Voorde began and was able to carry through until his untimely death. I want you to know that my office and my department heads will always be available for consultation and information for your body at any and all times. REPORT OF PARK DEPARTMENT Mr. Paul Krueper, Jr. Councilman Drom Fourth District South Bend, Indiana Dear Councilman Krueper: August 12, 1960 This Department has been notified by the City Clerk's Office that you would like to have a report on the extent of Dutch elm disease in South Bend and what is being done to curb it. First I should like to refer you to Chapter 30 of the South Bend Code which is the ordinance coverning trees and shrubs. This ordinance in substance places the responsibility for the planting, care, trrimming and removal of trees upon the owner of such real estate. In case of emergency work on the trees or removals may be made by the Park Department. We estimate such emergencies, caused by storms, cost to the Park Department from $5,000.00 to $,10,000.00 per year. I have been sending articles to the newspapers concerning Dutch elm disease since 1955 in order that our citizens may be made aware of the situation. In 1956 we made a survey.of street treesein South Bend and found that there were a total of 8,267 American Elms along our streets. At the same time a study in our parks revealed a total of 5,602 American Elm trees. We had only seven cases of Dutch elm disease in South Bend in 1955. Since then the disease has spread rapidly. In March, 1956, we requested all licensed arborists and nurserymen to attend a meeting at the Park Administration Building. At this meeting we explained Dutch elm disease, showed a 20 minute film on the disease and furnished all persons present with mimeographed directions for -formulations to be used in preventative spraying. We also set up a reporting system and furnished all licensed arborists with mimeographed forms for such a report. Howe with no State law or City ordinance to require observance the system failed because of apathy. For your information I am enclosing some of the mimeographed material furnished to newspapers and arborists. We requested and received an increase in our Park Budget funds to buy spray materials to be used on elms in our Parks. However, in spite of our efforts we have presently, by count last week, a total of 104 American elms which are dead or dying in the parks. These trees are being removed as rapidly as our small forestry department can handle them. Probably all of the elms which will die this year are already dead or show positive indication, of the disease. Many of the park dead elms have had a preventative spray. However, this spring was wet, cold and windy and it was impossible for us to spray all of our park elm trees in the short period when weather was favorably A check of permits to remove street trees made on August 11th reveals that 234 permits have been issued in 1960 up to that time for the removal of dead or dying elm trees in the tree and lawn areas. We have no way of knowing how many have been removed from rear and side yards. A drive around South Bend will disclose perhaps one hundred or more dead or dying elm trees which have not been removed at this time. We have approximately fifty calls per week to our office concerning street trees. Not- withstanding all of the newspaper publicity on this matter a good share of our citizens believe that the cost of operating a department for trimming and removal of street trees is included in their taxes. Of course this is not true. If a street tree program were to be adopted this would cost an additional $100,000.00 or more per year. This estimate is based on the cost of a similar department at Fort Wayne which is called "Tree Preservation" and had a budget of $120,000.00 in 1960. In conclusion, information concerning the feasibility of saving the elms by a costly preventative spray program is highly controversial. Some experts believe that it is a waste of money and all of the elms will eventually die anyway. There are some that claim the loss can be reduced to approximately three per cent of the total number per year. A few years ago I was informed that out Indiana State Entomologist recommended that no state legislative measures be taken to provide an Act for care and removal of elms affected by the disease and so far as I know this advice was followed. COMMUNICATION 819 Corby Boulevard South Bend, Indiana August 30, 1960 City Council City Hall South Bend, Indiana Dear Sirs: Last Friday, I had need to call on the Howard Park Recreation Department for a supply of athletic equipment for a large picnic. I dealt-with a Mrs. Mildred Seick and a Mr. Peter Ranich, and may I say, it was a very pleasant experience. The attention and interest shown was most gratifying, and certainly rare in this hurried world of ours. I'm also happy to say they demonstrated that courtesy is not yet completely passe'. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: September 12, 1960 The attached petition of Joseph and Stella Mrozek, to rezone One -Half of Lots 215 and 216, Kaley's 2nd Subdivision, more commonly known as 501 North Olive Street from "B" Residential Use and f1B" Height and Area District to "C" Com- mercial Use and "C" Height and Area District was legally advertised on August 22, 1960 and given public hearing under date of September 8, 1960. The following action was taken: After due consideration the Commission found that since a commercial establishement has been located upon the subject property for many years and commercial zoning exists on the other three corners of subject intersection the petition should be granted. E. Smith's Subdividion of Lots Nos., 38, 39, 40 and 41 in Second Plat of Shetterly Place Addition to the City of South Bend, also a tract or parcel of land 42 feet in width taken off and from the entire length of the Northwesterly side of Lot No. 42 in the Second Plat of Shetterly Place, and also a tract or parcel of land 8 feet in width taken off of and from the entire length of the Southeasterly side of Lot No. 42 and a tract or parcel of land 46 feet in width taken off of and from the entire length of the Northwesterly side of Lot No. 43 in the Second Plat of Shetterly Place, the above listed