The meeting was called to order by Joseph T. Kroll, President, who presided. ROLL CALL Present: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: _ e1ULL 67,1`70.1 Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. I COM153NICATIONS July 22, 1960 The Honorable Common Council City of South Bend South Bend, Indiana lGentlemen: Submitted herewith is the recommended Six -Year Capital Improvement Program for 1961 -1966 for the City of South Bend. This report is submitted in c6mpliance with Chapter 174, Section 35, Sub - i Section 4, of the Acts of the General Assembly of 1947. This new program includes projects submitted by all municipal departments of the City of South Bend including the Schobl City of South Bend. On 21 July 1960 the Planning Commission accepted a committee report recommending the adoption of the program and after thorough consideration unanimously recommended it favorable to the Council for adoption by ordinance. Councilman Tellson seconded the motion. ,Motion carried. TITIONS petition was received from Jack Frost et al asking to rezone land in 700 block Portage Avenue. Councilman Tellson made a motion that the petition be referred to the City Planning Commission. Councilman Krueper seconded the motion. Motion carried. petition was received from Simon and Mary Krizmanich to rezone land at 119 S. Scott Street. ouncilman Muszynski made a motion that the petition be referred to the City Planning Commission. ouncilman Lehman seconded the motion. Motion carried. petition was received from Ira. and Opal Kendall to rezone land at 710 W. Washington Street. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. ouncilman Ladewski seconded the motion. Motion carried. A petition was received from Monsignor Peterson to annex land west of Portage Road on Colfax Road. �ICouncilman Ladewski made a motion that the petition be referred to the City Planning Commission. ,Councilman Allen seconded the motion. Motion carried. A petition was received from Joseph & Stella Morz�k to rezone land at 501 N. Olive St. Councilman Ladewski made a motion that the petition be referred to the City Planning Commission, Councilman Lehman seconded the motion. Motion carried. REPORT OF BOARD OF PUBLIC WORKS & SAFETY I To The Common Council July 20, 1960 City of South Bend RE: Your Directive of July 12,196o Gentlemen: With reference to your Directive of July 12, 1960 concerning the motion made by Councilman Tellson at the July 11 Regular Meeting of the Council, the Board of Public Works end Safety at its meeting on Monday, July 18, 1960, took the following action: In accordance with a Directive from the Office of the City Clerk, dated July 12, 1960, a motion made by Councilman Tellson at the regular meeting of the Council on July 11, 1960 that the New Jersey Railroad be contacted to repair their Prairie and Kemble crossing was referred to Clem Hazinski, Traffic Engineer. The Board directed the Traffic Engineer to contact the New Jersey Railroad, study the matter and report back to the Board at a future meeting. CC to: Traffic Engineer ES Respectfully submitted, /s /. REPORT OF TRAFFIC ENGINEER Members of t1m Common Council July 21, 1960 South Bend, Indiana Gentlemen: At the direction of the Board of Public Works and Safety reference a motion made at the July 11, 1960 meeting of the Council by Councilman Tellson an investigation was made of the railroad crossing at Kemble Street. It was found that there are three sets of tracks there. Those owned by the New Jersey, Indiana & Illinois Railroad and the Pennsylvania Railroad are in good repair having been attended to only recently. However, the street crossing of the New York Central tracks is in need of repair. I have notified that railroad of the condition requesting that immediate attention be given resulting in repair. REPORT OF BOARD OF 1HEALTH July 25, 1960 City Clerk City Hall South Bend, Indiana RE: Complaint received at Council Meeting of July 12, 1960 Please be advised that on July 15, 1960 the New York Central, New Jersey and Grand Trunk Railroads have been contacted regarding the weeds at the Arnold Street Crossing and at Harris, Walnut and Ford Streets; same has been cut and cleared. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole,to whom was referred AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR 1961,Respectfully report that they have examined the matter and that in their opinion it should be reported favorable as amended. /s/ T.W. ORDINANCE NO. 4327 - - -60 AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1961 AS AMENDED The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE. FIRST AND SECOND READING AN ORDINANCE TO REGULATE AND CONTROL THE SALE AND USE OF PLASTIC COVERINGS OR BAGS. The Ordinance was given first reading by title and second readiin i gull Councilman Muszynski made a motion that the Ordinance be set for Public Hearing on Auus ,1960. Councilman Coleman seconded the motion. Motion carried. REGULAR MEETING ORDINANCE 28 -60`. AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND INTERNATIONAL HARVESTER COMPANY FOR THE PURCHASE OF ONE TWO*: TON DUMP TRUCK FOR THE SUM OF $3,179.79 229 The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion for suspension of the rules. Councilman Allen seconded the motion, Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes and 0 nays. ORDINANCE,FIRST AND SECOND READING AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITY OF SOUTH BEND, INDIANA AND INDIANA AND MICHIGAN ELECTRIC COMPANY The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for Public Hearing on August 8,1960. Councilman Coleman seconded the motion. Motion carried. NEW BUSINESS Councilman Muszynski moved that a special meeting of the Council be held on Monday, August 1st in order to comply with the dates the State Board of Accounts has set for hearing the Budget. Councilman Tellson seconded the motion. Motion carried, and a call for a special meeting will be sent out. Councilman L.adewski stated that the intersection of Edison and South Bend Avenue was a busy one and that a traffic signal or some other traffic control device should be installed. He moved that this be referred to the Traffic Engineer for study and report. Councilman Tellson seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Tellson made a motion to adjourn. Councilman Coleman seconded the motion.
