HomeMy WebLinkAbout09-27-60 Council Meeting MinutesREGULAR MEETING SEPTEMBER 27, 1960 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, on Tuesday, September 27, 1960, at 7:03 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South. Bend: Your Committee on the inspection and supervison of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION Communication from Mrs. Edward F. Voorde expressing her appreciation for the sympathy of the Council. Councilman Lehman made a motion that the communication be accepted and placed on file. Councilman Ladewski seconded the motion. Motion carried. . PETITION Petition was received from Henry M. and Florence E. Kelly to tezone land located at 1301 North Michigan Street. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. DEPARTMENTAL REPORTS Report of the Board of Public Works and Safety To the Common Council City of South Bend September 20, 1960 RE: Your Directive of September 13, 1960, with reference to a Motion made by Councilman Glass, Seconded by Council Lehman and duly Carried, concerning the possibility of procuring a patrol boat for the St. Joseph River in order to discourage speeding on the river, the followong actions was taken by the Board of Public Works and Safety at its meeting of September 19, 1960: The Chief of Police was directed to make an investigation of this and report his findings back to the Board. REPORT OF TRAFFIC ENGINEER Members of the Common Council South Bend, Indiana Gentlemen: September 22, 1960 Re: Petition bearing 1745 signatures requesting Traffic light at Lombardy and Western At the September 12th regular session of the Common Council a petition for installation of Traffic Lights at Western and Lombardy was presented by Councilman Muszynski. I have forwarded this petition to the State Highway Department at LaPorte District and will report back to the Council as soon as results and recommendations have been received from the Traffic Engineer of that district. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14th DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (2254 Portage Avenue) Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE recommended favorably to the Council that the petition be withdrawn. /s/ T. Scott and 710 West Washington), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE POSTPONED UNTIL THE , MEETING ON OCTOBER 10th. /s/ T. W. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14th day OF JUNE, 1948, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (E. ORDINANCES, THIRD READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, ON THE 14th DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (2254 Portage Avenue) Councilman Coleman made a motion that the Council accept the withdrawal of the petition. Councilman Lehman seconded the motion. Motion carried. ORDINANCE NO. 4336 - - -60 AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14th day of JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. Councilman Glass made a motion for a five minute recess. Coun- cilman ladewski seconded the motion. Motion carried. The Council "recessed at fi:55 P.M. The Council reconvened at 8:15 P.M. Councilman Glass made a motion to table the Ordinance until October 10, 1960. Councilman Allen seconded the motion. Councilman Lehman asked for a roll call vote. Motion carried by a roll call vote of 6 ayes, 3 nays (Councilmen Coleman, Lehman and Muszynski). ORDINANCE NO. 4337 - - -60 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, - CERTAIN LANDS The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4338 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE 1959 GENERAL STREET IMPROVEMENT FUND $5,494.31 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4339 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN STREET DEPARTMENT, SANITATION DEPARTMENT, CITY JUDGE, POLICE DEPARTMENT, AND WEIGHTS AND MEASURES IN THE AMOUNT OF '$10,984.00 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE AN ORDINANCE TO REGULATE AND CONTROL THE SALE AND USE OF PLASTIC COVERINGS OR BAGS The President announced that this Ordinance would be continued, as per action of the Committee of the Whole. Communication The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: September 23, 1960 The attached proposed ordinance originated by the City Planning Commission relative to adoption of the Master (Comprehensive ) Plan by ordinance was legally advertised on August 1, 1960 and given public hearing under date of August 11, 1960.. The following action was taken- After due consideration it was moved, seconded, and unanimously carried that the proposed ordinance be approved and submitted to the Common Council for adoption. ORDINANCE, FIRST AND SECOND READING MASTER COMPREHENSIVE PLAN ORDINANCE FOR THE CITY OF SOUTH BEND, INDIANA AND ITS ENVIRONS` The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the ordinance be referred to the Committee of the Whole who will have a meeting to consider the Ordinance and then set it for public hearing at a later date. Councilman Muszynski seconded the motion. Motion carried. OLD BUSINESS Councilman Muszynski requested the Traffic Engineer to make a report at the next meeting of the Council as to the Progress being made on control at Sample and Mayflower Road. Councilman Lehman moved to amend the above request by including "all arterial streets" in the request. Councilman Glass seconded the motion. Motion carried. Councilman Tellson asked about enforcement of the anti -noise Ordinance in that heavy trucks and other vehicles were causing so much noise on Michigan Street as well as on other thoroughfares. Mr. Irving Smith, City Attorney, stated that the rerouting of trucks is in progress and should be completed soon and therby noisy vehicles should be removed from main streets. Councilman Tellson made a motion that the oral report of the City Attorney be ac- cepted. Councilman Muszynski seconded the motion. Motu carried. There being no further business before the Council, Councilman Glass made a motion to adjourn. Councilman Coleman seconded the motion.
