 1959, to proceed with the repair of these railroad crossings with due dispatch. Councilman Coleman seconded the motion. Motion carried. 11 NEW BUSINESS Councilman Lehman presented a petition bearing 51 signatures requesting improvement of Caroline Street from Bowman Street to Fox Street by erecting either Stop of Yield signs at intersections. He asked that the traffic Engineer make a study of this area and report to the Board of Public Works and Safety for action. There being no further business to come before the Council, Councilman Glass made a motion to adjourn. Councilman Muszynski seconded the motion.