properties being more generally described as lying in the 700 block of Portage Avenue, from "B" Residential Use to "C" Commercial Use was legally advertised on August 22, 1960 and given public hearing under date of September 8, 1960. The following action was taken: After due consideration the Commission found that the proposed zoning represented a continuation of strip zoning and this accompanied by the large amount of existing commercial zoning in the immediate area being used other than for commercial purposes clearly shows the need for no additional commercial zoning in'the area and the petition therefore should be denied. Peterson, Sacred Heart Church for Diocese of Fort Wayne, Inc., to annex to the City of South Bend the following described property: Beginning at a point in the SW'k, Sec. 27, T38N, R2E, at the intersection of the East -West centerline of Section 27 and the present North -South city limits, thence South along said City Limits for a distance of Six Hundred Eighty and Seventy -Four Hundredths (680.74) feet to a point of intersection of said City Limits and the North line of Highland Cemetery extended East, thence West along the North line of Highland Cemetery for a distance of Five Hundred Eighty (580) feet, more or less, to a cross in a concrete marker, thence North for a distance of Six Hundred Eighty and Seventy -four Hundredths (680.74) feet to the East -West centerline of said Section 27, thence East along the East -West centerline of said Section 27, for a distance of Five Hundred Eighty (580) feet, more or less, to the point of beginning containing approximately Nine (9) acres was legally advertised on August 22, 1960 and given public hearing under date of September 8, 1960. The following actiot was taken: After due consideration the Commission found that in their opinion: 1. The annexation is in the best interests of the city and of the territory sought to be annexed 2. The area is urban in character, being an economic and social part of the annexing city. 3. The city is financially able to provide municipal services to the annexed area within the reasonably near future, 4. The area sought to be annexed is needed for development of the city in the reasombly near future. 5. The lines of the annexation are so drawn as to form a compact area abutting the municipality. The following action was taken: After due consideration the Commission found that since the area in question has been zoned commercially for thirty years and as yet has not been so used is a clear indication that commercial use of the property is unlikely and that since the majority of the land in the immediate area is zoned "A" Residential and sufficient commercial zoning exists in said general area that the petition should be recommended favorably. ORDINANCE NO. 4335 - - -60 AN ORDINANCE APPROVING A CONTRACT BY AND BETWEEN THE BOARD OF WATERWORKS COMMISSIONERS FOR AND ON BEHALF OF THE CITY OF SOUTH BEND AND CLYDE E. WILLIAMS AND ASSOCIATES The Ordinance was given first reading by title and second reading in full. Councilman Ladewski made a motion for suspension of rules. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Allen). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1. absent (Councilman Allen). RESOLUTION WHEREAS, on the 14th day of August, 1960, FRED LAKE, of the City of South Bend, Indiana, represented the City of South Bend in the Soap Box Derby at Akron, Ohio; and, WHEREAS, because of the tedious preparation in the building of his Soap Box Derby entry, as well as his practice and diligence, the said FRED LAKE w&6 able to be the winner of the first prize of all America in said Soap Box Derby; and, WHEREAS, the achievement of FRED LAKE has brought great renown to FRED LAKE and the City of South Bend; and, WHEREAS, the City Administration is most pleased with this achievement and with the notice brought to our City and further pleased that a member of our community has been able to compete successfully in said contest and be the winner. NOW, THEREFORE, BE IT RESOLVED That the Common Council and the City Administration express to FRED LAKE its appreciation and best wishes and congratulations for a job well done. God, in His Infinite Wisdom, has called from this life EDWARD FRANCIS VOORDE, Mayor of the City of South Bend; and, WHEREAS, his death has brought much grief and sorrow to his family, his friends, the City of South Bend, the County of St. Joseph, and the State of Indiana; and, WHEREAS, he was born and raised in the City of South Bend, and served the Township and the City in government service for many, many years last past up to and including the day of his death; and, all; and, WHEREAS, his efficiency, ability and capabilities in government are known to WHEREAS, his term of office as Mayor of the City of South Bend, beginning in 1956 and continuing to his untimely death, has been one of outstanding service to the community, and the City has progressed and benefited greater than ever before; and, WHEREAS, his kindness, charity and devotion to people in all walks of life, regardless of creed, color or religion, was a matter of notice to all; and, WHEREAS, his concern for his fellow man was most important in all his endeavors° as well as his concern and love for his family; and, WHEREAS, our Community has suffered a most tremendous loss by his death by virtue of his public service as well as his philanthropic and human service to the people of the community, his family and his church. NOW, THERFORE, BE IT RESOLVED: That we, the Common Council of the City of South Bend, on our own behalf, and on behalf of the elected officials, appointed officials and employees of the City of South Bend, do hereby extend to the entire family of EDWARD FRANCIS VOORDE our most sincere sympathy in this, their, as well as our, deepest hour of sorrow. BE IT FURTHER RESOLVED That a page in the Council Records of the City of South Bend be set aside and this Resolution be copied therein and a copy duly certified by the Clerk be sent to his family. /s/ JOSEPH T. Councilman Muszynski presented a petition bearing 1,745 signatures requesting a traffic light at Western Avenue and Lombardy Drive and publicly complimented the women who obtained the signatures on the petition.
